Limited sources of water in the world imposed many countries to give 'real' tariffs on water, or in other words, water privatization. Long time ago, water is a public good which people could access, freely and cheaply. In the future, there are tendencies that water can no longer be used as goods, but become private goods, where only certain people who could pay the 'real' tariff of wait could have access to which. Water privatization has undergone in many countries, as well as fit developed, developing, and less developed countries. Besides the limited sources of water, th inability of the government (especially in third world countries) to provide water service for ih citizens is getting worse. Governments can no longer give subsidy to its citizens by giving che water's tariff meanwhile the costs to provide clean water is quite high. Governments have limit choice, so privatization becomes the ultimate solution for this problem. Moreover, the World Bo and Asian Development Bank are very keen on these water privatization. The consequence o water privatization is the significant increase of water tariff. It means that only rich people will ha access to clean water while the poor can not pay for the high water tariff. This becomes the cent problem of water privatization happened in many countries, for example in South Africa, where 2i people die because inaccessibility of clean expensive-water. Meanwhile, water privatization in Indonesia that has been legalized through UU No. 7, 2004 is underway. Would water privatization become detrimental to Indonesia's poor people?

Abstract
Dalam berbagai praktek di era kolonial maupun dalam rezim ekonomi Washington Consensus yang telah lalu, air mengalami komodifikasi menjadi barang ekonomi. Privatisasi muncul sebagai mekanisme yang mewadahinya, dengan dukungan perusahaan asing transnasional. Argentina muncul sebagai negara dengan ruang lingkup dan nilai investasi terbesar di dunia dalam privatisasi air pada dekade 1990-an. Hal ini menarik seiring bervariasinya dinamika benturan kepentingan yang terlibat antara negara, institusi keuangan internasional, pebisnis, dan masyarakat sipil. Dengan kerangka neo-liberalisme serta tata kelola dan keamanan sumber daya alam, tulisan ini mengangkat perdebatan dan kritik privatisasi air Argentina dengan kajian kualitatif. Permasalahan utamanya ialah seputar peran rezim ekonomi global yang memiliki kekuatan untuk mengarahkan perilaku negara.
Abstract
Water resources has long been transformed by economic actors from being public goods into being more economically valued assets. The late Washington Consensus regime facilitated the conversion, including what occured in Argentina, the largest nation with water privatization project during the 1990s. Central domain of this research are the relations among business-government-global economic regime while putting the state as the level of analysis, by using the neo-liberalism and water security governance as tools of investigation. The water business has direct and indirect allegation to state sovereignity and behaviour, by observing the relatively stronger function of TNCs in water privatization.

Penelitian ini membahas peran dan strategi Koalisi Masyarakat Menolak Swastanisasi Air Jakarta (KMMSAJ) dalam upaya menghentikan kebijakan swastanisasi air di Jakarta. Beragam problematika pengelolaan layanan air oleh swasta telah memicu pembentukan koalisi yang terdiri dari berbagai macam organisasi masyarakat sipil, seperti LBH Jakarta, KRUHA, Solidaritas Perempuan, Walhi Jakarta, ICW, serta individu yang terdiri dari warga Jakarta yang menjadi korban swastanisasi air. Penelitian ini menggunakan konsep urban social movement dari Domaradzka (2018) dan teori movement action plan dari Moyer (2001) untuk menjelaskan tahapan, peran dan strategi KMMSAJ. Metode penelitian ini adalah metode kualitatif dengan teknik pengumpulan data melalui wawancara mendalam (in-depth interview) sebagai data primer dan studi pustaka sebagai data sekunder. Temuan penelitian ini menunjukkan, KMMSAJ dengan berbagai strateginya berhasil mengimplementasikan keseluruhan peran yang disebutkan oleh Moyer (2001), seperti melakukan konsolidasi masyarakat, melibatkan seluruh segmen masyarakat, membuat gugatan warga negara (citizen lawsuit), mengajukan petisi di Indonesia dan internasional, serta melakukan lobi. Pada tahun 2017 KMMSAJ berhasil memenangkan gugatan di Mahkamah Agung. Namun, MA kemudian melakukan pembatalan gugatan citizen lawsuit pada tahun 2018, yang mengakibatkan pemerintah kota DKI melakukan beberapa kebijakan yang menyebabkan swastanisasi air Jakarta belum sepenuhnya bisa dihentikan seperti tujuan KMMSAJ. ......This research examines the role and strategies of the Coalition of Jakarta Residents Opposing Water Privatization (KMMSAJ) in efforts to stop water privatization policies in Jakarta. The numerous issues surrounding private water management have triggered the formation of a coalition comprising various civil society organizations, such as LBH, KRUHA, Solidaritas Perempuan, Walhi, and ICW, as well as individuals who are Jakarta residents affected by water privatization. This study utilizes Domaradzka's (2018) concept of urban social movement and Moyer's (2001) theory of movement action plan to explain the stages, roles, and strategies of KMMSAJ. The qualitative research methodology involves data collection through in-depth interviews as the primary data and a literature study as the secondary data. The findings of this research indicate that KMMSAJ, through its various strategies, has successfully implemented all the roles mentioned by Moyer (2001), such as community consolidation, engaging all segments, filing a citizen lawsuit, submitting petitions at national and international levels, and conducting lobbying efforts. In 2017, KMMSAJ won the suit at the Supreme Court. Unfortunately, the Supreme Court later revoked the citizen lawsuit in 2018, leading to several policies by the Jakarta city government that prevented the complete cessation of water privatization, as intended by KMMSAJ. f

Skripsi ini membahas tentang bagaimana pemerintah Indonesia melakukan kejahatan dalam melakukan kebijakan privatisasi air bagi warga DKI Jakarta. Teori yang dipakai dalam skripsi ini adalah kejahatan negara yang dilakukan karena melakukan pelanggaran HAM oleh Julia dan Herman Scwendinger, teori Strukturasi oleh Giddens, dan crimes of domination oleh Quinney. Skripsi ini melihat bagaimana praktik-praktik yang dilakukan oleh pemerintah Indonesia tidak terlepas dari dan mendukung adanya struktur yang lebih besar dalam globalisasi. Indonesia dihegemoni oleh Bank Dunia dalam rangka globalisasi yang kemudian diberi reaksi oleh Indonesia sebagai bentuk adaptasi struktural sehingga pemerintah Indonesia melakukan crimes of domination. Dalam hal ini, pemerintah Indonesia melakukan kejahatan dengan adanya pelanggaran hak asasi manusia atas air bersih terhadap warga DKI Jakarta. Penelitian ini menggunakan pendekatan kriminologi kritis untuk mengkaji masalah kebijakan privatisasi air bersih ini. Metode yang digunakan adalah metode kualitatif dengan studi dokumen, wawancara, FGD, dan penelusuran data sekunder sebagai teknik mengumpulkan data. ......This thesis discusses about how the Indonesian government commit a crime in doing water privatization policy for the Jakarta citizens. The theory and concept used in this thesis are a state crime for committing human rights violations by Julia and Herman Schwendinger, Structuration theory by Giddens, and crimes of domination by Quinney. This thesis sees how the practices done by the government of Indonesia cannot be separated from and promote the bigger structure in the globalization. World Bank performs hegemony in the context of globalization to Indonesia whose the reaction, as a form of structural adaptation, is committing crimes of domination. In this case, the Indonesian government commit a crime in the presence of human right to water violation to the people in Jakarta. This study uses critical criminology approach to study the problem of clean water privatization policy. The method used is a qualitative method with the documents study, interviews, focus group discussions, and secondary data retrieval as data gathering technique.
