Abstrak :
Tesis ini mendalami peran asas pelepasan hak (Rechtsverwerking) dibandingkan dengan kemampuan memaparkan riwayat kepemilikan tanah dalam pembuktian di pengadilan. Penelitian ini adalah penelitian yuridis normatif, yang tujuannya bersifat preskriptif. Hasil penelitian menyarankan bahwa asas Rechtsverwerking yang saat ini hanya diatur dalam Peraturan Pemerintah Nomor 24 Tahun 1997 sebaiknya segera dikuatkan dalam bentuk Undang-undang agar perannya dapat dirasakan oleh masyarakat yang memperoleh tanah dengan itikad baik.

This thesis explore the role of the principle of waiver (Rechtsverwerking) compared to the ability to expose a history of land ownership in evidence at court. This is a normative juridical research, whose goal prescriptive. The results suggest that principle of waiver (Rechtsverwerking) which is currently only regulated in form of a Government Regulation No. 24 of 1997, should be immediately strengthened to the form of a statute, that can be effecively perceived by the public whose getting a land by good intention.
