Tindakan penagihan pajak merupakan alat untuk memaksa Wajib Pajak membayar utang pajaknya, namun Direktorat Jenderal Pajak tidak dapat melakukan tindakan penagihan pajak seperti penyitaan harta dan pelelangan dalam perkara pailit karena hal tersebut tidak diperkenankan oleh Undang-Undang Kepailitan. Penelitian ini bertujuan untuk mengevaluasi tindakan penagihan pajak berdasarkan successful tax debt management guna meminimalkan tidak tertagihnya utang pajak. Penelitian ini menggunakan metode studi kasus yang dilakukan pada Subdirektorat Penagihan, Kantor Pelayanan Pajak A, Kantor Pelayanan Pajak B, dan Kantor Pelayanan Pajak C. Pengumpulan data melalui wawancara. Hasil penelitian ini menunjukkan bahwa strategi penagihan Wajib Pajak Pailit disusun secara terkoordinasi dan melibatkan beberapa fungsi administrasi yang berkaitan dengan penagihan pajak. Penagihan pajak terhadap Wajib Pajak Pailit tidak memerlukan pendekatan persuasif. Langkah-langkah yang dilakukan oleh Direktorat Jenderal Pajak sebelum melakukan tindakan penagihan dengan upaya paksa telah terstandardisasi. Direktorat Jenderal Pajak menggunakan seperangkat alat penegakan hukum yang terdiri dari sita, cegah, dan sandera dengan tujuan agar Wajib Pajak Pailit melunasi utang pajaknya. Penilaian terhadap apakah utang Wajib Pajak Pailit tidak ekonomis untuk ditagih dilakukan berdasarkan pedoman yang mencakup berbagai faktor. Kendala penagihan pajak terhadap Wajib Pajak Pailit adalah sulit untuk menjual aset Wajib Pajak Pailit.


Tax collection action is a tool to force taxpayers to pay their tax debts, but the Directorate General of Taxes can not execute tax collection action such as seizure of assets and auctions in a bankrupt case because Bankruptcy Law prohibits it. This study aims to evaluate tax collection actions based on successful tax debt management to minimise uncollectible tax debts. This study uses the case study method conducted at the SubDirectorate of Collection, A Tax Office, B Tax Office, and C Tax Office. Data collection through interviews. The results of this study show that the Tax Collection strategy for Bankrupt Taxpayer is developed in a coordinated and involves several administration functions related to tax collection. In the context of tax debt collection within bankruptcy proceedings, the necessity of persuasive communication with bankrupt taxpayers is deemed nonessential. Standardized procedures are in place within the Directorate General of Taxes prior to resorting to law enforcement measures for debt collection from bankrupt taxpayers. These measures encompass a spectrum of enforcement tactics, including asset confiscation, imposition of travel restrictions (exit bans), and, in extreme circumstances, detainment. The Directorate General of Taxes assesses various criteria to determine the viability of collecting debts from bankrupt taxpayers. The obstacle to collecting tax from bankrupt taxpayers is that it is difficult to sell the bankrupt taxpayers' assets.

"Skripsi ini membahas tentang Pengaruh Penagihan Pajak Dengan Surat Paksa Terhadap Kepatuhan Wajib Pajak di KPP Pratama Depok. Tujuannya adalah untuk mengetahui seberapa besar pengaruh penagihan pajak dengan surat paksa terhadap kepatuhan wajib pajak di KPP Pratama Depok. Metode yang digunakan dalam penelitian ini adalah metode kuantitatif dengan eksisting statistik, dan menggunakan desain deskriptif. Hasil dari penelitian ini adalah: penagihan pajak dengan surat paksa berpengaruh signifikan sebesar 65,6% terhadap kepatuhan wajib pajak di KPP Pratama Depok.

This final assignment discusses the Effect Of The Tax Collection Action with A Forced Letter To Taxpayers Compliance In Tax Service Office Primary Of Depok. The aim of the research is to determine how much the effect of the tax collection action with a forced letter to taxpayers compliance In Tax Service Office Primary Of Depok the method of this research was quantitative with existing statistic and using descriptive interpretative. The results of this study are: tax collection with a forced letter has a strong influence of 65,6% on the taxpayers compliance in Tax Service Office Primary Of Depok."

