Hak atas kesehatan merupakan hal yang sangat penting untuk semua manusia, termasuk narapidana. Salah satu kelompok narapidana yang rentan terhadap permasalahan hak atas kesehatan adalah narapidana pengguna narkoba. Pada tulisan ini penulis membahas tentang hak atas kesehatan untuk pengguna narkoba dalam lembaga pemasyarakatan di Indonesia pada kondisi pandemi Covid-19. Untuk melihat permasalahan hak atas kesehatan narapidana pengguna narkoba penulis menggunakan teori keadilan sosial yang dicetuskan oleh Jhon Rawls dan humanitarian theory of punishment yang dicetuskan oleh Lewis. Penulis menganalisis permasalahan hak atas kesehatan pada narapidana pengguna narkoba di Indonesia dengan  melihat standar yang dikeluarkan oleh lembaga-lembaga Internasional. Kemudian, penulis mencoba melihat respons pemerintah Indonesia dalam melihat situasi pengguna narkoba yang ada di dalam lapas pada masa Covid-19 dan membandingkannya dengan respons ideal yang dikeluarkan oleh lembaga-lembaga Internasional termasuk urgensi vaksinasi bagi narapidana di dalam lapas, terkhusus pengguna narkoba. Setelah itu, penulis menganalisis relevansi dari penggunaan pemenjaraan dalam merespons pengguna narkoba pada saat pandemi Covid-19. ......The right to health is very important for all human beings, including prisoner. One of the groups that are vulnerable to the issue of the right to health are drug users. In this paper, the author discusses the right to health for drug users in prisons in Indonesia during the Covid-19 pandemic. To look at the problem of the right to health of drug users, the author uses the social justice theory initiated by John Rawls and the humanitarian theory of punishment proposed by Lewis. The author analyzes the issue of the right to health in the relationship of drug users in Indonesia by comparing it with the standards issued by international institutions. Then, the author tries to see the response of the Indonesian government is looking at the situation of drug users in prisons during the Covid-19 period and compares it with the ideal response issued by international institutions, including the urgency of vaccination for prisoners in prison, especially drug users. After that, the authors analyzed the relevance of the use of imprisonment in responding to drug users during the Covid-19 pandemic.

Skripsi ini membahas mengenai pengaturan transplantasi organ ditinjau dari perspektif Hak Asasi Manusia (HAM) serta menganalilis perbandingan hukum antara Indonesia dan Malaysia. Pemberian imbalan materiil maupun imateriil dalam transplantasi organ tidak diizinkan dengan dalih apapun. Berkaitan dengan hal tersebut, tujuan penulisan skripsi ini adalah untuk menganalisis pengaturan mengenai transplantasi organ ditinjau dari perspektif HAM bagi Pendonor maupun Resipien. Skripsi ini juga akan menganalisis perbandingan hukum Indonesia dan Malaysia, mengingat Malaysia merupakan negara yang juga melarang adanya jual beli organ. Metode penelitian yang digunakan untuk penulisan skripsi ini adalah metode penelitian hukum normatif. Dalam metode penelitian normative, penelitian ini akan menggunakan implementasi ketentuan hukum normatif (undang-undang) yang berlaku di Indonesia dan Malaysia. Indonesia dan Malaysia melarang adanya praktik jual beli organ dan menegaskan bahwa transplantasi organ dilakukan hanya untuk tujuan kemanusiaan. Walaupun Pendonor menyetujui untuk menjual organnya, jual beli organ tetap tidak diizinkan. Perlu adanya badan resmi negara yang mengawal jalannya proses transplantasi organ. Badan tersebut disebut dengan Komite Transplantasi Nasional. ...... This thesis analize organ transplantation from the Human Rights Perspective and comparing the law between Indonesia and Malaysia about organ transplantation. Material nor immaterial rewards are not permitted under any pretext. In this regard, the purpose of this thesis is to analyze law related to organ transplantation from a human rights perspective either for donors and also recipients. This thesis will also discuss the laws of Indonesia and Malaysia related to organ transplantation because Malaysia also prohibit the existence of organ trading. The research method used to study this thesis is the normative legal research method. In the normative research method, this research will use laws and regulations in Indonesia and Malaysia. Indonesia and Malaysia prohibit the existence of organ trading and only approve organ transplantation for humanitarian goals. Although the donor is approved to sell their organs, buying and selling organs is still not permitted. An official state agency is needed to oversee the process of organ transplantation. The official state agency is called the Komite Transplantasi Nasional.

