Gas bumi adalah sumber daya alam tak terbarukan yang sangat penting bagi hajat hidup banyak orang. Oleh karena itu, eksploitasi dan pemanfaatan gas bumi harus dilakukan secara bijak dan untuk kemakmuran rakyat. Hal ini diamanatkan dalam Pasal 33 ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Implementasi unbundling dan open acces dalam Peraturan Menteri ESDM Nomor 19 tahun 2009 gagal untuk mencapai tujuannya apabila dilihat dari perspektif menciptakan efisiensi dan meningkatkan pertumbuhan infrastruktur nasional gas bumi. Oleh karena itu pemerintah mengeluarkan Peraturan Menteri ESDM Nomor 4 Tahun 2018 untuk merekonstruksi banyak ketentuan yang terkandung dalam peraturan sebelumnya, terutama mengenai hak eksklusif di Wilayah Jaringan Distribusi Tertentu yang kemudian diikuti oleh perubahan prinsip pemisahan badan usaha menjadi hanya pemisahan akuntansi juga mengenai ketentuan open access menjadi third party access. Penelitian ini akan menganalisis apakah ketentuan yang terkandung dalam Peraturan Menteri ESDM Nomor 4 Tahun 2018 sesuai dengan UUD 1945 dan prinsip persaingan yang sehat.
Natural gas is a very important non-renewable natural resource that controls the livelihood of many people. Therefore, the exploitation and utilization of natural gas must be carried out wisely and for the greatest prosperity of the people. This is mandated in Article 33 Paragraph (3) of the 1945 Constitution of the Republic of Indonesia. The implementation of unbundling and open access under ESDM Ministerial Regulation Number 19 of 2009 fails to achieve the expectation from the perspective of creating efficiency and improving national infrastructure of natural gas. Therefore the government issued ESDM Ministerial Regulation Number 4 of 2018 to reconstruct many of the provisions contained in the previous regulation, mainly regarding the exclusive rights in Certain Distribution Areas which then followed by the alteration of separation principle (Legal unbundling) into accounting unbundling as well as the alteration of open access into third party access. This thesis will analyse whether the provisions contained in the ESDM Ministerial Regulation Number 4 of 2018 is in line with the 1945 constitution and the principle of fair competition.

ABSTRAK
Over the past few years, one of Indonesias state-owned enterprises, PLN, has conducted dialogues focusing on developing a new value-creative business model to transform itself, a sleepy regulated utility, into a truly competitive electricity service provider. However, efforts to preserve the prominence of the Countrys electricity sector have been ongoing as the sector is still experiencing sustained rolling blackouts, net import dependency and lack of transmission facility enforcement throughout the Indonesian archipelago. Such efforts have been varied from the incentivise policy and programs such as the Public-Private Partnership and the two phases of Fast Track Program. The reformation of electricity law dated back on the 1985, 2002 and 2009 to attract investors in the development of Indonesias electricity sector have been enacted, but a controversial issue arose from the annulment of the Law No. 20 Year 2002 on Electricity by the Constitutional Court Decision No. 001- 021-022/PUU-I/2003 stating that such law which clearly stating that the requirement to privatise electricity operation was unconstitutional. This article will try to provide a comprehensive comparative analysis of such decision with the common practice adopted by the EU which has successfully implemented its deregulation and separation of the electricitys business chain through unbundling the sector as part of liberalisation.