"Bertambahnya jumlah wajib pajak dari tahun ketahun namun pertambahan jumlah wajib pajak tersebut tidak diimbangi dengan kepatuhan wajib pajak dalam membayar pajak. Masalah kepatuhan menjadi kendala dalam pemaksimalan penerimaan pajak. Penelitian ini mengkaji tingkat kepatuhan wajib pajak orang pribadi dalam memenuhi kewajiban perpajakanya dengan menggunakan beberapa variabel bebas seperti persepsi wajib pajak pada kualitas pelayanan fiskus dan sanksi denda. Tujuan penelitian ini untuk mengetahui pengaruh Kualitas pelayanan fiskus dan sanksi denda terhadap kepatuhan wajib pajak.
Metode yang digunakan dalam penelitian ini adalah kuantitatif. Teknik pengumpulan data yang digunakan adalah dengan metode survei dengan menggunakan media kuesioner dan studi pustaka. Analisa dilakukan dengan menggunakan teknik analisis regresi berganda.
Berdasarkan hasil analisis yang dilakukan maka diperoleh kesimpulan bahwa persepsi wajib pajak pada kualitas pelayanan fiskus dan sanksi denda memeiliki pengaruh positif dan signifikan terhadap kepatuhan wajib pajak.

The number of tax payers is increase for years. But, it is not balanched with the level of tax compliance. The compliance problem bepmes on obstacle in optimizing the tax revenue. This study examines the level of compliance of individual tax payers of using several independent variabbles such a the perception of tax payers on quality service tax authorities and tax penalties. The purpose of this study was to determine the influence of the quality service tax authorities and tax penalities against individual taxpayer compliance.
The method used in this study is quanttative. The data collection techniques are survey method with quetionnaires and literature. Data analysis techniques used in this study is the technique of multiple regression analysis.
Based on the results of the analysis undertaken concluded that perception of tax payer on quality servisce tax authorities and tax penalties have a positive adn significant impact on tax payers comliance.

"ABSTRAK
Pembagian harta pailit milik debitor pailit yang dilakukan oleh kurator harus
dilakukan dengan menimbang kedudukan kreditor pailit. Kedudukan kreditor ini
dapat menjadikan seorang kreditor memiliki hak untuk didahulukan atas
pembayaran utang oleh debitor dibandingkan dengan kreditor lainnya. Kreditor
preferen sebagai kreditor dengan hak istimewa berada diatas kreditor separatis dan
konkuren. Tetapi hal ini tidak sejalan dengan pemberesan harta pailit PT.
Industries Badja Garuda (dalam pailit). Utang pajak milik debitor pailit
diklasifikasikan menjadi utang pajak yang bersifat preferen dan utang pajak yang
bersifat konkuren. Pokok permasalahan yang akan dibahas yaitu bagaimana
kedudukan utang pajak dalam pemberesan harta pailit dan bagaimana
penyelesaian utang pajak dalam pemberesan harta pailit PT Industries Badja
Garuda. Metode penelitian yang digunakan adalah yuridis normatif dengan
tipologi penelitian preskriptif. Jenis data yang digunakan yaitu data sekunder.
Dari penelitian ini dapat disimpulkan bahwa kedudukan utang pajak dalam
kepailitan menjadi pihak yang didahulukan pelunasannya daripada kreditor
lainnya. Hal ini ditentukan dalam Undang-Undang. Meskipun utang pajak sebagai
kreditor preferen memiliki hak untuk didahulukan, kreditor separatis pemegang
jaminan tetap memiliki hak atas jaminan yang dimilikinya. Pelunasan utang pajak
dalam kasus ini harus memperhatikan ketentuan mengenai daluwarsa utang pajak.
Untuk mencegah tidak dilunasinya utang pajak oleh wajib pajak maka seharusnya
kantor pajak bertindak lebih tegas agar tagihan pajak yang tidak terbayar tidak
menumpuk.

ABSTRACT
The settlement of bankruptcy property of debtor, which is conducted by the
curator in charge, must be done by considering the position of their creditors. The
position of creditors can make some creditor have preference rights for the debt
payment compared to other creditors. Creditor with preference rights must get the
debt repayment first compared to the other creditors. But this regulation is not
applied in tax debt repayment related to bankruptcy property settlement in PT.
Industries Badja Garuda (in Bankrupt process). Tax debt in this case, gets
classified into tax debt with preference rights and tax debt with concurrent rights.
The main issues in this study are how the position of tax debt in bankruptcy
property settlement and how the settlement of tax debt in bankruptcy property
settlement PT Industries Badja Garuda? This study uses juridical normative with
prescriptive research. This study uses secondary data. From the research can be
concluded that the position of tax debt repayment in bankruptcy becomes the
priority creditors in the bankruptcy property settlement compared to the other
creditors. This is stated in the constitution. Even though tax debt as creditor gets
the preference right by the law, creditor with separatist rights still have the right to
claim their debt guarantee. Tax debt repayment in this case should considering the
expiration clause in taxation. To prevent the taxpayer neglecting their duty, tax
office in charge should act more assertive so the tax debt will not accumulate"

