Abstrak :
Para ahli sepakat bahwa bahan untuk penulisan Actio Pauliana ini sangal jarang. Konsep Actio Pauliana sudah lama dikenal, baik yang diatur di dalam Kitab Undang-Undang Hukum Perdata maupun yang diatur dalam Undang-Undang Kepailitan (Faillissements-Verordening, St). 1905-217 jo Stb. 1906 No. 348). Dalam tulisan ini Penulis akan lebih memfokuskan uraian Actio Pauliana dalam hubungannya dengan Perkara Kepailitan, sehingga nantinya tulisan ini dapat diharapkan memberi surnbangan kepada para Hakim, khususnya Hakim Pengadilan Niaga dan Kurator dalam memutus dan menangani Actio Pauliana ini. 1. Apakah yang dimaksud dengan Actio Pauliana itu ? 2. Kapan suatu perbuatan debitur dapat dianggap sebagai perbuatan curang atau beritikad tidak baik, sehingga merugikan para kreditur dan oleh karenanya dapat diajukan permohonan Actio Pauliana ? 3. Langkah-langkah apakah yang harus ditempuh oleh Kurator ketika mengetahui adanya perbuatan/tindakan debitur yang merugikan kreditur ? 4. Yurisdiksi peradilan manakah yang memeriksa dan memutus permohonan Actio Pauliana? 5. Apakah proses pemeriksaan permohonan Actio Pauliana tunduk pada jangka waktu pemeriksaan 30 (tiga puluh) hari seperti dalam proses pemeriksaan permohonan pailit? 6. Apakah ada kewajiban untuk diwakili oleh Penasihat Hukum seperti disyaratkan dalam Pasal 5 UU No. 4 Tahun 1998 mengenai permohonan pernyataan pailit? Apakah hambatan/kesulitan dalam proses Actio Pauliana ?

Penelitian ini berfokus pada pengukuran kinerja Pusjianbang menggunakan pendekatan Balanced Scorecard (BSC). Penelitian ini merupakan penelitian kuantitatif dengan didukung data kualitatif, dan analisisnya secara deskriptif analitis. Berdasarkan hasil penelitian yang dilakukan diketahui bahwa tingkat kinerja Pusjianbang dengan menggunakan pendekatan Balanced Scorecard adalah berada pada kualifikasi baik dengan total skor 34. Perincian pengukuran ini adalah sebagai berikut: kinerja pembelajaran dan pertumbuhan organisasi berada pada kondisi cukup baik yaitu dengan skor 14, kinerja proses bisnis internal berada pada kondisi baik dengan skor 8, kinerja pelanggan berada pada kondisi baik dengan skor 8, dan kinerja pada aspek keuangan berada pada kondisi sangat baik dengan skor 4 dengan tingkat penyerapan anggaran 94,14%. Guna meningkatkan kinerja organisasi maka Pusjianbang perlu melakukan langkah-langkah strategis. Berdasarkan hasil penelitian, ada beberapa aspek yang perlu diperhatikan yaitu: 1) aspek pembelajaran dan pertumbuhan, hal yang perlu diperhatikan adalah kemampuan pimpinan organisasi untuk menangani bawahan, pemberian penghargaan atau sanksi bagi pegawai, dan pola komunikasi dalam organisasi. 2) aspek proses bisnis internal, Pusjianbang hams memberdayakan secara optimal tenaga peneliti dari PTN atau LIPI agar terjadi transfer ilmu pengetahuan kepada personil Pusjianbang. 3) aspek pelanggan, Pusjianbang perlu untuk meningkatkan kualitas hasil penelitian dengan cara meningkatkan kualitas personil Pusjianbang dan validitas data hasil penelitian. 4) aspek keuangan, Pusjianbang harus dapat memanfaatkan secara efisien dan efektif agar anggaran yang telah dikeluarkan dapat menghasilkan produk penelitian yang berkualitas sehingga dimanfaatkan oleh unit utama. ...... This Research focuses on performance measurement at Policies Development and Studies Centre using Balance Scorecard Approach. This research is using quantitative method supported by qualitative data, and it is analyzed descriptively. Based on the result of this research, it is identified that the level of performance at Policies Development and Studies Centre using Balance Scorecard approach is in good qualification with total score 34. The details of this measurement are as follow. The performance of organization learning and growth is in sufficient condition with score 14. The performance of internal business process is in good condition with score 8. The performance of customers is in good condition with score 8 and the performance of financial aspect is in very good condition with score 4 and the level of budget realization is 94.14%. To improve the organization performance, the Policies Development and Studies Centre should implement strategic measures. Based on the result of this research, there are some aspects that should be focused on. 1) The learning and growth aspect: organization should give more attention to the ability of its managers to handle their subordinates, the award and sanction given to the employee, and communication pattern in organization. 2) The internal business process aspect: Policies Development and Studies Centre should empower the researchers from State Universities and Indonesian Science Institute optimally so there will be knowledge transfers to employees of Policies Development and Studies Centre. 3) The customer aspect: Policies Development and Studies Centre should improve the research quality by developing the quality of human resources in Policies Development and Studies Centre and also by improving the validity of research data. 4) The financial aspect: Policies Development and Studies Centre should utilize the budget efficiently and effectively in order to provide the high quality product of research and to be used by main units in Department of Law and Human Rights.

