Abstrak :
In Indonesia, the concept of Internally Displaced Persons (IDPs) has not obvious enough and become the basis of thought yet. It can be seen from the regulation that regulate the IDPs which none of those regulations uses IDPs terminology. Another provides evidence is no regulation in act level regarding IDPs. The best regulation regarding IDPs in Indonesia is Presidential Decree Number 3 Year 200}. The consequence of this condition, IDPs problems could not handle properly. Contrary condition with international, there are several instruments can be apply to resolve the IDPs problem such as The 1951 Refugee Convention, the 1949 Geneva Convention relative to the Protection of Civilian Persons in Time of War. The Second Additional Protocol 1977 The protection of victims of non-international armed conflicts, and The Guiding Principles on Internal Displacement (Guiding Principles). International bodies dealing with IDPs, like UNHCR could not directly access IDPs in Indonesia because of state sovereignty. This article is trying to provide the big picture of IDPs condition and the policy in Indonesia relating to the international law.

Abstrak :
Indonesia sebagai negara bukan anggota dari Konvensi Tahun 1951 tentang Status Pengungsi (Konvensi Pengungsi) sering kali disalahkan atas ketidakmampuannya dalam pemenuhan hak pendidikan pencari suaka anak dan pengungsi anak. Posisi hukum suatu negara terhadap suatu konvensi merupakan landasan dari terbentuknya kewajiban negara tersebut atas ketentuan yang terdapat didalamnya. Adanya keikutsertaan Indonesia di dalam konvensi hak asasi manusia lainnya menyebabkan ketidakpastian atas standarisasi pemenuhan hak pendidikan anak berdasarkan statusnya sebagai pencari suaka maupun pengungsi. Maka, berdasarkan masalah ini, peneliti melakukan penelitian berdasarkan metode penelitian hukum normatif kualitatif melalui studi kepustakaan. Selanjutnya penemuan atas penelitian bahwa dalam hal kewajiban negara bukan pihak dalam Konvensi Pengungsi terhadap hak pendidikan anak, terdapat 2 kewajiban yaitu penerimaan berdasarkan non-refoulement dan penghormatan atas hak asasi manusia yang keduanya merupakan bagian dari hukum adat internasional. Sebagaimana hasil penelitian, seharusnya komunitas internasional membantu secara aktif upaya pemenuhan hak pendidikan pencari suaka anak dan pengungsi anak melalui kontribusi nyata baik secara langsung maupun tidak langsung dan bukannya menuntut pemenuhan hak tersebut secara sepihak kepada negara-negara bukan pihak, yang dalam hal ini salah satunya adalah Indonesia. ......Indonesia as a non-party to the 1951 Convention on the Status of Refugees (the Refugee Convention) is often blamed for its inability to fulfill the educational rights of child asylum seekers and child refugees. The legal position of a country towards a convention is the basis for the formation of the country's obligations for the provisions contained therein. The existence of Indonesia's participation in another human rights conventions causes uncertainty over the standardization of the fulfillment of children's education rights based on their status as asylum seekers or refugees. Therefore, based on this problem, the researcher conducts research based on qualitative normative legal research methods through literature study. Furthermore, the findings from the research show that in terms of the obligations of a country that is not a party to the Refugee Convention towards  children's education rights, there are 2 obligations, namely acceptance based on non-refoulement and respect for human rights, both of which are parts of international customary law. As the research results, the international community should actively assist efforts to fulfill the educational rights of child asylum seekers and child refugees through real contributions, either directly or indirectly, instead of demanding the fulfillment of these rights unilaterally to non-parties, which in this case is Indonesia.
