Abstrak :
Grasi sangat dibutuhkan dalam pemerintahan suatu negara karena dapat meminimalisasi beberapa resiko yang dikhawatirkan sebagai akibat dari vonis yang dijatuhkan oleh hakim, khususnya untuk pidana maksimal seperti pidana mati, yaitu adanya kemungkinan terjadi eksekusi terhadap innocent people. Permasalahan timbul ketika seorang Terpidana mati mengajukan grasi dan kemudian permohonan grasi tersebut ditolak oleh Presiden, namun ketika akan dilakukan eksekusi mati, Presiden mengeluarkan perintah untuk menunda eksekusi mati tersebut, sehingga menyebabkan ketidakpastian hukum atas penolakan grasi tersebut, yang berakibat pula penegakan hukum atas tindak pidana narkotika menjadi hilang marwahnya. Hal tersebut terjadi dalam kasus penundaan eksekusi mati Mary Jane Veloso. Oleh karena itu, perlu dilakukan penelitian terkait dengan kewenangan Presiden dalam menunda pelaksanaan putusan yang telah berkekuatan hukum tetap, dan kebijakan Presiden dalam menunda eksekusi hukuman mati terpidana Mary Jane Veloso ditinjau dari asas legalitas. Berdasarkan penelitian, penundaan pelaksanaan putusan yang telah berkekuatan hukum tetap melalui grasi bukanlah upaya hukum, namun merupakan hak Kepala Negara untuk memberikan pengampunan kepada warganya yang dijatuhi putusan oleh pengadilan. Selain daripada itu, kebijakan presiden dalam menunda eksekusi hukuman mati terpidana Mary Jane Veloso ditinjau dari asas legalitas telah diatur dalam Pasal 1 ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan Undang-Undang Nomor 1 Tahun 2006 tentang Bantuan Timbal Balik Dalam Masalah Pidana serta Undang-Undang Nomor 15 Tahun 2008 tentang Pengesahan Treaty On Mutual Legal Assistance in Criminal Matters (Perjanjian tentang Bantuan Timbal Balik Dalam Masalah Pidana). Pengaturan ketentuan undang-undang tersebut merupakan upaya mewujudkan prinsip checks and balances, sehingga penggunaan kewenangan ini telah dibatasi, yaitu sebelum Presiden menentukan akan memberikan penundaan eksekusi hukuman mati, maka Presiden terlebih dahulu diharuskan mendapat pertimbangan dari Mahkamah Agung. ...... Grasi is indispensable in the government of a country because it can minimize some of the risk that is feared as a result of judgment imposed by the judge, especially for maximum punishment such as capital punishment, namely the possibility of execution of innocent people. The problem arises when a prisoner dies to pardon and then the request for pardon is rejected by the President, but when the execution will be executed, the President issued an order to delay the execution of death, thus causing legal uncertainty over the rejection of the pardon, resulting in law enforcement of crime narcotics become lost marwahnya. This happened in the case of the postponement of the execution of Mary Jane Veloso. Therefore, it is necessary to conduct research related to the authority of the President in delaying the execution of verdicts which have permanent legal force, and the President's policy in postponing execution of death sentence of convict Mary Jane Veloso viewed from the principle of legality. Based on the research, the delay in the execution of verdicts that have been legally enforced through pardon is not a legal effort, but it is the right of the Head of State to grant pardons to his citizens who are judged by the court. In addition, the president's policy in postponing the execution of the death penalty of convicted woman Mary Jane Veloso in terms of legality principles has been regulated in Article 1 paragraph (3) of the 1945 Constitution of the State of the Republic of Indonesia and Law Number 1 Year 2006 on Mutual Assistance In Criminal Matters and Law Number 15 Year 2008 on Ratification of the Treaty On Mutual Legal Assistance in Criminal Matters (Agreement on Mutual Assistance in Criminal Matters). The provision of the provisions of the law is an effort to realize the principle of checks and balances, so that the use of this authority has been restricted, ie before the President determines will give a delay execution of death penalty, the President must first be considered by the Supreme Court.

