"Maraknya kasus peletakan jaminan fidusia atas benda milik pihak ketiga dalam perjanjian pembiayaan dalam praktik penjaminan fidusia telah menjadi permasalahan krusial terkait perlindungan hukum terhadap para pihak, yakni pemilik asli benda dan kreditur sebagai Penerima Fidusia, salah satunya adalah sebagaimana dalam Putusan No. 975 K/Pdt/2020. Tulisan ini menganalisis bagaimana keabsahan peletakan jaminan fidusia atas benda milik pihak ketiga dalam perjanjian pembiayaan dan bagaimana hakim menyikapi kasus penjaminan fidusia atas benda milik pihak ketiga dalam perjanjian pembiayaan pada Putusan No.975 K/Pdt/2020 serta bagaimana tindakan dalam putusan tersebut dapat dikualifikasikan sebagai suatu perbuatan melawan hukum dalam perspektif hukum perdata. Tulisan ini disusun dengan menggunakan metode penelitian doktrinal dengan pendekatan analitis. Hasil penelitian menyimpulkan bahwa penjaminan fidusia atas benda milik pihak ketiga dalam perjanjian pembiayaan adalah sah apabila dilakukan berdasarkan persetujuan pemilik benda sebagaimana ditafsirkan dari Pasal 1 angka 5 UU Jaminan Fidusia. Kemudian, tindakan Para Tergugat menjaminkan fidusia atas benda milik pihak ketiga dalam Putusan No. 975 K/Pdt/2020 sudah tepat dinyatakan bukan merupakan perbuatan melawan hukum, tetapi alasan pertimbangan hakimnya keliru karena seharusnya yang mendasari perbuatan tersebut dinyatakan bukan melawan hukum adalah karena pada waktu proses pembiayaan dijalankan objek tersebut bukanlah milik Penggugat.

The rise in cases of placing fiduciary guarantees on objects belonging to third parties on financing agreements in the practice of fiduciary guarantees has become a crucial problem related to legal protection for the parties, namely the original owners of the objects and creditors as Fiduciary Recipients, one of which is as in Decision No. 975 K/Pdt/2020. This paper analyzes the validity of placing fiduciary guarantees on objects belonging to third parties in financing agreements and the judges respond to cases of fiduciary guarantees on objects belonging to third parties in financing agreements in Decision No. 975 K/Pdt/2020 and how the actions in this decision can be qualified as tort from a civil law perspective. This article is conducted using doctrinal research methods with an analytical approach. The results of the research conclude that fiduciary guarantees for objects belonging to third parties in financing agreements are valid if carried out based on the agreement of the object owner as interpreted from Article 1 point 5 of the Fiduciary Guarantee Law. Then, the actions of the Defendants in placing fiduciary guarantees to objects belonging to third parties in Decision No. 975 K/Pdt/2020 were rightly declared not to be unlawful, but the reason for the judge's consideration was wrong because the basis for the action to be declared lawful was because at the time the financing process was carried out the object did not belong to the Plaintiff."

"ABSTRAK
Jaminan Fidusia atas kendaraan bermotor yang tidak didaftarkan membawa
konsekuensi hukum bagi kreditur dalam hal pelaksanaan eksekusi atas Jaminan
tersebut. Hal ini dikarenakan tanpa dilakukan pendaftaran, Sertifikat Jaminan Fidusia
yang berfungsi sebagai dasar dilaksanakannya eksekusi tidak terbit sehingga eksekusi
yang tetap dilaksanakan menjadi tidak sah. Di samping ketentuan pendaftaran,
pelaksanaan eksekusi tentunya juga harus memperhatikan ketentuan mengenai
wanprestasi dan juga keabsahan dari Perjanjian Pembiayaan sebagai perjanjian
pokoknya. Dalam hal terjadi wanprestasi, apakah wanprestasi yang demikian telah
cukup untuk membatalkan perjanjian yang diwujudkan dengan dilaksanakannya
eksekusi tersebut. Sedangkan keabsahan perjanjian juga perlu diperhatikan karena
sebagaimana diketahui Perjanjian Pembiayaan dibuat dengan disertai Perjanjian
Jaminan Fidusia sebagai perjanjian tambahan atau pelengkap yang keberadaannya
bergantung dari keabsahan Perjanjian Pembiayaan tersebut. Oleh karenanya penting
bagi hakim untuk menggali keabsahan dari Perjanjian Pembiayaan untuk melihat
apakah alasan eksekusi yang dilakukan oleh kreditur dapat dibenarkan atau tidak.

