"Pembuktian kartel tidak dapat dipisahkan dari penggunaan analisa ekonomi untuk membuktikan adanya perjanjian tertulis di antar para pelaku usaha yang dicurigai melakukan kartel. Namun di satu sisi, penggunaan bukti ekonomi (tidak langsung) masih menjadi perdebatan di Indonesia, karena selain mengandung ambigu, penggunaannya belum diatur secara tegas dalam sistem hukum Indonesia. Penelitian ini akan menjabarkan penggunaan analisa ekonomi yang digunakan oleh KPPU untuk membuktikan dugaan-dugaan kartel yang ada selama tahun 2009-2010 serta menganalisa validitas penggunaan analisa ekonomi berdasarkan hukum nasional. Penelitian ini merupakan penelitan hukum normatif yang menggunakan analisa kualitatif. Ketelitian dan ketepatan dalam melakukan penghitungan serta analisa ekonomi adalah suatu hal yang masih harus ditingkatkan oleh KPPU demi perwujudan penegakan hukum persaingan usaha yang ideal.

The use of economic analyis to prove the existence of a gentlement agreement among the alleged cartel members is unseparable from the processs of cartel verification itself. However, on the other hand, the use of economic analysis (which is an indirect evidence), still remains as a controversy, not only because of its ambiguity, but also its method has not yet clearly been regulated under Indonesian law. This research is to elaborate the use of economic analysis employed by the Commission For the Supervision of Business Competition (KPPU) to prove the alleged cartels cases within the year of 2009-2010 and also to examine the validity of the use of economic analysis according to the national law system. This research is a normative legal research with qualitative analysis. Meticulous economic calculation and accuracy in analysis are of something that KPPU should improve for the fulfillment of an ideal competition law enforcement. "

"Pada akhir tahun 2018, tarif tiket pesawat untuk penerbangan domestik kelas ekonomi dari berbagai maskapai telah melambung tinggi. Kenaikan harga tiket yang signifikan dinyatakan dipicu dari kenaikan harga avtur dan penurunan nilai tukar Rupiah. Struktur industri penerbangan yang dikuasai oleh dua group besar juga dinilai telah memicu terjadinya kenaikan harga tiket. Permasalahan yang diangkat dalam penelitian ini adalah terhadap adanya dugaan praktik persaingan usaha tidak sehat karena adanya pergerakan tarif tiket pesawat yang seragam dari maskapai-maskapai di Indonesia. Komisi Pengawas Persaingan Usaha menilai bahwa kenaikan dan penurunan tarif tiket pesawat oleh maskapai penerbangan telah memberikan indikasi awal atas adanya tindakan yang bersifat anti persaingan yakni dugaan pelanggaran penetapan harga oleh para maskapai penerbangan sebagaimana diatur dalam Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat. Metode penelitian yang digunakan adalah penelitian kepustakaan dengan tipe penelitian yuridis-normatif. Hasil penelitian menunjukkan bahwa terhadap kenaikan tarif tiket pesawat oleh para maskapai telah menunjukkan indikasi awal terjadinya sebuah praktik persaingan usaha tidak sehat diantara para maskapai, namun bukti-bukti yang diperoleh sampai saat ini belum cukup konklusif untuk dapat menyatakan telah dilakukannya pelanggaran UU No. 5 Tahun 1999 dari kenaikan tarif tiket pesawat.

At the end of 2018, airline ticket prices for economy-class domestic flights from various airlines have soared. The significant increase in flight ticket prices was said to be triggered by the increase in avtur prices. The structure of the airline industry whcih is controlled by two large airline groups is also considered to have triggered an increase in ticket prices. The problem raised in this study is on the allegations of price fixing by the indications of parallel business conduct in the industry, both from full service airlines and no frills airlines or Low Cost Carriers. The competition supervisory commission in Indonesia (KPPU), considers that the parallel movement of flight ticket prices have provided an initial indication of anticompetitive actions, namely alleged price fixing violations as stipulated in Law Number 5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Competition. The research method used in this thesis is juridical-normative type. The analysis of the case has concluded that there have not been found sufficient evidence to support the indications of anticompetitive practices among airlines to fix prices of domestic airline ticket prices."