Penelitian ini merupakan penelitian kuantitatif dengan didukung data kualitatif, dan analisisnya secara deskriptif analitis. Berdasarkan hasil penelitian yang dilakukan diketahui bahwa tingkat kinerja unit VKSK dengan menggunakan pendekatan Balanced Scorecard adalah berada pada kualifikasi baik dengan total skor 4. Perincian pengukuran ini adalah sebagai berikut: kinerja pelanggan berada pada posisi baik dengan skor 4, kinerja pertumbuhan dan pembelajaran berada pada kondisi cukup baik yaitu dengan skor 3, kinerja proses bisnis internal berada pada kondisi dengan skor 4, dan kinerja pada aspek keuangan berada pada kondisi sangat baik dengan skor 4. Guna meningkatkan kinerja organisasi maka unit VKSK perlu melakukan langkah-langkah strategis. Berdasarkan hasil penelitian, ada beberapa aspek yang perlu diperhatikan yaitu: 1) aspek pelanggan, hal yang perlu diperhatikan adalah kemampuan petugas dalam mengatasi keluhan dan menyediakan tempat untuk menampung keluhan pelanggan. 2) aspek pertumbuhan dan pembelajaran, pemberian penghargaan dan sangsi terhadap penyelesaian tugas yang baik dan buruk perlu mendapatkan perhatian dari pimpinan agar bawahan juga merasa dihargai atas hasil usahanya. 3) aspek proses bisnis internal, prosedur untuk memperoleh VKSK jangan hanya berorientasi pada kemampuan pelanggan untuk membeli visa, tapi juga harus memperhatikan keamanan agar tidak merusak stabilitas keamanan negara. 4) aspek keuangan, pada aspek ini unit VKSK sudah memberikan yang terbaik dalam penggunaan anggaran, namun sebaiknya anggaran untuk perawatan elektronik dan prasana mendapatkan perhatian lebih dari Direktorat Jenderal Imigrasi agar pelayanan pemberian VKSK dapat berjalan dengan baik.

This research focused on the grating of the achievement of the VOA unit used the Balanced Scorecard approach (BSC). This research using method with quantitative researched by being supported by the qualitative data, and his analysis descriptively analytical. Was based on results of the research that was carried out it was known that the level of the achievement of the VOA unit by using the Balanced Scorecard approach was in the good qualification. These grating details were as follows: the achievement of the customer aspect was in the position was good with the score 4, the achievement of the growth and learning aspect was in the quite good condition that is with the score 3, the achievement of the process of the internal business aspect was in the condition was good with the score 4, and the achievement in finance aspect was in the condition was very good with the score 4. In order to increases the achievement of the organization then the VOA unit must carry out strategic steps. Was based on results of the research, there were several aspects that must be paid attention to that is: 1) the customer aspect, the matter that must be paid attention to was the official's capacity in overcoming the complaint and providing the place to accommodate the customer's complaint. 2) the growth and learning aspect, giving of the appreciation and doubt must towards the good and bad task resolution get attention from the management so that the subordinate also feels the subordinate was appreciated on results of his efforts. 3) the process of the internal business aspect, the procedure to receive VOA only should not be oriented in the customer's capacity to buy visas, but also must pay attention to the Security in order to not damage the stability of the security of the country. 4) financial aspect, in this aspect the VOA unit has given that was best in the use of the budget, but better the budget for the maintenance of electronics and equipment got attention more than Directorate General Immigration so that the VOA giving service could go well.

Campur tangan manusia terhadap alam mengakibatkan ketidakseimbangan alam. Hal ini juga berdampak pada terjadinya krisis air sebagai akibat dari ketidakseimbangan dalam siklus hidrologi. Untuk mencegah hal tersebut maka perlu dilakukan upaya konservasi air. Metode panen air hujan dengan cistern merupakan salah satu cara untuk melaksanakan upaya konservasi air tersebut. Penelitian yang dilakukan adalah dengan menganalisa curah hujan yang terjadi di Faklutas Teknik Universitas Indonesia Depok dan melihat peta penyebaran curah hujan tersebut serta merencanakan suatu panen air hujan sistem cistern di wilayah studi yang direncanakan untuk menampung sebagian dari curah hujan tersebut. Pengolahan data dilakukan dengan menggunakan teori-teori hidrologi dan menghitung efisiensi yang terjadi. Diharapkan dari hasil ini akan menjadi dasar pertimbangan pengadaan cistern di Fakultas Teknik Universitas Indonesia. ......Human.s interference of nature results unbalanced nature. Data processing by using theory of hidrologi and calculate the efficiency that happened. This result is expected will become base consideration of levying of cistern in Faculty Of Technique University Of Indonesia.
