"Skripsi ini membahas hal-hal apa saja yang menjadi tanggung jawab dan kewajiban sponsoring state dalam kegiatan eksplorasi dan eksploitasi di area dasar laut Internasional (Kawasan) yang dilakukan oleh subjek hukum privat yang disponsori olehnya. Kawasan merupakan wilayah dasar laut yang terletak di luar yurisdiksi negara manapun dan menyimpan kekayaan sumber daya mineral yang begitu besar. International Seabed Authority melaui Bab XI dari UNCLOS 1982 merupakan lembaga yang diberikan kewenangan untuk mengatur segala macam kegiatan eskplorasi dan eksploitasi sumber daya mineral yang dilaksanakan di Kawasan. Salah satu fungsi dari International Seabed Authority adalah mempromosikan partisipasi efektif dari negara-negara berkembang untuk melakukan kegiatan di Kawasan. Akan tetapi sampai saat ini tidak banyak negara berkembang yang terlibat secara efektif dalam kegiatan eksplorasi dan eksploitasi di Kawasan. Minimnya partisipasi negara berkembang ini lebih disebabkan kepada kurang jelasnya tanggung jawab dan kewajiban negara-negara yang terlibat secara efektif dalam kegiatan di Kawasan. Kekurangjelasan ini menyebabkan banyak negara-negara berkembang tidak mampu untuk menakar apakah dirinya sanggup untuk terlibat dalam kegiatan di Kawasan. Dalam pembahasan demi pembahasan di skripsi ini, akan dijelaskan mengenai apa yang menjadi tanggung jawab dan kewajiban dari negara-negara terkhusus sponsoring state dalam melakukan kegiatan di Kawasan berdasarkan Advisory Opinion dari Seabed Disputes Chamber tahun 2011. Secara ringkas, kejelasan mengenai tanggung jawab dan kewajiban negara dalam kegiatan di Kawasan membuat partisipasi negara-negara berkembang mulai bermunculan.

This undergraduate thesis discusses the responsibilities and obligations of Sponsoring State in accordance with activities of exploration and exploitation in International Seabed Area (The Area) carried by the private subject which is sponsored by such state. The Area is area of seabed that lies outside the jurisdiction of any state which holds extremely huge amount of mineral resources. International Seabed Authority through Part XI of UNCLOS 1982 is an institution authorized to organize all sorts of activities to explore and exploit the mineral resources in the Area undertaken. One of the functions of the International Seabed Authority is to promote the effective participation of developing countries to carry out activities in the Area. But until 2011, not many developing countries engage effectively in the activities of exploration and exploitation in the Area. The lack of participation of developing countries is due to the lack of clear responsibilities and obligations of the states that effectively engage in activities in the Area. This lack of clarity led to many developing countries not to be able to measure whether they are have the capability to engage in activities in the Area. In the analysis in this paper, will be explained about what the responsibilities and obligations of states especially those sponsoring state in conducting activities in the area by the Advisory Opinion of the Seabed Disputes Chamber in 2011. In summary, the clarity regarding the responsibilities and obligations of the state in accordance with activities in The Area make the effective participation of developing countries began to appear.

"Laporan magang ini membahas evaluasi atas metode penilaian (valuasi) aset yang dilakukan oleh PT JMN Advisory yang merupakan perusahaan yang bergerak di bidang financial advisory. Berada di bawah grup Magnolia Indonesia, penilaian aset ini bertujuan untuk membantu proses audit yang dilakukan oleh KAP Rose atas laporan keuangan PT Lily yaitu dengan cara reviu estimasi nilai wajar properti AA yang telah dihitung oleh KJPP Amber. PT Lily adalah sebuah perusahaan yang bergerak di bidang pengembangan properti seperti perumahan, pusat perbelanjaan, dan hotel. Evaluasi ini dilakukan dengan mengacu pada PSAK 16, 48, dan 68 untuk memahami nilai wajar dari properti AA yang disajikan dalam laporan keuangan serta meninjau kembali kewajaran metode dan asumsi yang digunakan untuk mengestimasi nilai wajar melalui pendekatan pasar, biaya, dan pendapatan. Hasil evaluasi menunjukkan bahwa proses penilaian (valuasi) yang dilakukan oleh PT JMN Advisory sudah sesuai dengan dasar-dasar teori yang berlaku dengan beberapa modifikasi, namun PT JMN Advisory belum memiliki prosedur yang terstruktur untuk setiap metode penilaian. Oleh karena itu, PT JMN Advisory perlu mengembangkan pedoman mengenai prosedur peninjauan reviu metode dan asumsi aset tetap untuk proyek-proyek serupa lainnya dalam membantu proses audit. Laporan magang ini juga bertujuan untuk lebih lanjut membahas tentang pengalaman magang dan pengembangan diri penulis dalam pengetahuan financial advisory, hal manajemen waktu, kemampuan bahasa Inggris formal, serta kemampuan teknis lainnya.