"Skripsi ini membahas analisa manajemen pajak penghasilan pada PT. IPS, khususnya pajak penghasilan badan pada tahun 2008 dalam upaya mencapai efisiensi beban pajak. Penelitian ini adalah studi kasus. Hasil Penelitian menyarankan agar PT. IPS melakukan koreksi atas penghasilan final dan non final, agar tidak menyebabkan beban pajak yang lebih besar, serta melakukan pembetulan atas SPT Masa PPh Pasal 23 untuk melaporkan objek yang seharusnya terutang PPh Pasal 23.

This research discuss about analysis of income tax management on PT. IPS particularly income tax in 2008 in achieving efficiency of tax expense. This research is a case study. Results of the study suggest that PT IPS to revise the Corporate Income Tax Return regarding corrections on the final and non-final income, to avoid the larger administrative sanction, as well as perform revision of the Article 23 Income Tax Return to disclose all transaction that subjected to Income Tax."

"Rendahnya tingkat kepatuhan pajak di Indonesia yang dapat dilihat dari tax ratio, menjadi masalah yang harus diatasi oleh pemerintah. Di tahun 2020, pemerintah Indonesia melalui DJP menggagas dan menerapkan kebijakan pre-populated tax return dalam pelaporan Pajak Pertambahan Nilai. Skripsi ini ditujukan untuk mengetahui bagaimana evaluasi dari penerapan kebijakan ini melalui tiga kriteria, yaitu tungkat kepatuhan, beban Wajib Pajak, dan efisiensi dengan menggunakan site penelitian yaitu KPP Wajib Pajak Besar Tiga. Selain itu, skripsi ini juga ditujukan untuk mengetahui penerapan kebijakan pre-populated tax return di Indonesia jika dibandingkan dengan negara lain. Penelitian ini menggunakan pendekatan kualitatif, metode pengumpulan data dilakukan melalui studi pustaka dan wawancara mendalam. Hasil evaluasi di KPP Wajib Pajak Besar Tiga dapat memperlihatkan kebijakan ini dapat memberikan manfaat terhadap tingkat kepatuhan pajak, dapat meringankan beban Wajib Pajak, dan dapat memberikan efisiensi terhadap biaya yang dikeluarkan KPP Wajib Pajak Besar Tiga. Jika dibandingkan dengan penerapannya di negara lain, masih terdapat banyak kekurangan yang harus diatasi oleh Indonesia melalui DJP agar penerapan kebijakan ini dapat berjalan dengan lebih baik lagi dan dapat memberikan manfaat dengan maksimal.

The low level of tax compliance in Indonesia that can be seen the tax ratio is a problem that must be overcome by the government. In 2020, Indonesian government through the Directorate General of Taxes (DGT) initiates and implements pre-populated tax return policies for Value Added Tax return. This thesis is intended to find out how the evaluation results from the implementation of this policy through three criteria, namely the level of compliance, the burden of the taxpayer, and efficiency by using LTO 3 as the research site. In addition, this thesis is also intended to determine the implementation of the pre-populated tax return policy in Indonesia when compared to other countries. This study used a qualitative approach, data collection through literature studies and in-depth interviews. The results of the evaluation at LTO 3 can show that this policy can provide benefits to the level of tax compliance, can ease the burden of the Taxpayer, and can provide efficiency to the costs incurred by LTO 3. When compared with its implementation in other countries, there are still many shortcomings that must be overcome by the Indonesian government through the DGT so that the implementation of this policy can run better and can provide maximum benefits."