ABSTRACT
Fiduciary Warranty for motor vehicle which is not registered bring legal
consequences to the lender for warranty execution. This because without any
registration, Fiduciary Certificate as the basic for execution implementation doesn?t
exist so the execution remains held was invalid. In addition to the registration
provisions, the execution must also concern to the default provisions and also The
Financing Agreement validity as a primary contract. In the event of default, is the
default has been enough to cancel the agreement which is followed with execution
implementation. Meanwhile, the agreement validity must also concerned because as
well known The Financing Agreements was made with accompanied Fiduciary
Agreement as an additional or supplementary agreements whose existence depends
on The Financing Agreement validity. Therefore it?s important for the judge to
explore The Financing Agreement validity to see if the execution reason which
carried out by lender can be justified or not ."

"Akta jaminan fidusia yang tidak dibuat oleh pemilik asli dari objek akan berimplikasi pada keabsahan akta tersebut. Untuk itu penelitan ini membahas perihal permasalahan yang menyangkut keabsahan akta jaminan fidusia yang tidak memperoleh persetujuan dari pemilik sebenarnya dan tidak menguasai objeknya berdasarkan pertimbangan Putusan Mahkamah Agung Indonesia No. 975K/PDT/2020. Penelitan hukum doktrinal ini, menganalisis objek hukum dalam konsep peraturan perundang-undangan dan putusan pengadilan. Objek hukum yang diteliti tersebut dikumpukan melalui studi dokumen dalam bentuk bahan-bahan hukum primer dan sekunder, yang diteliti untuk memberikan jawaban atas permasalahan penelitian. Bagaimana keabsahan akta jaminan fidusia yang tidak dibuat oleh pemilik asli dan tanggung jawab notaris atas akta jaminan fidusia yang dibuat. Berdasarkan hasil penelitian yang dilakukan maka dapat dijelaskan sebagai berikut: Akta jaminan fidusia yang tidak berdasarkan ijin pemilik asli dan objeknya tidak dikuasai menjadi batal dan notaris dapat membatalkan akta jaminan fidusia yang telah dibuat.

A fiduciary security deed that is not made by the original owner of the object will have implications for the validity of the deed. For this reason, this research discusses the problems concerning the validity of a fiduciary security deed that does not obtain the consent of the actual owner and does not control the object based on the consideration of the Indonesian Supreme Court Decision No. 975K/PDT/2020. This doctrinal legal research analyzes legal objects in the concept of legislation and court decisions. Saham Perseroan Terbatas Tertutup merupakan benda yang dapat dipindahkan
kepemilikannya melalui perjanjian hibah dan/atau perjanjian jual beli.
Pemindahan hak atas saham melalui perjanjian ini harus tunduk pada persyaratan
dan juga tata cara yang diatur dalam peraturan perundang-undangan maupun
Anggaran Dasar Perseroan agar sah secara hukum. Apabila syarat-syarat tersebut
tidak terpenuhi maka pemindahan hak atas saham itu dapat dikatakan sebagai
sebuah perbuatan melawan hukum, sebagaimana dapat ditemui dalam putusan No.
604/Pdt.G/2011/PN.Jkt.Sel. Dua permasalahan utama yang akan dibahas dalam
penulisan ini adalah bagaimana tata cara pemindahan hak atas saham Perseroan
Terbatas Tertutup melalui perjanjian jual beli dan hibah serta bentuk perbuatan
melawan hukum yang terjadi dalam perkara di atas. Penulisan dalam skripsi ini
menggunakan pendekatan yuridis normatif dengan metode penelitian
kepustakaan. Berdasarkan hasil analisis skripsi ini, pelanggaran unsur esensialia
dalam suatu perjanjian pemindahan hak atas saham merupakan sebuah perbuatan
melawan hukum. Oleh karena itu penting bagi para pihak untuk patuh serta
memahami ketentuan umum perjanjian dan juga tata cara pemindahan hak atas
saham yang telah diatur dalam peraturan perundang-undangan.

