"Jika kawasan pada umumnya memilih untuk hanya mendukung universalitas HAM, maka tidak demikian bagi ASEAN. Ia mendukung prinsip universal melalui instrumen-instrumen HAM internasional. Dengan bersamaan, ia membuat AHRD yang turut mengatur bahwa HAM harus ditegakkan dengan mempertimbangkan partikularitas regional maupun nasional. Penelitian ini menganalisis bagaimana diskursus kontestasi HAM menjelaskan pembuatan AHRD tersebut. Penelitian ini berupaya mendapatkan penjelasan yang mendalam dan tuntas melalui pendekatan kualitatif dan interpretatif. Penelitian ini juga menggunakan logika dari Queer Theory yang memungkinkan untuk mengalisis kasus tersebut. Ternyata ditemukan bahwa ketika AHRD dianalisis dengan menggunakan teori tersebut, AHRD dapat dipahami sebagai dokumen yang menawarkan jawaban bagi kebutuhan realita sosial ASEAN.

Regions in general choose to only support universality in human rights. However, ASEAN supports universality through various international instruments. At the same time, the region also supports particularity through its AHRD by considering both regional and national particularities. This research aims to see how the contestation between both principles explain this case. In doing so, this research uses qualitative and interpretative approaces to achieve deep and thorough explanations. It also uses the logics of Queer Theory in realising such goal. When AHRD is analysed using that logic, it is found, that the document offers answers to ASEAN’s social reality."

"Manga boys love (BL) merupakan salah satu budaya pop Jepang yang telah mendunia, berfokus pada kisah hubungan romantis antara laki-laki yang menghadirkan sejumlah tokoh-tokoh homoseksual dengan spektrum identitas gender yang beragam. Penelitian ini menganalisa proses “konstruksi identitas gender” tersebut, khususnya melalui tokoh Karasuma dalam manga BL bergenre omegaverse dengan judul Kurui Naku no wa Boku no Ban karya Kusabi Keri. Metode yang digunakan dalam penelitian ini adalah metode deskriptif analisis dengan Queer Theory dari Judith Butler, didukung oleh konsep gender performativity dan gender identity sebagai pilar utama teori tersebut. Hasil penelitian menunjukkan bahwa Karasuma sebagai seorang tokoh omega, awalnya digambarkan sebagai seorang “laki-laki” dengan identitas gender feminin, lemah, dan inferior sehingga kerap mengalami diskriminasi dan perlakuan tidak senonoh oleh kelompok alpha, kelompok laki-laki dengan identitas gender maskulin, dominan, kuat, dan superior. Namun Karasuma berusaha mengubah identitas gender feminin yang dilekatkan padanya, dengan mendobrak norma dan relasi gender tradisional yang berlaku melalui berbagai perlawanan dan strategi, atau “gender performativity”—mengikuti terminologi Butler—hingga berhasil mengonstruksi identitas gendernya sendiri, dan melahirkan identitas gender yang baru, yang disebut oleh Butler sebagai “identitas gender ketiga” atau masculine female. Sebagai genre narasi yang diproduksi dan dinikmati perempuan, Kurui Naku no wa Boku no Ban pun menjadi salah satu wacana baru yang mendekonstruksi gagasan heteronormativitas dalam masyarakat Jepang.

Boys Love manga (BL) is a worldwide Japanese pop culture, focusing on the story of romantic relationships between men which presents homosexual figures with diverse set of gender identities. This study analyzes the process of "construction of gender identity", specifically through the character Karasuma in the BL omegaverse manga titled Kurui Naku no wa Boku no Ban by Kusabi Keri. This research uses descriptive analysis method in Judith Butler’s Queer Theory and is supported by the concept of gender performativity and gender identity. This research finds that Karasuma as an omega figure, was initially described as a male with feminine, weak, and inferior gender identity, as a result, he often experiences discrimination and indecent treatment by alpha characters or men with masculine, dominant, strong, and superior traits. However, Karasuma tried to change the feminine gender identity attached to him, by opposing traditional gender norms and relations through various resistances and strategies, or "gender performativity"—following Butler's terminology—to succeed in constructing his own gender identity, and thereby generate a new gender identity that is what Butler calls "third gender identity" or masculine female. As a narrative genre that is produced and enjoyed by women, Kurui Naku no wa Boku no Ban has become a new discourse that deconstructs the idea of heteronormativity in Japanese society."

Seksualitas adalah bagian penting dari kehidupan manusia. Dengan pentingnya seksualitas bagi manusia, pembatasan terhadap individu dengan seksualitasnya kemudian mencerabut individu dari kehidupannya. Heteroseksisme menjadi salah satu yang membatasi individu dari seksualitasnya, khususnya individu dengan seksualitas alternatif. Melalui cara pikir biner, heteroseksisme membatasi seksualitas alternatif untuk hadir dalam ruang pemahaman. Queer theory kemudian menjadi kritik terhadap heteroseksisme demi membuka ruangruang kemungkinan dalam seksualitas, melepaskan cara pikir biner dan membawa seksualitas alternatif keluar dari ruang ketidak-pahaman.

ABSTRACT

Sexuality is an important part within the life of human. Having such importance in individual?s life, any forms of constrains towards individual?s sexuality therefore estrange individual from their own life. Heterosexism becomes one of the constraints parting individual from their sexuality, especially those bearing alternative sexuality. Through the binary framework, heterosexism constrains alternative sexuality to exist in the intelligibility sphere. Queer theory then appears as a critique towards heterosexism in order to open up the possibilities within sexuality, liberating sexuality from the binary framework and freeing alternative sexuality from the unintelligibility sphere.<.p>"

"Skripsi ini membahas mengenai kelompok minoritas seksual LGBTIQ schagai subjek hak dan hubungannya dengan negara schagai institusi penjamin hak asasi manusia. Penelitian ini menggunakan metodc analisis deskriptif dan studi kepustakaan. Hasil dari pcnclilian ini menyatakan bahwa ada keperluan untuk menguhah konsep 11AM schagai sesuatu yang terkonstruksi secant social agar kelompok minoritas seksual LG13'I IQ dapat diakui sebagai subjek hak dan mendapatkan penghormatan, pemenuhan, serta perlindungan atas hak dan kepentingan mereka dari negara. Sislem negara demokrasi menjadi wadah politik yang sesuai untuk memherikan emansipasi kepada kelompok minoritas seksual LGBTIQ.

This thesis discussed about sexual minority group LGBTIQ as the subject of rights and its relation with the state as the human rights guarantor institution. This research used analitical descriptive and bibliography study methods. The result of this research declares that there is a need to change the conception of human rights into something that construct socially so that the sexual minority group LGBTIQ can he recognized as the subject of rights and get hold of respect, fulfillment, along with protection for their rights and interests that come from the state. The democracy state system became an appropriate political institution to give the sexual minority group I.GBTIQ emancipations."