"Pemungutan pajak di Indonesia dilaksanakan dengan sistem full self assessment, yang berarti Wajib Pajak menghitung dan melaporkan sendiri kewajiban pajaknya. Direktorat Jenderal Pajak (DJP) hanya melakukan pengawasan dan pemeriksaan. Hasil dari permeriksaan tersebut adalah Surat Ketetapan Pajak (SKP) dan Surat Tagihan Pajak (STP). Jika Wajib Pajak tidak menerima hasil pemeriksaan, Wajib Pajak dapat mengajukan keberatan, dan jika masih belum puas, dapat mengajukan banding. Masalah lain yang memberatkan Wajib Pajak, dapat diajukan gugatan kepada Pengadilan Pajak. Dengan demikian pengadilan pajak merupakan suatu sarana untuk memberikan keadilan kepada masyarakat.
Dalam skripsi ini hanya dibahas beberapa kasus mengenai banding untuk mendapatkan kesimpulan. Penulisan ini menganalisis tentang fakta-fakta di persidangan yang mendasari pertimbangan Hakim dalam memutus sengketa pajak yang diajukan Wajib Pajak. Setelah melakukan ringkasan putusan banding, penulis mengelompokkan fakta-fakta yang terjadi di persidangan, yaitu pentingnya persyaratan formal persidangan, kelengkapan alat bukti yang memberi keyakinan kepada hakim, perbedaan interpretasi hukum antara Wajib Pajak dan DJP, serta pentingnya pengetahuan tentang peraturan perpajakan yang berlaku. Fakta-fakta tersebut digunakan sebagai dasar penulis untuk membangun manajemen perpajakan yang dapat dilakukan oleh Wajib Pajak agar fakta-fakta yang melemahkan argumen Wajib Pajak tidak terjadi lagi di masa mendatang.

Indonesia adopts self-assessment method in tax collection in which Taxpayer calculates and reports their income taxes while Directorate General of Taxes only performs the monitoring function and examination. The output of that process is a Tax Assessment Letter and Tax Collection Letter in which Tax payer may not fully agree. Thus Taxpayer may raise an objection and through court, if Tax payer is still not satisfied with the objection's result. Therefore Tax Court is one of a medium to bring justice to society. This research will only examine several appeal cases in court to lead into a conclusion.
This study examines the Court’s facts which become the basis of Judges consideration in making a decision. After resuming some appeal verdicts, writer classified the court’s facts, the importance of formal regulation, completeness of evidences, the difference of Law interpretation between Directorate General of Tax and Tax Payer, and the urgency of comprehending and knowing about the newest Tax rules which are applied.Those facts become the basis forwriter to build tax management system for Tax Payer, so that the same tax dispute will not happen again in the future.

"Pembaharuan system perpajakan nasional atau lebih dikenal dengan tax reform, yang didalamnya terdapat pemberlakuan sistem Self Assesment, yaitu memberi keleluasaan bagi Wajib Pajak untuk membayar dan melapor sendiri kewajiban perpajakannya. Namun bagaimana jika wajib pajak tidak dapat memenuhi kewajiban perpajakannya baik karena ketidakpatuhan dalam sistem perpajakan maupun faktor-faktor lainnya. Skripsi ini membahas tentang implementasi penagihan pajak oleh fiskus di KPP Pratama Cikarang Utara, serta kendala apa saja yang dihadapi, dan upaya apa saja yang dilakukan oleh fiskus untuk mengatasi kendala tersebut. Pendekatan yang digunakan dalam penelitian ini adalah penelitian kualitatif dengan desain deskriptif dan mengambil KPP Pratama Cikarang Utara sebagai site penelitian.
Hasil penelitian ini ditemukan bahwa penagihan aktif memberikan peran yang sangat signifikan terhadap pencairan tunggakan pajak atas surat ketetapan yang terbit selama tahun 2009. Terkait dengan realisasi pencairan tunggakan pajak secara keseluruhan dapat disimpulkan bahwa tindakan penagihan aktif sebagai upaya pencairan tunggakan pajak tahun 2009 belum efektif karena hanya terealisasi sebesar 49,95 %.Hal tersebut dikarenakan ditemukannya beberapa kendala antara lainSeksi Penagihan KPP Pratama Cikarang Utara belum memiliki Sumber Daya Manusia yang belum memadai terutama terkait dengan Jurusita Pajak, wajib pajak yang sudah tidak terdaftar, kesadaran yang rendah dari wajib pajak, dan terakhir sarana kerja yang kurang memadai.

Renewal of the national taxation system or better known as tax reform, which is the application of Self Assessment system, which provide flexibility for taxpayers to pay for their own reporting and tax obligations. But what if the taxpayer can not do the tax compliance that caused by the tax system or other factors. This paper discusses the implementation of tax collection by tax authorities in KPP Pratama Cikarang Utara, as well as any obstacles encountered, and what is being done by the tax authorities to overcome these obstacles. The approach used in this study is a qualitative research design with descriptive and took the KPP Pratama Cikarang Utara as the site of research.
The results of this study found that the active collection provides a very significant role to the disbursement of delinquent taxes on an assessment published in 2009. disbursements associated with the realization of the overall tax arrears can be concluded that the active collection action as an effort to melt the tax arrears in 2009 not effective because it only realized by 49.95%. That is caused by several obstacles such as KPP Pratama Cikarang Utara not have Human Resources that adequate especially for the bailiff of the tax collection, a taxpayer who is not registered, low awareness of the taxpayer, and the last working facilities inadequate.

