"ABSTRAKAdalah sesuatu pilar demokrasi adalah masyrakat madani, yang salah satu perujudan utamanya berupa organisasi kemasyarakatan (ormas). Seiring proses demokratisasi pasca-reformasi 1998, di berbagai kota di Indonesia bermunculan banyak ormas, baik yang lingkup kegitanya di tingkat nasional maupun daerahh. kemunculan ormas-ormas ini merupakan ekspresi hak untuk berkumpul, berserikat, dan berpendapat yang dijamin oleh UUD 1945. Menyikapi perkembangan tersebut, berbagai regulasi dikeluarkan olehpemerintah. penerapan regulasi ini pun mengalami dinamika dari waktu ke waktu. Tujuanya menjamin hak konstitusional warga negara dengan memfasilitasi dan mengoptimalkan kehadiran ormas yang berkontribusi bagi tercapainya tujuan nasional."

"Pengesahan Peraturan Pemerintah Pengganti Undang Undang, No. 2Tahun 2017 tentang Keormasan (Perppu Ormas) sebagai UU dan pengesahan UU No.5 Tahun 2018 tentang Terorisme adalah sebuah capaian kebijakan strategis dalam sektor keamanan nasional yang dapat dimanfaatkan oleh pemerintah maupun masyarakat sipil untuk membendung kiprah kelompok-kelompok radikal di Indonesia, terutama (namun tak terbatas pada) mereka yang terkait dengan gerakan-gerakan Islam radikal, baik yang diketahui menggunakan pendekatan kekerasan maupun yang tidak. Pemetaan yang tepat terhadap perkembangan kelompok radikal, pada tataran lingkungan strategis global, regional, dan nasional, penting dilakukan karena akan menjadi landasan bagi pembentukan kebijakan publik yang lebih luas dan mendalam tekait penanggulangan radikalisme dan gerakan radikal di masa depan. Analisis kualitatif deskriptif yang dilakukan penulis berdasarkan data-data, dokumen dan fenomena yang terjadi menunjukkan bahwa pengesahan Perppu Ormas No 2 Tahun 2017 dan UU No 5 Tahun 2018 tentang Terorisme mempunyai dampak signifikan jika diikuti dengan tindakan-tindakan tegas oleh penegak hukum."

"Pusat Pelaporan dan Analisis Transaksi Keuangan (PPATK) telah melakukan penghentian sementara transaksi 92 rekening Front Pembela Islam (FPI) dan afiliasinya. Walaupun telah habis jangka waktu berakhirnya penghentian sementara transaksi, dalam sejumlah kasus ditemukan rekening yang tidak dapat digunakan sebagaimana semestinya. Metode penelitian yang digunakan adalah penelitian kepustakaan dengan tipe yuridis-normatif. Hasil penelitian menunjukan bahwa PPATK dalam melaksanaan penghentian sementara transaksi telah sesuai dengan ketentuan yang ada, serta memiliki alasan dan dasar kewenangan yang kuat untuk melakukan upaya demikian. Sebagai nasabah beritikad baik yang merasa hak dan kepentingannya dirugikan, dapat mengajukan keberatan secara langsung terhadap PPATK. Nasabah dapat menggunakan layanan pengaduan terhadap bank yang belum mencabut penghentian sementara transaksi meski sudah habis jangka waktunya, maka dapat menggunakan layanan pengaduan yang dimiliki oleh masing-masing bank. Jika nasabah tidak puas, maka dapat mengupayakan penyelesaian lewat LAPS SJK dan pengadilan negeri maupun pengadilan agama bagi bank syariah.

On January 20th, 2021, Indonesian Financial Transaction Reports and Analysis Center (PPATK) had temporarily postponed the transactions of 92 accounts of Islamic Defender Army (FPI) and its affiliates. Even though the time period for the postponement held by PPATK had expired, several accounts were found that could not be used properly. The research method used in this thesis is juridical-normative type and qualitative data management. PPATK in carrying out the postponement of transactions on 92 FPI’s accounts and their affiliates  has complied with existing provisions, and has a strong reason for authority to make such efforts. As a good faith customer, they can appeals with the objection to PPATK in firsthand and use the complaint service owned by each bank for accounts whose transaction status has not been revoked by the bank concerned even when the time limit of postponement was over. If the customer is not satisfied, then they can seek a settlement through the LAPS SJK and the district court as well as the religious court for Islamic banks."

"Dibalik segi positif dari proses demokrasi yang berlangsung, terselip celah masalah baru yaitu ancaman disintegrasi bangsa. Kekhawatiran itu tak hanya bersumber dari tuntutan pemisahan diri sebagian rakyat di beberapa daerah, tapi juga lantaran maraknya kerusuhan sosial di daerah, konflik antar ormas, konflik sengketa pemilu baik tingkat nasional maupun tingkat pilkada, konflik sengketa tanah perkebunan, dan konflik kerusuhan sosial lainnya yang berkembang menjadi pertentangan. Dalam konteks penanganan konflik antar ormas terkait dengan aksi kekerasan sebagaimana marak terjadi dan menjadi keprihatinan banyak kalangan, juga suatu kepentingan nasional. Bahkan, keselamatan publik serta hak dan kebebasan orang lain terancam oleh tindakan yang mengatasnamakan suatu organisasi. Penelitian ini bertujuan untuk menelaah sejauh mana peran penegak hokum, khususnya Baintelkam Polri dalam upaya penanggulangan konflik antar ormas di DKI Jakarta dan langkah-langkah optimalisasi peran tersebut.

