Broadly speaking, this paper aims to examine how Indonesia law views rape and sexual crimes against women, how victims (women and girls) are projected in the law, and how criminal law affects the female victims seeking justice. Are there any laws adequate in providing protection for victims of sexual crimes? The main law referred to in Indonesia rape cases is the Penal Code (KHUP) created by the Dutch during their occupation in Indonesia. This legal reference has become a "holy book" for law enforces, particularly policemen and prosecutors. However because the Penal Code was created during the colonial period, today it is obsolete and does not offer much protection for victims of sexual crimes. From a woman's perspective, the law might be biased because it was formulated from a male point of view. Indeed, despite efforts by legal development programs to improve management of the judiciary, serious problems remain. The law relating to rape along with the procedural law shows how sex crimes are projected to justice. When the interpretation of law is removed from the context of human victims and perpetuated by institutions access to justice for victims of sexual assault is difficult to obtain. The law which essentially has multiple interpretations is standardized into a single meaning and freezes. When the law freezes, dew interpreters will be sensitive, principled, and courages enough to exercise the necessary discretion to bring justice to victims.

Skripsi ini membahas mengenai pengaruh dari Policy Paper on Sexual and Gender-Based Crimes 2014 terhadap penuntutan kejahatan seksual yang diadili di Mahkamah Pidana Internasional. Dalam penelitian ini juga akan dibahas secara kronologis terkait pengaturan dan penuntutan kejahatan seksual di pengadilan- pengadilan sebelum Mahkamah Pidana Internasional untuk melihat signifikansi dari setiap pengadilan dalam penuntutan kejahatan seksual. Kejahatan seksual pada International Military Tribunal of Nuremberg and Tokyo (IMT dan IMTFE) pada masa Perang Dunia II belum dianggap sebagai kejahatan yang terpisah dan hanya sebagai bagian dari “mass atrocities”. Perkembangan dan pengaturan juga kejahatan seksual dapat dilihat pada pengadilan pidana internasional yang dibentuk oleh Dewan Keamanan PBB yaitu ICTY, ICTR dan SCSL. Dengan berkembangnya pengaturan kejahatan seksual dalam pengadilan-pengadilan ini maka keberhasilan Penuntut Umum dalam membuktikan kejahatan seksual telah menghasilkan landmark cases seperti putusan Prosecutor v. Tadic yang merupakan keberhasilan pertama oleh Penuntut Umum dalam membuktikan kejahatan seksual. Namun, tidak ada kejahatan seksual yang berhasil dituntut di Mahkamah Pidana Internasional sebelum diterbitkannya Policy Paper on Sexual and Gender-Based Crimes 2014. Kasus pertama yang berhasil membuktikan kejahatan terhadap kemanusiaan berupa kejahatan seksual adalah kasus Prosecutor v. Bemba setelah diterbitkan Policy Paper on Sexual and Gender Based Crimes 2014. Maka dari itu, penulis bertujuan untuk menjelaskan faktor- faktor dari ketidakberhasilan penuntutan kejahatan seksual di Mahkamah Pidana Internasional melalui kasus-kasus dan pengaruh Policy Paper on Sexual and Gender Based Crimes 2014 sebagai pedoman Penuntut Umum terhadap penuntutan kejahatan seksual di Mahkamah Pidana Internasional. ......This thesis discusses the implementation of the Policy Paper on Sexual and Gender-Based Crimes 2014 on the prosecution of sexual crimes tried at the International Criminal Court. This study will also discuss chronologically regarding the regulation and prosecution of sexual crimes in courts before the International Criminal Court to see the significance of each court in prosecuting sexual crimes. Sexual crimes at the International Military Tribunal of Nuremberg and Tokyo (IMT and IMTFE) during World War II were not considered separate crimes and only as part of "mass atrocities". The development and regulation of sexual crimes can be seen in the international criminal courts established by the UN Security Council, namely ICTY, ICTR and SCSL. With the development of the regulation of sexual crimes in these courts, the success of the Public Prosecutor in proving sexual crimes has resulted in landmark cases such as the decision of Prosecutor v. Tadic which is the first success by the Public Prosecutor in proving a sexual crime. However, no sexual crimes were successfully prosecuted in the International Criminal Court prior to the publication of the 2014 Policy Paper on Sexual and Gender-Based Crimes. The first case that succeeded in proving crimes against humanity in the form of sexual crimes was the case of Prosecutor v. Bemba after the publication of the Policy Paper on Sexual and Gender Based Crimes 2014. Therefore, the author aims to explain the factors of the unsuccessful prosecution of sexual crimes at the International Criminal Court through cases and the influence of the 2014 Policy Paper on Sexual and Gender Based Crimes as the Public Prosecutor guide for the prosecution of sexual crimes at the International Criminal Court.

Sejalan dengan perkembangan teknologi masa kini, penggunaan internet untuk kegiatan seksual, dimana pornografi termasuk di dalamnya semakin marak. Sejauh ini, penelitian mengenai aktivitas mengakses pornografi masih lebih berfokus pada laki-laki, walaupun aktivitas mengakses pornografi pada perempuan dilaporkan meningkat. Lebih lanjut, banyak penelitian mengenai pornografi memiliki dampak yang buruk terhadap perempuan. Oleh karena itu, penelitian ini mengeksplorasi aktivitas mengakses pornografi dan sexual well-being pada perempuan, serta pandangan terkait dengan mengakses pornografi sebagai seorang perempuan. Penelitian ini dilakukan dengan metode kualitatif menggunakan wawancara terfokus pada enam perempuan dewasa muda yang mengakses pornografi di internet, dan menemukan bahwa partisipan mengakses pornografi secara rutin dengan alasan utama karena kebosanan, mengisi waktu luang, memuaskan hasrat, dan mencari referensi. Partisipan juga melaporkan pandangan yang cenderung positif terkait dengan aktivitas yang dilakukannya, Lebih lanjut, partisipan juga menyadari konten kekerasan pada pornografi di internet namun memiliki cara tersendiri dalam menyikapinya. ......In line with today's technological developments, the use of the internet for sexual activities, including pornography, is increasingly widespread. So far, research on the activity of accessing pornography is still more focused on men, although the activity of accessing pornography among women has been reported to increase. Furthermore, many studies on pornography have negative impact on women. Therefore, this study explores the activities of accessing pornography and sexual well-being in women and views related to accessing pornography as a woman. This study was conducted with a qualitative method using focused interviews on six emerging adult women who accessed pornography on the internet and found that participants access pornography regularly with the main reasons being boredom filling their free time, satisfying desires, and looking for references. Participants also reported positive views regarding pornographic viewing. Furthermore, participants are also aware of violent content in pornography on the internet but have their way of dealing with it.