"Tesis ini membahas mengenai pelaksanaan eksekusi objek jaminan fidusia yang dilakukan diluar pengadilan, lebih khusus setelah diputusnya Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019. Sebagaimana dikemukakan dalam Putusan Mahkamah Agung Nomor 1978 K/PDT/2020 dimana Perusahaan Pembiayaan melaksanakan eksekusi objek jaminan fidusia diluar pengadilan melalui titel eksekutorial namun pihak lain tidak menghendaki hal tersebut. Permasalahan pada penelitian ini tentang pelaksanaan eksekusi objek jaminan fidusia dalam putusan tersebut yang dilaksanakan sebelum Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019 disahkan, namun diputus setelah putusan Mahkamah Konstitusi tersebut disahkan. Untuk menjawab permasalahan tersebut digunakan metode penelitian hukum yuridis normatif menggunakan pendekatan perundang-undangan serta kasus dengan menggunakan data sekunder disertai tipologi penelitian eksplanatoris. Dalam penelitian ini ditemukan bahwa pelaksanaan eksekusi objek jaminan fidusia boleh dilakukan tanpa melalui pengadilan, namun harus tetap berdasar pada Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia dan Putusan Mahkamah Konstitusi 18/PUU-XVII/2019 sehingga Perusahaan Pembiayaan harus memperbaharui pedoman dalam rangka pelaksanaan eksekusi objek jaminan fidusia.

This thesis discusses about the implementation of the execution of fiduciary guarantee objects that are carried out outside the court, more specifically after the decision of the Constitutional Court Number 18/PUU-XVII/2019. As stated in the Supreme Court Decision Number 1978 K/PDT/2020 where the Financing Company executes the fiduciary guarantee object outside the court through an executorial title but other parties do not want this. The problem in this study is the implementation of the execution of the fiduciary guarantee object in the decision which was carried out before the Constitutional Court Decision Number 18/PUU-XVII/2019 was ratified, but was decided after the Constitutional Court decision was ratified. To answer these problems, normative juridical law research methods are used using statutory and case approaches using secondary data accompanied by an explanatory research typology. In this study it was found that the execution of fiduciary guarantee objects may be carried out without going through a court, but must still be based on Law Number 42 of 1999 concerning Fiduciary Guarantees and Constitutional Court Decision 18/PUU-XVII/2019 so that Financing Companies must update the guidelines in the context of implementing the execution of fiduciary guarantee objects."

"Skripsi ini membahas mengenai pembatalan perjanjian yang dilakukan secara sepihak dengan studi kasus putusan Mahkamah Agung No. 2583/K/PDT/2013, mengenai pembatalan perjanjian sewa menyewa secara sepihak atas tanah milik negara yang terletak di Kompleks Kali Besar Timur No. 31, Jakata barat. Penelitian ini membahas dua permasalahan utama. Pertama, apakah pembatalan perjanjian dapat digugat sebagai perbuatan melawan hukum meskipun terdapat hubungan kontraktual diantara kedua belah pihak. Kedua, pelaksaanan putusan hakim terkait dengan kasus pembatalan perjanjian yang dilakukan secara sepihak tersebut. Skripsi ini menggunakan metode penelitian yuridis normatif, yaitu penelitian yang mengacu kepada hukum positif atau norma hukum tertulis.
Hasil penelitian menunjukkan bahwa pembatalan perjanjian harus memperhatikan ketentuan dalam Pasal 1338 KUHPerdata dan Pasal 1266 KUHPerdata, yaitu harus dengan itikad baik dan dimintakan kepada hakim pengadilan negeri. Sehingga tindakan pembatalan perjanjian yang dilakukan secara sepihak dapat digugat atas dasar perbuatan melawan hukum meskipun terdapat hubungan kontraktual diantara kedua belah pihak. Penelitian ini juga menunjukkan bahwa putusan hakim terkait dengan pembatalan perjanjian secara sepihak telah tepat tetapi dasar pertimbangan dan amar putusannya kurang sesuai dengan ketentuan peraturan perundang-undangan yang berlaku.

