ABSTRAK Pendaftaran Tanah Sistematis Lengkap PTSL merupakan upaya yang dilakukan pemerintah, karena terdapatnya proses sertifikasi yang lamban selama 36 tahun melalui PRONA sejak masa orde baru. Birokrasi dituntut untuk melaksanakan PTSL secara profesional, sesuai dengan payung hukum dan tidak terjadinya maladministrasi. Penelitian ini membahas bagaimana kesiapan birokrasi dalam implementasi PTSL, dengan studi kasus di Kecamatan Cibinong, Kabupaten Bogor. Penelitian ini menggunakan pendekatan post-positivist dengan teknik pengumpulan data melalui wawancara mendalam dan studi pustaka, serta teknik analisa data kualitatif. Hasil penelitian menunjukkan bahwa dari segi komitmen untuk berubah; adanya mekanisme perubahan PRONA ke PTSL, kuota penerima dan realisasi waktu pelaksanaan PTSL yang jelas dan baik. Dari segi kemampuan untuk berubah menunjukkan hasil: tuntutan bekerja telah terbagi secara proposional terdapatnya petunjuk teknis sebagai SOP PTSL, ketersediaan SDM dan anggaran, sarana dan prasaran yang memadai, terdapatnya kebijakan yang mengatur pelaksanaan PTSL, sistem informasi yang terkomputerisasi, tersedianya mitra kerja, serta terdapatnya partisipasi masyarakat. Disisi lain, terdapat beberapa hal yang menjadi faktor penghambat kesiapan, seperti terdapatnya waktu kerja yang berlebihan, mitra kerja yang kurang mendukung kesiapan birokrasi sehingga menimbulkan celah terjadinya maladministrasi, kurangnya pemahaman terhadap visi dan misi PTSL, partisipasi yang bersifat terbatas, serta tidak terdapatnya mekanisme pengaduan dan umpan balik dari masyarakat.
ABSTRACT The Comperhensive Systematic Land Registration or called by PTSL is the program made by The Government to completed the land certificate. The Reason of this Program, because the certification process for 36 years was plodding through PRONA since new orde era. In addition, The Bureaucracy required to carry out of this program in accordance with the regulations and againts the maladministration. This research describe about how bureaucracy readiness in implementation of PTSL with the case studies in Cibinong District. This research used the post positivist approach with techniques data collection through in depth interview and study literature and using qualitative technique to analyze data. The results of this study from change commitment rsquo s indikator there are a change mechanism from PRONA to PTSL, receivers quota and clear schedule. Change efficacy indikator show work demand was diveded accordance the structure and function, availability of standard operating procedure, availability of human resources and budget of implementation, good infrastructure and tools, availability of policy for implementationn, computerized information system, availability of partners and community participation during the implementation. On the other hand, there are some barrier of bureaucracy readiness like excessive work time, lack of partners supporting and causes the maladministration, lack of understanding of vision and mission of PTSL, participation is limited, there is no mechanism for complaints and feedback from the community.

Tesis ini membahas mengenai tumpang tindih sertipikat di atas suatu lahan akibat kesalahan administratif. Sertipikat yang cacat hukum administratif adalah sertipikat yang mengandung kesalahan prosedur, kesalahan penerapan peraturan perundang-undangan, kesalahan subyek hak, kesalahan obyek hak, kesalahan jenis hak, kesalahan perhitungan luas, data yuridis atau data fisik tidak benar, atau kesalahan lain yang bersifat administratif. Sertipikat yang cacat hukum administrative dapat memberikan ketidakpastian hukum sebagaimana yang diharapkan oleh pendaftararan tanah di Indonesia Penelitian ini merupakan suatu penelitian yang berbentuk penelitian normatif yang bersifat deskriptif. Hasil penelitian menunjukkan bahwa di Kecamatan Bojonegara pernah terjadi Penerbitan Sertipikat yang cacat hukum administratif yaitu penerbitan Sertipikat HPL atas Nama PT. Pelabuhan Indonesia II yang terletak di Kecamatan Bojonegara, Kabupaten Serang.

