"Technology is one of important factors in economic building of developing countries, including Indonesia. Developing countries need various modern technologies governed by developed countries by transfer of technology among countries. but very often, there appear handicaps in the process of transfer of technology to developing countries from the developed ones, one of the handicaps is lack of law regulations. In this article the problem of the role of law in the transfer of technology is analysed by using juridical normative and quantitative methods of approach. The data used in the analysis comprise both the primary and secondary data. Form those methods approach it is concluded that law has a role to give the basis for the creation of effective mechanism for the transfer of technology among countries by fair conditions both for providers and receivers of technologies."

"ABSTRAKPenulisan yang berjudul "Mengefektifkan Alih Teknolagi Komputer di Indonesia" memberikan gambaran yang lebih jelas mengenai konsepsi teknologi komputer serta peranannya bagi suatu negara berkembang. Dalam penulisan ini kita mendapatkan gambaran yang lebih luas mengenai konsepsi dari pelaksanaan alih teknologi khususnya di bidang komputer. Hal itu menyangkut setiap tahapan dalam proses alih teknolagi, saluran masuk alih tekhalogi dan saluran cara alih teknologi. Penulisan ini juga memberikan gambaran atas sikap pemerintah Indonesia terhadap teknalogi komputer dan juga mengemukakan sikap yang seyogyanya ditempuh oleh pemerintah Indonesia. Hal tersebut menyangkut kebijaksanaan dasar, teknologi tepat guna, kebijaksanaan tata niaga, sikap masyarakat Indonesia, penataan organisasi pelaksana alih teknolagi dan perlindungan hukum dalam alih teknologi."

"Skripsi ini membahas mengenai tujuan paten sebagai sarana alih teknologi sebagaimana hal tersebut termaktub dalam Pasal 7 The Agreement on Trade-Related Aspects of Intellectual Property Rights Agreement (TRIPs Agreement). Namun terdapat sebuah polemik dalam pengaturan paten di Indonesia mengenai ketentuan Pasal 107 ayat 2 Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Terdapat pro dan kontra atas terbitnya pasal tersebut, bahwa berdasarkan pasal 107 ayat 2 mengenai pelaksanaan kewajiban invensi berupa importasi dapat menghambat terciptanya alih teknologi bagi Indonesia namun disaat yang sama hal tersebut dapat memberikan kemudahan berusaha bagi pemegang paten. Oleh karenanya penulis melakukan penelitian yang dilakukan dengan metode yuridis normatif dan menghasilkan penelitian yang berbentuk komparatif deskriptif analitis. Hasil dari penelitian ini menunjukkan bahwa ketentuan Pasal 107 ayat 2 tidak maksimal dalam menjamin adanya kontribusi dalam peningkatan inovasi, transfer, dan diseminasi teknologi, belum mencerminkan keutungan bersama bagi pemegang paten dan pengguna pengetahuan teknologi serta cara yang kondusif bagi kesejahteraan sosial dan ekonomi, dan ketentuan tersebut telah mencerminkan keseimbangan dan kewajiban pemegang paten dalam rangka terhindarnya dari penyalahgunaan atas hak eksklusif yang berlebihan.

This thesis discusses the purpose of patents as a means of technology transfer as stated in Article 7 of the Agreement on Trade-Related Aspects of Intellectual Property Rights Agreement (TRIPs Agreement). However, there is a polemic in the regulation of patents in Indonesia regarding the provisions of Article 107 point 2 of Law Number 11 of 2020 concerning Job Creation. There are pros and cons to the issuance of this article, that based on Article 107 point 2 regarding the implementation of the obligation of an invention in the form of importation, it can hinder the creation of technology transfer for Indonesia, but at the same time it can provide business convenience for patent holders. Therefore, the authors conducted research conducted with normative juridical methods and produced research in the form of comparative descriptive analytical. The results of this study indicate that the provisions of Article 107 point 2 are not maximal in guaranteeing a contribution to increasing innovation, transfer and dissemination of technology, do not reflect mutual benefits for patent holders and users of technology knowledge and ways that are conducive to social and economic welfare, This reflects the balance and obligations of the patent holder in order to prevent excessive abuse of exclusive rights."