Hak atas Kesehatan semakin sulit ditegakan dalam Pandemi COVID-19, terutama bagi pengungsi dan pencari suaka tanpa kewarganegaraan di Indonesia. Sebagai negara yang belum meratifikasi Konvensi 1951 dan protokol 1967, hak atas kesehatan pengungsi ditanggung oleh UNHCR dan IOM. Pemerintah melaksanakan program vaksinasi COVID-19 dengan tujuan menghentikan penyebaran COVID-19. Pengaturan mengenai program vaksinasi oleh pemerintah ditetapkan dalam Peraturan Menteri Kesehatan No. 18 Tahun 2021 tentang Pelaksanaan Vaksinasi Dalam Rangka Penanggulangan Pandemi Corona Virus Disease 2019 (COVID-19) dan lebih jelasnya dalam Keputusan Menteri Kesehatan No. HK.01.07/MENKES/6424/2021 Petunjuk Teknis Pelaksanaan Vaksinasi dalam Rangka Penaggulangan Pandemi Corona Virus Disease 2019 (COVID-19). Pengungsi dan pencari suaka tanpa kewarganegaraan memiliki hak atas kesehatan layaknya seluruh warga negara Indonesia dan pemerintah memiliki kewajiban untuk melindungi, memenuhi dan menghormati hak atas kesehatan. Pemerintah telah menciptakan program Vaksinasi COVID-19 yang belum dapat diakses oleh pengungsi dan pencari suaka tanpa kewarganegaraan dikarenakan adanya hambatan administrasi berupa kepemilikan kartu identitas. Pengungsi Rohingya sebagai pengungsi dan pencari suaka tanpa kewarganegaraan telah menerima vaksinasi tetapi memiliki kesulitan untuk mengakses aplikasi peduliLindungi yang merupakan bagian dari program vaksinasi COVID-19 dikarenakan hambatan administrasi tersebut. Dengan penelitian ini diharapkan kepada Kementerian Kesehatan, untuk menghapus hambatan administrasi tersebut dan dibuat peraturan yang sesuai dengan perundang-undangan agar tercipta kepastian hukum. ......The right to health is increasing difficult to enforce in the COVID-19 Pandemic, especially for stateless refugees and asylum seekers in Indonesia. As a country that has yet to ratify the 1951 Convention and the 1967 Protocol, the refugees and asylum seekers right to health are UNHCR and IOM responsibility. The government has implemented a COVID-19 Vaccination Program to prevent the spreading of the COVID-19 and is stipulated in Minister of Health Regulation no. 18 of 2021 concerning the Implementation of Vaccination in the Context of Combating the Corona Virus Disease 2019 (COVID-19) Pandemic and more thoroughly in the Decree of the Minister of Health No. 01.07/MENKES/6424/2021 Technical Instructions for the Implementation of Vaccination in the Context of Combating the Corona Virus Disease 2019 (COVID-19) Pandemic. This research explains describes the problems descriptively. This research is in the form of normative juridical research with qualitative methods. As the subject of this research, refugees and asylum seekers have the right to health like all Indonesian citizens and the government is obliged to protect this right to health. The government has established a COVID-19 Vaccination Program, that has not been accessible to stateless refugee and asylum seekers due to administrative obstacle in the form of identity ownership. Rohingya refugees as stateless refugees or asylum seekers have received vaccinations but have difficulty accessing PeduliLindungi application which is part of the COVID-19 Vaccination Program due to these administrative barriers. With this research, it is advised that the Ministry of Health will remove these administrative barriers and make regulation that are in accordance with the legislation to establish legal certainty.
