"Ide pencetusan Deklarasi Doha dilatarbelakangi oleh
protes dari negara-negara berkembang yang menilai
bahwa pasal-pasal pelindung TRIPS (the TRIPS
Safeguards) tidak jelas dan bersifat multi interpretasi.
Negara-negara berkembang berusaha mencari sebuah
alat tafsir terhadap the TRIPS Saféguards tersebut yang
memenuhi persyaratan hukum internasional, khususnya
Konvensi Wina yang mengatur tentang Hukum
Perjanjian Interasional dan proses legislatif negosiasi
berdasarkan kerangka kerja pembuatan keputusan WTO
(WTO decision making framework). Melalui Deklarasi
Doha, negara-negara berkembang mencapai tujuan
utama mereka untuk mencari penjelasan terhadap
penafsiran the TRIPS Safeguards tersebut. Meskipun
demikian, di masa yang akan datang, perbedaan tingkat
ekonomi, teknologi dan kepentingan di antara negara-
negara anggota WTO akan menjadi salah satu pemicu
perdebatan mengenai manfaat perlindungan paten obat
berdasarkan ketentuan WTO dan pengaruhnya terhadap
akses obat esensial. Hasil yang optimal dari perdebatan
tersebut akan sangat tergantung pada kehendak para
pihak yang terlibat untuk mencari solusi yang tidak
memihak kepentingan salah satu negara anggota WTO.

"Tulisan ini menganalisis bagaimana hubungan tanggung jawab antara subjek hukum kesehatan, seperti dokter, pasien, rumah sakit, dan pemerintah yang berkaitan antara satu sama lain, baik di Indonesia maupun di Selandia Baru. Selain itu, skripsi ini juga mengulas sistem kesehatan di Selandia Baru yang memberikan kompensasi kepada pasien yang menderita cedera perawatan yang ditimbulkan dari kelalaian medis. Penelitian ini bersifat deskriptif dengan metode pendekatan doktrinal. Hasil penelitian ini menunjukkan sistem kompensasi Selandia Baru yang memberikan bantuan untuk biaya perawatan dan rehabilitasi untuk semua cedera pribadi. Sistem ini berfokus pada unsur memperbaiki kondisi seperti semula dibandingkan dengan membuktikan kesalahan dari tenaga medis. Basis dari peraturan pada sistem kompensasi akibat cedera ini adalah Accident Compensation Act 2001 yang mengatur badan hukum yang bertugas untuk mengelola sistem kompensasi ini. Sistem kesehatan Selandia Baru yang tidak berfokus pada kesalahan ini dapat menciptakan sistem yang menekankan pada pengembalian kondisi ke semula (restorative justice). Oleh karena itu, pendekatan seperti ini seharusnya dapat diterapkan di Indonesia mengingat pentingnya melindungi dokter dari resiko profesinya yang tinggi. Sehingga, penyelesaian sengketa medis dapat memberikan solusi yang menguntungkan kepada semua pihak.

This paper analyzes the relationship of responsibility between health law subjects, such as doctors, patients, hospitals, and government in relation to each other both in Indonesia and New Zealand. In addition, this thesis also reviews the health system in New Zealand where this system provides compensation to patients who suffer treatment injuries arising from medical negligence. This research is descriptive with a doctrinal approach. The results of this study shows that New Zealand’s compensation system which provides assistance for treatment and rehabilitation costs for all personal injuries. The system focuses on the element of restoring the original condition rather than proving fault of the medical professional. The regulatory basis of the injury compensation system is the Accident Compensation Act 2001 which governs the statutory body tasked with administering the compensation system. New Zealand’s no-fault system can create a system that emphasizes restorative justice. Therefore, this approach should be applied in Indonesia given the importance of protecting doctors from the high risks of their profession. So that medical dispute resolution can provide solutions that are beneficial to all parties. "