"Laporan magang ini bertujuan untuk mengevaluasi aktivitas pengelolaan pajak restoran oleh BKD Kota CCC. BKD Kota CCC yaitu instansi Pemerintah Daerah yang mengelola keuangan daerah terutama pajak daerah. Kegiatan magang dilakukan di bidang PAD 1 dan membahas pajak restoran. Evaluasi dilakukan dengan melihat kesesuaian aktivitas pengelolaan pajak restoran terhadap referensi dan regulasi yang berlaku. Terdapat 3 kegiatan yang dilakukan selama magang berlangsung yaitu pendaftaran, pelaporan dan penagihan pajak. Pendaftaran pajak meliputi pemberian dan pengembalian formulir SPOPD disertai lampiran, penerbitan NPWPD dan Maklumat Daerah serta Penetapan NPWPD secara jabatan. Lalu, Pelaporan pajak meliputi pemungutan pajak, pelaporan SPTPD dan pembayaran pajak terutang. Kemudian penagihan pajak yang dimulai dari penagihan, surat teguran hingga kebijakan lelang. Pelaksanaan aktivitas sebagian besar telah sesuai referensi dan regulasi yang berlaku. Ketidaksesuaian bersifat minor dan dapat diselesaikan sehingga tidak mengganggu aktivitas operasional PAD 1.

This internship report aims to evaluate restaurant tax msanagement activities by the BKD Kota CCC. BKD Kota CCC is a local government institution that manages regional finances, especially local taxes. Internship activities are carried out in the field of PAD 1 and discuss restaurant taxes. Evaluation is carried out by looking at the suitability of restaurant tax activities against applicable references and regulations. There are 3 activities carried out during the internship, consist of registration, reporting and tax collection. Tax registration includes giving and returning SPOPD forms with attachments, issuance of NPWPD and Regional Declarations then Stipulation of NPWPD in office. Then, tax reporting includes tax collection, SPTPD reporting and payment of tax payable. Then tax collection starting from billing, warning letters to auction policies. Most of the activities carried out are in accordance with applicable references and regulations. Non-conformities are minor and can be resolved so that they do not interfere significantly with PAD 1 operational activities.

"During the last three years, the tax amount collected formed an continuing rising contribution to the state revenues. Contributing 70.4 % in 2002, 70.8 % in 2003, and 77.8% in 2004 for the State Budget. Contrary, other revenues contributed less to the State Budget, 29.6 % in 2002, 22 % in 2004. The significant rise in tax revenues during the successive years and particularly the last 3 years may still increase. Such is indicated by the increasing amount of unpaid taxes, whereas taxes are a lasting source of income which can be increased.
In line with the overall State Policy for 1999-2004, ordering a tax increase under more as the source of the nation's revenues. The policy has shown an adequately significant rise in tax revenues but still facing many problems in the form of unpaid taxes. The government has worked hard to collect unpaid taxes by applying new regulations and policies to reduce the amount of unpaid taxes.
The main problem reviewed in this survey is to see whether enforced tax collecting can indeed reduce the amount of unpaid taxes. The tax bureau for big taxpayers is investigated to see whether they were really able to reduce the amount of unpaid taxes. The investigation made use of available records to find out the results obtained through enforced collection and liquidation of unpaid taxes. A qualitative approach was used by making a conclusion from secondary documents and reports, while a qualitative approach was used to apply technique of correlation, the Pearson Product Moment.
The investigations indicated liquidated unpaid taxes of big taxpayers during 2002-2004 being 21.61 %, 30.54 % and 34.55 %. While the result is significant, it is however less significant compared with the liquidation of unpaid taxes on a national scale in the same period of 40.73 %, 32.15 %. lt means that liquidation of unpaid taxes from big taxpayers is always less than the liquidation of unpaid taxes on a national scale. lt means that the enforce collection of unpaid taxes from big taxpayers must be improved. The hypothetical shows a calculated value 2.353. Where the calculated value is higher if compared with the value indicated in the table, it means that it should he rejected and an alternative hypothesis. So the enforced collection of unpaid taxes has visible result in reducing the amount of unpaid taxes.
The Tax Bureau should be recommended to apply enforced tax collection even with detention of uncooperative tax payers where the survey shows that enforced tax collection has had visible result and that eventual detention of uncooperative taxpayers may become a real deterrent where it is so far not applied, and the Tax Bureau should reorganize and stricter control its personnel for better results under the prevailing regulations."