The researched focused on the termination of an agreement made by unilaterally with the case study of the supreme court's decision No. 2583/K/PDT/2013 regarding the termination of a lease agreement made by one party involved for a state owned land which located in Kompleks Kali Besar Timur No. 31, West Java. This research would focus on two main issues. First, whether a lawsuit could be made regarding the termination of the said agreement as an act of tort despite the contractual terms between both parties. Second, the implementation of the supreme court's decision regarding that said termination. This research used judicial-normative method that refers to positive law or written norms law.
The research showed that, termination of an agreement has to be made in accordance to Article 1338 KUHPerdata and Article 1266 KUHPerdata, which is made with the best interest of parties involved and appealed to the district court's judge. So that a lawsuit can be made for that kind of termination. This research also showed that the supreme court's judge decision regarding said termination has been right, although there's some fallacy in the injuction and consideration made by the judges.

"Tesis ini meneliti dan mengkaji mengenai kewenangan yang dimiliki oleh arbitrase dalam memeriksa dan memutus sengketa perbuatan melawan hukum yang telah terdapat Perjanjian arbitrase ditinjau dari peraturan perundangundangan yang berlaku. Metode penelitian yang digunakan dalam penelitian ini adalah metode yuridis normatif. Hasil penelitian adalah sesuai dengan kewenangan yang diberikan Undang-Undang No. 30 Tahun 1999 serta asas pacta sunt servanda arbitrase berwenang untuk memeriksa dan memutus sengketa perbuatan melawan hukum yang timbul dari suatu perjanjian yang telah terdapat Perjanjian arbitrase. Namun dalam implementasinya masih banyak ditemui pendapat pengadilan yang mengatakan bahwa pengadilan mempunyai kewenangan untuk memeriksa dan memutus sengketa perbuatan melawan hukum meskipun para pihak telah sepakat dalam suatu perjanjian arbitrates untuk menyelesaikan sengketa melalui arbitrase. Berdasarkan implementasi kewenangan arbitrase tersebut penelitian ini memberikan pandangan kepada lembaga peradilan untuk menghormati penggunaan lembaga penyelesaian arbitrase yang telah disepakati oleh para pihak berdasarkan asas pacta sunt servanda.

This Thesis analyses the competence of arbitration to adjudicate tort dispute that is bound by arbitration agreement pursuant to the Indonesian regulation(s). the method of research used in this thesis is normative-juridical method. The research found that according to the Law No. 30 of 1999 Arbitration and Alternative Dispute Resolutions and the principle of pacta sunt servanda, arbitration is competent to adjudicate tort dispute that is bound by arbitration agreement. But in implementation there are some court decision which ruled that Indonesia District Court have the authority to adjudicate tort dispute although the parties have agreed to resolve tort dispute through arbitration. In regards to the implementation of the arbitration authority, this thesis suggest Indonesian Court to respect the use of arbitration that the parties have agreed to on the basis of pacta sunt servanda principle."

