"ABSTRAK
The guidance of Allah for mankind is contained in the scriptures se t down by Him through the Prophets and Messengers. These scriptures are numerous due to the number of the Prophets. But, the mentioned and prominent ones include Zabur which was given to Prophet Dawud, Suhuf which was given to Prophet Ibrahim, Tawrah which was given to Prophet Musa, Injil which was given to Prophet Isa and the Quran which was given to Prophet Muhammad. However, the most circulated ones in the contemporary world are the Quran and Bible. These two contain direct and indirect information about different issues and concepts. In spite of the similarities in few areas, the points of divergence are substantial. Hence this paper is aimed at examining five out the areas of convergence as well as the areas of divergence of both the Quran and Bible with empirical examples from both scriptures. Conclusion is made to juxtapose their similarities which are due to their divine qualities and their differences which are as a result of the abrogation and interpolation by the people. Thus, the people are encouraged to show due respect to these heavenly scriptures."

"ABSTRAK

Tesis ini membahas peran strategic similarities dan strategic complementarities terhadap kinerja Merger & Akuisisi (M&A) pada industri perbankan di Asia Pasifik. Penelitian ini adalah penelitian kuantitatif dengan menggunakan variabel-variabel dalam laporan keuangan sebagai indikator yang mencerminkan strategi yang dilakukan perusahaan. Hasil penelitian dengan metode hierarchical regression mengenai peran strategic similarities yang dapat mempengaruhi kinerja sejalan dengan penelitian-penelitian terdahulu pada wilayah regional yang berbeda, yaitu di Amerika dan Eropa. Sedangkan untuk strategic complementarities, hasilnya berbeda, dimana dampaknya tidak signifikan. Penelitian ini sekaligus menggabungkan dua pendekatan strategic yang berbeda yaitu similarities dan complementarities dalam satu penelitian meskipun konstruk dan pembahasannya terpisah. Hasil dari penelitian ini diharapkan dapat memberikan gambaran bagi para manajer dalam mengambil keputusan terkait strategic preferences saat melakukan M&A.


ABSTRACT

 


The research explains the role of strategic similarities and strategic complementarities to Merger & Acquisition (M&A) performance in Asia Pacific Banking.  This research is quantitative research based on variables in financial statement as an indicator/proxy to determine underlying strategy of the firm. The results of the research using hierarchical regression related to strategic similarities are in line with previous research on United States and Europe. However, for strategic complementarities, the results are not significant. This research also put two different strategic approach: similarities and complementarities into one research despite the construct and analysis were runs separately. From this research, managers can have better understanding which strategic preferences that they will use for M&A.

"Pembatalan merek terdaftar merupakan salah satu upaya yang dilakukan untuk melindungi suatu merek dari tindakan curang oleh pihak lain. Alasan-alasan yang dapat digunakan untuk mengajukan suatu pembatalan merek diatur di dalam Pasal 20 dan/atau Pasal 21 Undang-Undang Nomor 20 Tahun 2016. Salah satu alasan yang diatur dalam ketentuan tersebut adalah mengenai adanya iktikad tidak baik dengan meniru atau menjiplak suatu merek terkenal. Pembuktian adanya iktikad tidak baik merupakan hal yang tidak mudah karena harus mengaitkan dengan masalah persamaan pada merek serta merek terkenal. Mengenai persamaan pada merek, dapat dilihat dalam Pasal 21 ayat (1), sementara mengenai merek terkenal dapat meninjau Penjelasan Pasal 21 ayat (1) huruf b serta Pasal 18 Peraturan Menteri Hukum dan HAM Nomor 67 Tahun 2016. Dalam penerapannya, itikad tidak baik masih sering terjadi sehingga perlu penegakan hukum terkait hal tersebut.

Cancellation of a registered trade mark is one of the efforts made to protect a trade mark from the fraudulent actions of other parties. The grounds that can be used to apply for a trade mark cancellation are regulated in Article 20 and/or Article 21 of Law Number 20 of 2016. One of the grounds stipulated in the provision is the existence of bad faith by imitating or plagiarizing a trade mark. Proving the existence of bad faith is not easy because it must relate to the issue of similarities in trade mark and well-known trade mark. Regarding the similarities of trade mark, it can be seen in Article 21 paragraph (1), while the well-known trade mark can be reviewed in the Explanation of Article 21 paragraph (1) letter b as well as the Article 18 of Minister of Law and Human Rights Regulation Number 67 of 2016. In practice, bad faith still often occurs, so law enforcement is needed in this regard."

"Kemiripan pada dua kebudayaan dalam satu negara yang sama kerap terjadi, namun hal tersebut berbeda dengan kemiripan yang terdapat dalam festival Nebuta dan festival Ogoh-ogoh. Skripsi ini meneliti tentang dua negara yang berbeda dan bahkan berjauhan letaknya memiliki kemiripan kebudayaan. Penelitian dipusatkan pada masyarakat Aomori di Jepang dan Bali di Indonesia, tempat kedua festival tersebut dilaksanakan tiap tahunnya. Kedua festival ini merupakan ritual pembersihan diri. Uniknya, tujuan pembersihan diri serta bentuk prosesi yang berupa arak-arakan boneka raksasa dari kedua festival ini memiliki kemiripan satu sama lain. Penelitian ini adalah penelitian kualitatif deskriptif. Dengan berlandasan konsep kebudayaan, hasil penelitian dapat mengklasifikasikan persamaan dan perbedaan yang terdapat pada Festival Nebuta dan Festival Ogoh-ogoh.