The focus of this Thesis is Overlapping Certificate of Right on Land as a result of an Administrative Law Deformed.Administrative Law Deformed Certificate is the certificate with the inaccuracy of procedure, the regulation application, the right subject, the right type, the width calculation, the incorrect judicial or physical data or other administrative inaccuracy. The administrative Law deformed certificate may cause the uncertainty of law as it is expected by the Land Registry in Indonesia. Research methods in this thesis is a normative legal research methods refers to the legal norms which is contained in the legislation that is descriptive research. The research result shows that in Bojonegara, has ever issued the Administrative Law Deformed Certificate, which was the issuing of Certificate HPL upon the name of PT. Penelitian ini membahas mengenai penerapan peraturan perundang-undangan tentang administrasi pertanahan pada kegiatan pendaftaran tanah di lingkup pemerintah desa. Penelitian ini dilakukan dengan menganalisa penerapan peraturan perundang-undangan terkait dengan administrasi pertanahan di Desa Kelubir dan Desa Pimping, Kabupaten Bulungan, Provinsi Kalimantan Utara. Penelitian ini adalah penelitian dengan metode yuridis-normatif. Hasil dari penelitian ini diharapkan dapat dimanfaatkan sebagai referensi ataupun masukan bagi pengembangan ilmu di bidang hukum pada umumnya, khususnya di bidang pertanahan. Penelitian ini menunjukkan bahwa masih ditemukan kekurangan dalam pelaksanaan administrasi pertanahan di pemerintah desa, khususnya berkaitan dengan pengumpulan data dan informasi pertanahan yang merupakan salah satu unsur dalam pemeliharaan data pada kegiatan pendaftaran tanah. Selain itu, kurangnya sosialisasi dan pemahaman dari aparat pemerintah desa ataupun masyarakat membuat kesalahpahaman pada kegiatan pendaftaran tanah. Penelitian ini menyimpulkan bahwa perlunya untuk diadakan pengaturan mengenai Standar Pelayanan Minimal (SPM) pendaftaran tanah pada lingkup pemerintah desa dan dilaksanakannya penyuluhan dan pembinaan mengenai administrasi pertanahan kepada aparat pemerintahan desa.
This research discusses the application of laws and regulations concerning land administration in land registration activities within the scope of the village government. This research was conducted by analyzing the application of laws and regulations related to land administration in Kelubir Village and Pimping Village, Bulungan Regency, North Kalimantan Province. This research is research with a juridical-normative method. The results of this study are expected to be used as a reference or input for the development of science in the field of law in general, especially in the field of land. This research shows that there are still deficiencies in the implementation of land administration in the village government, specifically related to the collection of land data and information which is one element in maintaining data on land registration activities. In addition, the lack of socialization and understanding from village government officials or the community caused misunderstanding on land registration activities. This study concludes that there is a need to regulate the Minimum Service Standards (SPM) for land registration within the scope of village governments and the implementation of counseling and guidance on land administration to village government officials.

Abstrak :

Masih banyaknya jumlah bidang tanah yang belum terdaftar dan terpetakan di Indonesia serta lambannya proses sertifikasi tanah menjadi latar belakang dibentuknya program Pendaftaran Tanah Sistematis Lengkap (PTSL). Para aktor pelaksana dituntut untuk melaksanan PTSL secara profesional yang mengacu pada ketentuan hukum maupun teknis sehingga tidak terjadi praktik maladministrasi. Hal tersebut menjadi alasan  dilakukannya penelitian yang bertujuan untuk menganalisis pelaksanaan program PTSL serta faktor-faktor yang mempengaruhi pelaksanaan program PTSL di Kantor Pertanahan Kota Jakarta Utara Tahun 2018. Penelitian ini menggunakan teori dari Edwards III (1980) dengan pendekatan post-positivist  dan teknik pengumpulan data kualitatif melalui wawancara mendalam dan studi pustaka. Hasil penelitian menunjukan bahwa dari segi capaian, pelaksanaan program PTSL tahun 2018 di Kantor Pertanahan Kota Jakarta Utara berhasil mencapai target yang telah ditetapkan. Namun, secara keseluruhan program PTSL di Kota Jakarta Utara belum dilaksanakan dengan baik dikarenakan terdapat beberapa kendala seperti kurangnya penyuluhan intensif dari Kantor Pertanahan, kurangnya kuantitas sumber daya manusia dan fasilitas dalam menunjang pelaksanaan PTSL, serta terdapat kekosongan hukum perihal peraturan teknis  pembiayaan persiapan pelaksanaan program PTSL. Peneliti juga menemukan faktor lain yang mempengaruhi dalam pelaksanaan program PTSL yaitu faktor kepemimpinan faktor sosial ekonomi masyarakat. 


The large number of land parcels that have not yet been registered and mapped in Indonesia and the slow process of land certification is the background for the establishment of a complete systematic land registration program (PTSL). The actors involved in this program are required to implement PTSL professionally which refers to legal and technical provisions so that there is no practice of maladministration, thus being the reasons for this research that aims to analyze the implementation of the PTSL program and the factors that influence it at the Land Office of North Jakarta in 2018. This research refers to the theory from Edwards III (1980) with a post-positivist approach with qualitative data collection techniques through in-depth interviews and literature studies. The results of the research show that in terms of achievement, the implementation of the PTSL program in 2018 at the Land Office of North Jakarta City successfully achieved the set target. However, overall the PTSL program in North Jakarta City has not been implemented properly due to several constraints such as lack of intensive counselling from the Land Office the quantity of human resources and facilities are still lacking in supporting the PTSL implementation, and there is a legal vacuum regarding technical regulations that regulate the financing of preparation for implementing PTSL programs. The researcher also found other factors that influence the implementation of the PTSL program, namely the leadership factors and the socio-economic factors of the community.