"Penelitian ini bertujuan untuk mengevaluasi implementasi sistem pengendalian intern pemerintah yang sesuai dengan Peraturan Pemerintah Nomor 60 Tahun 2008 terhadap pengelolaan utang pihak ketiga. Objek penelitian ini dilakukan pada Lembaga Pemerintah X yang merupakan Lembaga Pemerintah Non-kementerian yang mempunyai tugas membantu dan bertanggung jawab secara langsung kepada Presiden Republik Indonesia. Lembaga Pemerintah X memiliki nilai utang pihak ketiga yang dinilai paling signifikan jumlahnya di antara kementerian/lembaga lainnya. Pengumpulan data dilakukan dengan wawancara semi-terstruktur dan menggunakan teknik analisis deskriptif kualitatif. Hasil analisis implementasi sistem pengendalian intern pemerintah atas pengelolaan utang pihak ketiga menunjukkan masih terdapat proses yang belum memadai dalam komponen lingkungan pengendalian atas penetapan reward dan punishment, kompetensi dan pelatihan SDM, jumlah pegawai, sistem penilaian risiko, kegiatan pengendalian, dan ketidaktersediannya informasi dan komunikasi yang memadai. This study aims to evaluate the implementation of the government's internal control system following Government Regulation No. 60 of 2008 on the management of third-party debt. The object of this research is Government Institution X, which is a non-ministerial government institution that has the task of assisting and reporting directly to the President of the Republic of Indonesia. Government Institution X has the value of third-party debt, which is considered the most significant in number among other ministries/institutions. Data were collected through semi-structured interviews and using qualitative descriptive analysis techniques. The results of the analysis of the implementation of the government's internal control system on third-party debt management show that there are still inefficient processes in the components of the control environment for the determination of rewards and punishments, HR competencies and training, number of employees, risk assessment system, control activities, and the unavailability of information and communication. Recommendations from the results of this study for managing third-party debt are the preparation of guidelines and technical instructions. Prepared Standard Operating Procedures for managing third-party debt that underlies the work and determining third-party debt risk accounts contained in the Internal Control over Financial Reporting (ICOFR) working paper, as well as the availability of education and training for all debt management employees."

"Proses jual beli seringkali didasari dengan pembuatan Perjanjian Pengikatan Jual Beli sebelum dilanjutkan dengan Akta Jual Beli. Para pihak tidak menyadari adanya ketentuan yang juga mengikat akibat pembuatan Perjanjian Pengikatan Jual Beli walaupun belum terjadinya peralihan hak. Penulisan ini terdiri dari dua rumusan masalah, yaitu mengenai akibat hukum terhadap perbuatan melawan hukum setelah penandatanganan Perjanjian Pengikatan Jual Beli dan mengenai pertimbangan hakim dalam memutus perkara perbuatan melawan hukum setelah penandatanganan Perjanjian Pengikatan Jual Beli. Penulisan ini menggunakan metode yuridis normatif dan tipologi penelitian eksplanatoris. Bahan hukum yang digunakan adalah bahan hukum primer berupa peraturan perundang-undangan yang mengatur terkait Perjanjian Pengikatan Jual Beli, Akta Pemberian Hak Tanggungan, perbuatan melawan hukum, dan juga kredit, sedangkan bahan hukum sekunder yang terdiri dari buku, jurnal, dan internet. Penulisan ini juga melakukan wawancara baik terhadap Notaris dan PPAT serta juga kepada Bank. Penulis menyimpulkan bahwa akibat adanya perbuatan melawan hukum setelah dilakukan penandatanganan Perjanjian Pengikatan Jual Beli, maka Akta Pemberian Hak Tanggungan dapat batal demi hukum karena tidak dibuat atas dasar sebab yang halal. Selain itu, pertimbangan majelis hakim dalam memutuskan perkara perbuatan melawan hukum setelah penandatanganan Perjanjian Pengikatan Jual Beli kurang tepat karena tidak mempertimbangkan mengenai hak dan kewajiban yang timbul akibat Perjanjian Pengikatan Jual Beli. Majelis hakim juga seharusnya mempertimbangkan tentang perbuatan Bank. Hal ini karena Bank tidak menerapkan prinsip kehati-hatian Bank dalam pemeriksaan sebelum pemberian kredit.