Dunia masih mengenal hukuman mati. berdasarkan data Amnesty International (AI), tercatat 128 negara yang telah menghapuskan hukuman mati tetapi masih banyak negara yang menerapkan hukuman mati seperti Amerika Serikat, Cina, Singapura dan Indonesia. Kontroversi hukuman mati dilatarbelakangi oleh pro dan kontra tentang alasan dan legitimasi dijatuhkannya hukuman mati tersebut.

Skripsi ini membahas hukuman mati sebagai salah satu bentuk sanksi terberat yang diatur dalam peraturan negara. Hukum positif Indonesia masih mengakui adanya mekanisme pelaksanaan hukuman mati, baik didalam Kitab Undang- Undang Hukum Pidana (KUHP), maupun di peraturan perundang-undangan yang lain. Dikaitkan dengan permasalahan hukuman mati ini, dikenallah Putusan Mahkamah Konstitusi Nomor 2-3/PUU-V/2007 tentang Pengujian Undang- Undang Nomor 22 Tahun 1997 tentang Narkotika terhadap UUD 1945, dimana permohonan uji materil ini diajukan oleh beberapa terpidana mati kasus narkotika. Permohonan mereka adalah agar hukuman mati dalam Undang-Undang Narkotika dicabut dan dinyatakan tidak berlaku lagi karena dinilai bertentangan dengan Undang-Undang Dasar 1945. Namun Mahkamah Konstitusi dalam putusannya menyatakan bahwa permohonan tersebut ditolak dan tidak dapat diterima. Skripsi ini juga akan membandingkan kasus hukuman mati yang dijatuhkan pada Rani Andriani Alias Melisa Aprilia (salah satu pemohon Putusan Mahkamah Konstitusi) dengan kasus hukuman mati yang dijatuhkan pada Abdul Azis Alias Imam Samudra. Selain itu, skripsi ini juga membahas mengenai prosedur pelaksanaan eksekusi hukuman mati di Indonesia dan permasalahan yang muncul mengenai penerapan Putusan Mahkamah Konstitusi Nomor 2-3/PUU-V/2007 dikaitkan dengan praktek pelaksanaan hukuman mati di Indonesia. ......This thesis discusses the death penalty as one of the toughest sanctions set forth in state regulations. Positive law in Indonesia is still recognizes the mechanism of this execution, both in the Penal Code and in the other legislation. This death penalty issue, then, will be related with the Constitutional Court Decision Number 2-3/PUU-V/2007 regarding Judicial Review of Law Number 22 of 1997 concerning Narcotics against Constitution of 1945, in which judicial review petition was filed by several death row cases of narcotics. Their application is for capital punishment in the Narcotics Act revoked and declared no longer valid because it considered contrary to the Constitution of 1945. But in the decision of the Constitutional Court stated that the request is rejected and unacceptable. This thesis will also compare the case of death sentences on Rani Andriani Alias Melisa Aprilia (one of the applicant's Constitutional Court Decision) in case of death sentences to Abdul Azis alias Imam Samudra. This thesis also discusses the procedure for execution of capital punishment in Indonesia and the problems that arise concerning the implementation of the Constitutional Court Decision Number 2-3/PUU-V/2007 associated with the practice of executions in Indonesia.

Abstrak :
In Indonesia's system law, drug crimes have death sentence (capital punishment). although capital punishment had been implementing as positive law in Indonesia but the efficacy of capital punishment as instrument of criminal policy still became debatable for Indonesia's criminologist and law practitioners. This thesis try to discover the effect of capital punishment toward prisoner's attitude to drug trading in Cipinang Prison. The basic theory as analyze in this research is deterrent theory from classical thinker Cecare Becaria and developed by modem thinker such as : Jhos Andenaes, Zimring and Hawkins, William Cambliss and etc. Research method applied in this thesis is survey quantitative approach. Population and sampling is drug prisoners (drug trader)in Cipinang Prison. The correlations and regressions analyze concludes R value= 0.925, determinant coefficient R = 0.885 and regression equations Y = 2.358 =-098765 + 0.249X3 + 0.707X4. From the analyze above we conclude that penalty would generally affect to learnt to the convicts for dealing with drugs. Deterrent effect of Capital Punishment would not depends on knowledge and perceptions of penalty, nevertheless it depends on perceptions to law enforcement and fear of capital punishment.
