ABSTRAK
Sampai saat ini, Indonesia masih belum menjadi anggota dari Konvensi Pengungsi 1951 dan Protokol 1967. Kondisi ini mengakibatkan penanganan pencari suaka di Indonesia tidak memiliki kerangka hukum yang yang memadai dalam menjamin perlindungan hak-hak mereka ketika masuk ke wilayah Indonesia. Penanganan Pencari Suaka di Indonesia masuk kedalam lingkup keimigrasian, yang mengkategorikan pencari suaka sebagai Imigran Ilegal, karena masuk ke wilayah Indonesi tanp adokumen yang sah. Pengkategorian sbagai Imigran Ilegal, menjadikan Pencari Suaka berisiko untuk ditahan di Rumah Detensi Imigrasi. Penahanan di Rumah Detensi Imigrasi ini bisa bertahun-tahun lamanya tanpa kepastian yang jelas. Penyiksaanpun kerap terjadi selama masa penahanan. Skripsi ini menjelaskan mengenai perlindungan pencari suska ditinjau dari instrumen hukum internasional yang dianalisis melalu peristiwa penahanan pencari suak yang terjadi di Indonesia. Melalui metode penelitian hukum normatif dan metode analisis pendekatan yuridis normatif dengan cara menganalisa data kualitatif. Analisis ini menyimpulkan bahwa tindakan penahanan dalam menangani pencari suak a akibat dari ketiadaan kerangka hukum nasional yang mengatur secra akhusus mengenai penanganan pencari suaka yang masuk ke wilayah Indonesia merupakan pelanggaran hak asasi manusia baik dari instrumen hukum internasional maupun nasional.
ABSTRACT
until now, Indonesia is still non-signatory the Refugee Convention 1951 and Protocol 1967. This condition cause there is no national legal frameworks which ensure the protection in handling the asylum seekers which enter Indonesia. So that, Asylum Seekers handling in Indonesia fall into the Immigration framework, which categorizes Asylum Seekers as the Illegal Immigrant because of illegal entry (undocumented). Categorizing as Illegal Imiigrant makes Asylum Seekers in danger. They subjected to detention in Immigration Detention. This detention could be for years without certainty. Torture often occur along the detention. This thesis explain the protection of the asylum seekers by the detention case that occur in Indonesia, through normative legal research method of method of analyzing the data is qualititative data analysis. This analysis concluded that the detention as in handling asylum seekers is a result of the absence of specific national framework in handlig asylum seekers who enter Indonesian territory, and this detention is arbitrary and violate human rights.

Penelitian ini bertujuan untuk menganalisis collaborative governance dalam penanganan permasalahan pengungsi dari luar negeri di wilayah DKI Jakarta. Penelitian secara khusus mengamati perihal kolaborasi Pemerintah Indonesia dan UNHCR Indonesia dan IOM Indonesia dalam penanganan permasalahan pengungsi dari luar negeri di wilayah DKI Jakarta. Teori yang digunakan adalah teori collaborative governance dan manajemen pengungsi. Pendekatan penelitian adalah post-positivist dengan teknik pengumpulan data berupa wawancara mendalam dan telaah literatur. Hasil penelitian menunjukkan bahwa memang terdapat proses kolaborasi antara Direktorat Jenderal Imigrasi sebagai state actor dan UNHCR Indonesia dan IOM Indonesia sebagai non-state actors dalam penanganan permasalahan pengungsi dari luar negeri di wilayah DKI Jakarta. Lebih lanjut lagi, ditemukan juga fakta bahwa proses kolaborasi yang ada ternyata sudah berjalan baik dan refugee management sudah efektif, dengan hasil akhir terdapat 7 dari 9 dimensi operasionalisasi konsep yang terpenuhi. ......This research aims to analyze the collaborative governance process in managing refugees related problems in Jakarta Capital Region area in Indonesia. This research is particulary focusing itself in analyzing the collaboration between the Indonesian government and UNHCR in Indonesia and IOM in Indonesia on accommodation and supervision, as well as humanitarian aid related matters as they try to manage the refugees related problems in Jakarta Capital Region area. This research is using the post-positivist approach, while the data collection method being used are in-depth interview, and literature studies. Theories being used are collaborative governance and refugees management. Result of the research shows that there were indeed collaborative governance process being done by Directorat General of Immigration as state actors and UNHCR Indonesia and IOM Indonesia as non- state actors. Furthermore, result of the research also shows that the collaborative process between all parties involved were deemed good and the refuge management was effective, proving that from 7 out of 9 dimensions from the concept operationalization are fulfilled.

Abstrak :
Under international law, a State may refuse to accord entry permit to its territory for aliens. However, there is always a possibility that under certain circumstances an alien enters a State territory without having any permit as it is in the case of refugee. Refugees have the right to be given protection as attached to their refugee status. The refugee rights for protection by the host stale is included in various regional and international treaties such as Convention relating the Status of Refugee 195! and the Protocol relating the Status of Refugee 1967, In reality, the refugee problem is more complex as it relates to legal issues such as those in regard to asylum seekers, stateless persons, illegal immigrant, and extradition. In many cases, there are difficult problems in deciding whether or not an individual or a group of aliens be given the refugee status. In an effort to solve the refugee problems around the world, the United Nations established the United Nations High Commissioner for Refugees (UNHCR). The following article describes comprehensively the refugee problems faced the international community.

Abstrak :
This article is a short report drawn from a research on the issue of the Afghan refugees in Australia (1999-2002). Using the infamous "boat people" case as illustration, the research was intended provide careful observation on the concept "human security/' a term increasingly linked to forced migration issues. Although human security is often portrayed as a benign concept with strong moral stance, its vastness and loose definition limit its adequacy as a useful tool of analysis. The concept is also prone to misuse because it loosely adapts to various ideological interests. Following framework elaborated from the thoughts of Caballero-Anthony and Freitas, the article shows that it: is possible to implement the human security approach in two conflicting dimensions, positive (the ideal) or negative. Both serve to protect the individuals, but each secures a different entity.