The buying and selling process is often based on the making of a Sale and Purchase Binding Agreement before proceeding with the Sale and Purchase Deed. The parties are not aware of the existence of provisions that are also binding due to the making of the Sale and Purchase Binding Agreement even though there has not been a transfer of rights. This writing consists of two problem formulations, namely regarding the legal consequences of unlawful acts after the signing of the Sale and Purchase Binding Agreement and regarding the judge's considerations in deciding cases of unlawful acts after the signing of the Sale and Purchase Binding Agreement. This writing uses a normative juridical method and an explanatory research typology. The legal materials used are primary legal materials in the form of laws and regulations relating to the Sale and Purchase Binding Agreement, Deed of Granting Mortgage Rights, unlawful acts, and also credit, while secondary legal materials consist of books, journals, and the internet. This writing also conducts interviews with both Notaries and PPAT as well as to Banks. The author concludes that as a result of an unlawful act after the signing of the Sale and Purchase Binding Agreement, the Deed of Granting Mortgage may be null and void because it was not made on the basis of a lawful cause. In addition, the consideration of the panel of judges in deciding cases of unlawful acts after the signing of the Sale and Purchase Binding Agreement is not appropriate because it does not consider the rights and obligations arising from the Sale and Purchase Binding Agreement. The panel of judges should also consider the actions of the Bank. This is because the Bank does not apply the prudential principle of the Bank in the examination before granting credit."

"Dalam pelaksanaan lelang, disyaratkan adanya Nilai Limit yang ditetapkan oleh Penjual (kreditur) dengan nilai pasar sebagai prioritas pertama (batas atas) dan nilai likuidasi sebagai alternatif terakhir (batas bawah). Tidak diaturnya ketentuan mengenai kewajaran penetapan Nilai Limit mengakibatkan banyaknya gugatan perdata yang diajukan oleh pihak tereksekusi untuk menuntut ganti kerugian karena objek jaminannya dijual jauh dibawah harga pasar. Bahwa pemenuhan unsur perbuatan melawan hukum dalam penetapan nilai limit lelang hak tanggungan dalam suatu gugatan perdata seharusnya tidak hanya dilakukan dengan menguji unsur pengertian PMH dalam arti sempit yaitu ada atau tidaknya pelanggaran terhadap hak subjektif orang lain dan/atau pelanggaran atas kewajiban hukum pelaku, namun juga PMH dalam arti luas yakni bertentangan dengan kesusilaan baik, ataupun bertentangan dengan kepatutan, ketelitian, dan kehati-hatian. Kemudian, untuk menentukan dasar nilai yang akan digunakan sebagai nilai limit, setiap penilai/penaksir dalam melakukan valuasi objek lelang harus menggunakan pedoman pada Standar Penilaian Indonesia (SPI) 205 yang

In carrying out an auction, a Limit Value is required to be determined by the Seller
(creditor) with market value as the first priority (upper limit) and liquidation value
as the last alternative (lower limit). The absence of provisions regulating the
fairness of limit value determination results in many civil lawsuits being filed by
executable parties seeking compensation because the collateral object is sold far
below the market price. This research will answer how the fulfillment of the element
of unlawful acts in determining the limit value of auctions in a civil lawsuit and the
valuation method for auction objects in the form of land and buildings based on
Appraisals or Public Appraiser, using juridical-normative research methods
through a study of literature and secondary data, as well as case studies on the
considerations of the Panel of Judges in the civil case number 213/Pdt.G/2020/PN
Bdg. The fulfillment of the element of unlawful act in determining the limit value of
the mortgage auction in a civil lawsuit should not only be carried out by examining
the element of unlawful act in the narrow sense, namely whether or not there is a
violation of the subjective rights of other people and/or a violation of the
perpetrator's legal obligations, but also unlawful act in a broad sense which is
contrary to good decency, or contrary to propriety, thoroughness, and prudence.
Then, to determine the basic value to be used as the limit value, each
appraiser/appraiser in valuing the auction object must use the guidelines in the
Indonesian Appraisal Standard (SPI) 205 issued by the Indonesian Appraiser
Profession Council (MAPPI) and Minister of Finance Regulation on Auction
Implementation Guidelines, through several approaches including market
approach, revenue approach, and cost approach