Behind the positive aspects of the ongoing democratic process, a new problem is tucked in, namely the threat of nation disintegration. The concern was not only stemmed from the demand for secession of some people in some areas, but also because of the rise of social unrest in the regions, conflicts between CSOs, election disputes both at the national and local election levels, conflicts over plantation land disputes, and other social conflict conflicts that developed be contradictory. In the context of handling conflicts between CSOs related to acts of violence as widespread and is a concern of many, it is also a national interest. In fact, public safety and the rights and freedoms of others are threatened by actions in the name of an organization. This study aims to examine the extent of the role of law enforcers, particularly the Indonesian Police's Baintelkam in efforts to overcome conflicts between CSOs in DKI Jakarta and steps to optimize that role."

"ABSTRAKArtikel ini membahas mengenai organisasi kemasyarakatan (ormas) di Jakarta yang bertransformasi dari basis kekerasan menjadi basis kontribusi positif. Setidaknya terdapat tiga kategori pendekatan yang umum digunakan dalam menjelaskan ormas berbasis kekerasan pada studi-studi sebelumnya, yaitu; ekonomi-politik, kultural, dan keamanan. Namun, hari ini ormas dihadapkan dengan ketegasan dari pemerintah, bagaimana ormas menyikapi situasi demikian? Bagaimana cara ormas dan anggota-anggotanya bertahan hidup dikala sudah tidak ada tempat untuk jago jawara ataupun preman? Lantas seperti apa kondisi ormas berbasis etnis dikemudian hari? Artikel ini berargumen bahwa melalui pilihan yang rasional, ormas membangun reputasinya melalui kontribusi positif pada masyarakat, bukan lagi melalui kekerasan. Bagi ormas ini bermakna sebuah proses dalam beradaptasi dengan regulasi pemerintah. Bagi anggota, ini merupakan cara mereka untuk mendapat penerimaan di masyarakat. Pendekatan yang digunakan dalam penelitian ini adalah kualitatif dengan studi kasus pada ormas Forum Rempug Betawi (FBR) selaku ormas berbasis etnik di Jakarta. Pengumpulan data primer dilakukan melalui wawancara mendalam terhadap anggota FBR dan masyarakat yang bersangkutan. Data primer akan diolah menggunakan analisa narasi.

ABSTRACTThis article discusses ormas in Jakarta that are transformed from the violenced based to the community support based. At least three appraches were used in previous studies; political-economics, cultural, and security. However, today ormas are faced with strict regulation from the government, how does ormas respond to such situation? How do ormas and their members survive as there is no place for jago or preman today? This article argues that is through rational choices, ormas build their reputation around postive contribution to the society, not through violences. The approach used in this study is qualitative with a case study at the Forum Rempug Betawi (FBR) as ethnics based ormas in Jakarta. Primary data collection is done through interviews with FBR members and the community concerned. Primary data will be processed using narrative analysis."

"Provinsi Aceh resmi memasuki era pascakonflik pada tahun 2005, dalam bagian pembangunan perdamaian pascakonflik, Konflik Lokal masih bereskalasi antarwarga, antardesa, antarsuku, dengan pemerintah daerah, dengan aparat keamanan setempat, antara pelajar, dan konflik kelompok lainnya. Studi ini mengkaji keterkaitan Lembaga Swadaya Masyarakat (LSM)/Organisasi Masyarakat (Ormas) terhadap peluang terjadinya konflik lokal di desa-desa di Aceh. Kami menggunakan data Survei Desa (Podes) Indonesia tahun 2008, 2011, 2014, dan 2018 dari Badan Pusat Statistik, serta didukung dengan hasil wawancara dengan 20 kepala desa. Kami menggunakan Logit Biner untuk menghitung hubungan antara keberadaan LSM/CO dan peluang kemungkinan terjadinya konflik lokal. Hasil kami menunjukkan bahwa kehadiran LSM/CO di dalam desa meningkatkan kemungkinan terjadinya konflik lokal. Dan jika ada interaksi antara LSM/CO dan BPD di dalam desa, kehadiran LSM/CO mengurangi kemungkinan terjadinya konflik lokal di Aceh.

Aceh officially entered a post-conflict era in 2005, in its part of post-conflict peace development, the Local Conflict still escalated between citizens, between villages, between Ethnic, with local government, with the local security force, and between students and other group conflicts. This study examines the association of the Non-Governmental Organization (NGO)/Community Organization (CO)’s to chance of having local conflict in village in Aceh. we use the data of the Indonesian village survey (Potensi Desa/Podes) in 2008, 2011, 2014, and 2018 from statistics Indonesia, and supported with interview results with 20 village leaders. We use Binary Logit to quantify the association between NGO/CO existence and the chance of likelihood of the local conflict. Our results show that the presence of NGO/CO within the village increases the chance of the likelihood of local conflict. And if there is an interaction between NGO/CO and BPD within the village, the presence of NGO/CO is decreasing the chance of likelihood of local conflict in Aceh. "

"The ratification of Government Regulation in Lieu of Law No. 2/2017 concerning Community Organization (Perppu Ormas) and Law No.5/2018 concerning Terrorism is a strategic policy achievement in the national security sector that can be utilized by the government and civil society to stem the progress of radical groups in Indonesia, especially (but not limited to) those associated with radical Islamic movements, both those who are known to use violent approaches and those who do not. Appropriate mapping of the development of radical groups, at the level of global, regional and national strategic environments, is important because it will become the basis for the formation of broader and deeper public policies related to the fight against radicalism and radical movements in the future. Descriptive qualitative analysis based on the data, documents and phenomena that occur shows that the ratification of those laws have a significant impact if followed by decisive actions by law enforcement."