"Penelitian ini bertujuan untuk mengetahui Dewasa ini, sepeda motor merupakan salah satu moda transportasi kebutuhan masyarakat. Adapun sepeda motor menjadi salah satu yang paling digemari oleh sebagian masyarakat Indonesia. Hal tersebut selaras dengan fakta bahwa berdasarkan data Badan Pusat Statistik BPS , hingga tahun 2013, total populasi sepeda motor di Indonesia mencapai 84.732.652 unit. Salah satu jenis sepeda motor yang menjadi favorit konsumen adalah skuter matic, dimana pada tahun 2016 skuter matic adalah tipe sepeda motor yang paling laris dimana memiliki pangsa pasar sebesar 79 persen. Permasalahan kemudian hadir ketika investigator KPPU mencium adanya praktek persiangan usaha tidak sehat berupa penetapan harga sepeda motor matik 110-125 cc yang dilakukan dua pelaku usaha yakni YIMM dan AHM, dimana investigator KPPU menemukan sebuah bukti komunikasi, berupa email yang dikirimkan Presiden Direktur YIMM, Yochiro Kojima kepada beberapa internal bawahanya. Kasus ini berakhir ketika pada tanggal 20 Februari 2017 majelis komisi memutuskan bahwa kedua pelaku usaha tersebut terbukti melakukan praktik persaingan usaha tidak sehat, yakni melanggar pasal 5 Undang-undang No. 5 Tahun 1999 tentang Penetapan Harga. Penelitian ini membahas dua permasalahan yakni ada atau tidaknya indikasi praktek persaingan usaha tidak sehat yang dilakukan oleh kedua terlapor dan apakah putusan majelis komisi telah sesuai dengan kaidah hukum persaingan usaha di Indonesia.

Today, motorcycles are one of the modes of transportation that become the needs of society. The motorcycle became one of the most favored mode of transportation by some people of Indonesia. This is in line with the fact that based on the Central Bureau of Statistics BPS data, recorded until 2013, the total population of motorcycles in Indonesia reached 84,732,652 units. One type of motorcycle that is a favorite for consumers is the matic scooter, where in 2016 matic scooter is the best selling type of motorcycle which has a market share of 79 percent. The problem was then present when the KPPU investigator smelled the practice of unfair business competition in the form of motorcycle pricing of 110 125 cc matic made by two business actors namely YIMM and AHM, where KPPU investigators found a proof of communication, in the form of an email sent by YIMM President Director Yochiro Kojima to some internal under him. The case ended when on 20 February 2017 the commission assembly decided that the two business actors were proven to conduct unfair business competition practices, namely violating Article 5 of Law no. 5 of 1999 on Pricing. This study discusses two issues namely whether or not there are indications of unfair business competition practices conducted by both reported and whether the decision of the commission council has been in accordance with the rules of business competition law in Indonesia."

"Tujuan dari penelitian ini adalah untuk memberikan bukti empiris mengenai pengaruh variabel makro ekonomi, yaitu: kurs USD/IDR, tingkat suku bunga, inflasi dan variabel mikro ekonomi, yaitu: Volume Perdagangan, Price Earning Ratio (PER) dan Debt to Equity Ratio (DER) dari indeks harga saham gabungan dan indeks saham sektoral terhadap harga saham. Metode penelitian yang digunakan dalam menganalisis pengaruh variabelvariabel di atas adalah ARCH/GARCH. Data yang dibutuhkan dalam penelitian ini didapat dari Bank Indonesia dan Bursa Efek Indonesia. Hasil penelitian ini menunjukkan bahwa kurs USD/IDR, tingkat suku bunga, inflasi, Debt Equity Ratio berpengaruh negatif terhadap indeks harga saham Gabungan dan mayoritas indeks saham sektoral di Bursa Efek Indonesia. Sedangkan untuk variabel volume perdagangan dan price earning ratio (PER) memiliki pengaruh yang positif terhadap Indeks Harga Saham Gabungan dan mayoritas Indeks Saham Sektoral.

The purpose of this research is to provide evidence on the impacts of macro economics variables, namely USD/IDR exchange rate, interest rate, inflation, and micro economics variable such as: Trading Volume, Price Earning Ratio (PER), and Debt to Equity Ratio (DER) of the Composite Index Stock and The Sectoral Index Stocks on a stock price.

The research methodology used in analyzing the above mentioned variables are ARCH/GARCH. The source of data for this research is from Bank Indonesia and the Indonesia Stock Exchange.

The result of this research showed that USD/IDR exchange rate, interest rate, inflation, Debt to Equity Ratio have negative impacts on the Composite Index Stock Prices and Sectoral Index Stock Prices. While the Trading Volume and Price Earning Ratio has a positive impacts on the Composite Index Stock Prices and the Sectoral Index Stock Prices."