This internship report discusses the evaluation of the asset valuation method carried out by PT JMN Advisory, a company engaged in the financial advisory sector. Under the Magnolia Indonesia group, PT JMN Advisory conducts this asset valuation to assist the audit process conducted by KAP Rose on the financial statements of PT Lily. PT Lily is a company engaged in property development such as housing, shopping centres and hotels. The project is conducted by reviewing the estimated fair value of the AA property, which KJPP Amber has calculated. This evaluation was carried out in accordance with PSAK 16, 48 and 68 to understand the fair value of AA's property presented in the financial statements and to review the reasonableness of the methods and assumptions used to estimate fair value through market, cost and income approaches. The evaluation results show that the valuation process carried out by PT JMN Advisory is in accordance with the applicable theoretical foundations with some modifications. However, PT JMN Advisory still needs a structured procedure for each assessment method. Therefore, PT JMN Advisory needs to develop guidelines regarding procedures for reviewing fixed asset methods and assumptions for other similar projects to assist the audit process. This internship report also aims to further discuss the author's internship experience and self-development in financial advisory knowledge, time management, formal English skills, and other technical abilities."

Fungsi advisory adalah salah satu fungsi yang dimiliki oleh Mahkamah Internasional sebagai organ utama PBB. Terdapat perkembangan untuk membahas pertanyaan hukum yang terkait sengketa berjalan melalui fungsi advisory meski memiliki karakteristik contentious. Perbedaan antara dua fungsi ini adalah signfikansi dari prinsip state consent sebagai landasan. Terdapat dua pandangan bertentangan terkait kedudukan prinsip state consent dalam advisory opinion terkait sengketa berjalan. Pandangan pro state consent menekankan pada kaitannya dengan prinsip international obligation, compliance, dan prinsip yudisial dengan karakteristik serupa yakni res judicata dan lis pendens. Di sisi lain, pandangan yang mengesampingkan state consent menegaskan pada urgensi pada isu tertentu yang berkaitan dengan tujuan PBB sebagai organisasi, salah satunya mengenai isu dekolonialisasi dan pendapat Mahkamah Internasional sebelumnya bahwa state consent tidak dibutuhkan dalam yurisdiksi advisory. Setelah melakukan penelitian dengan metode studi pustaka, dapat disimpulkan bahwa pembahasan suatu sengketa berjalan dalam advisory opinion harus dilihat secara kasus per kasus, dari perumusan pertanyaan hukum yang diajukan, ada tidaknya isu terkait perdamaian dan keamanan dunia, serta keanggotaan dari negara pihak dalam PBB, untuk dapat menentukan dicederainya prinsip state consent. Dalam Legal Consequences of the Separation of the Chagos Archipelago from Mauritius in 1965, terdapat isu dekolonialisasi yang belum terselesaikan karena terdapat pemisahan paksa antara Kepulauan Chagos dengan Mauritius. Selain itu, Mauritius dan Inggris Raya merupakan anggota PBB, yang mana artinya telah memberikan state consent fondasional terhadap yurisdiksi Mahkamah Internasional. Adapun saran yang dapat diberikan adalah perlu adanya ketentuan lebih mendetail bagi pelaksanaan fungsi advisory opinion, terutama dalam hal pertanyaan tersebut berkaitan erat dengan sengketa berjalan.

 


The advisory function is one of the functions upheld by the International Court of Justice (ICJ) as one of the principle organs of the United Nations (UN). There is a trend to discuss legal questions related to pending disputes through the advisory function despite having contentious characteristics, where the two functions share different significance of the principle of state consent. The pro state consent view emphasizes its relation to the principles of international obligation, compliance, and judicial principles such as res judicata and lis pendens. The opposing view refers to the mandate of UN to maintain international peace and a previous ICJ opinion which points out that state consent is not required in the advisory jurisdiction. It can be concluded that advisory opinion on pending disputes must be seen on a case-by-case basis; from the formulation of the questions, its relation to international peace, as well as the state membership to the UN, to determine the role of state consent. In the Legal Consequences of the Separation of the Chagos Archipelago from Mauritius in 1965, there is an unresolved issue of decolonialism due to the forced separation between the Chagos Islands and Mauritius. In addition, Mauritius and the United Kingdom are members of the UN, which means they have given their foundational state consent to the jurisdiction of the ICJ. The recommendation that can be given is the need for more detailed provisions for the implementation of the advisory opinion function, especially related to a pending dispute.