The similarities between two cultures in the same country often happens, however it is different from that contained in the similarity of Nebuta festival and Ogoh-ogoh festival. This thesis examines two different countries and even farther apart who have similarities of culture. The study focused on the people of Aomori in Japan and Bali in Indonesia, where the festival is held annually. Both of these festivals is a cleansing ritual of self. Interestingly, self-purifying purposes and form of the procession which is cavalcade giant puppets in both festivals has similarities to one another. This study is a descriptive qualitative research. By using the concept of culture, the results can classify the similarities and the differences found in Nebuta Festival and Ogoh-ogoh Festival.

Skripsi ini membahas unsur intrinsik, yaitu tema, tokoh dan penokohan, alur, serta
latar dalam novel Sleep With The Devil karya Santhy Agatha dan novel Secret Fire
karya Johanna Lindsey. Penelitian ini bertujuan untuk membandingkan persamaan
dan perbedaan dalam novel Sleep With The Devil dan Secret Fire. Berdasarkan
penelitian, penulis melihat bahwa kedua novel memiliki banyak persamaan. Dengan
demikian, penulis menyimpulkan novel Sleep With The Devil terpengaruh novel
Secret Fire.

ABSTRACT
This thesis compares the intrinsic elements, namely theme, character and
characteristic, plot and background in Sleep With The Devil by Santhy Agatha and
Secret Fire by Johanna Lindsey. This research aims to compare the similrities and
differences in Sleep With The Devil and Secret Fire. Based on the research, the writer
concludes that both novels have many similarities and Sleep with the Devil is
influenced by Secret Fire."

"Tesis ini membahas mengenai perlindungan hukum merek terkenal atas tindakan dilusi merek terhadap persaingan curang di Indonesia. Penulis mengajukan dua pokok permasalahan: Pertama, mengenai perlindungan merek terkenal atas tindakan dilusi merek terhadap persaingan curang berdasarkan perjanjian internasional dan hukum merek di Amerika Serikat, Uni Eropa, Singapura, dan Indonesia. Sedangkan kedua, mengenai penerapan teori dilusi oleh Hakim dalam pertimbangannya dalam memutus sengketa merek terkenal. Dengan menggunakan metode penelitian yuridis normative dengan pendekatan perundang-undangan dan metode perbandingan hukum. Perlindungan yang diberikan dalam Undang-Undang No. 20 Tahun 2016 tentang Merek dan Indikasi Geografis dan Peraturan Menteri Hukum dan Hak Asasi Manusia No. 12 Tahun 2021 tentang Pendaftaran Merek belum secara eksplisit mengatur dan memberikan perlindungan merek terkenal atas suatu tindakan dilusi merek terhadap persaingan curang di Indonesia. Disisi lain, Singapore Trademark Act 1998 Chapter 332 as revised 2005 yang telah memberikan perlindungan hukum pada merek terkenal atas tindakan dilusi merek terhadap persaingan curang di Singapura. Namun, jika merujuk dalam pertimbangan Majelis Hakim Pengadilan Niaga pada Pengadilan Negeri Jakarta Pusat secara tidak langsung telah menerapkan dan memberikan perlindungan hukum merek terkenal atas tindakan dilusi merek terhadap persaingan curang secara benar. Penulis menyarankan agar perlindungan merek terkenal terhadap dilusi merek dapat dijadikan sebuah ketentuan hukum baru demi memberikan kepastian hukum bagi pemilik merek terkenal.

This thesis discusses the legal protection of well-known trademarks for trademark dilution against unfair competition in Indonesia. The author proposes two main issues: First, regarding the protection of well-known trademarks for trademark dilution against unfair competition based on International Treaties and Trademark Law in the United States, European Union, Singapore, and Indonesia. While the second is regarding the implementation of dilution theory by the Judge in his consideration in deciding the well-known trademark dispute. By using a normative juridical research method with a statutory approach and a comparative law method. The protection provided in Law No. 20 of 2016 regarding Trademarks and Geographical Indications and The Regulation of Minister of Law and Human Rights No. 12 of 2021 regarding Trademark Registration has not explicitly regulated and provided protection for well-known trademarks for an act of trademark dilution against unfair competition in Indonesia. On the other hand, the Singapore Trademark Act 1998 Chapter 332 as revised in 2005 has provided legal protection for well-known trademarks for trademark dilution against unfair competition in Singapore. However, if referring to the consideration of the Panel of Judges of the Commercial Court at the Central Jakarta District Court, it has indirectly implemented and provided legal protection of well-known trademarks for trademarks dilution against unfair competition correctly. The authors suggest that the protection of well-known trademarks for trademark dilution can be used as a new legal provision to provide legal certainty for the owner of a well-known trademark."
