Skripsi ini membahas nilai-nilai kedaulatan rakyat dalam bidang keuangan negara yang terciderai dengan pengaturan ketentuan materiil pungutan yang memaksa yang tidak dimuat dalam Undang-Undang, namun dalam Peraturan Pemerintah. Undang-Undang PNBP Nomor 20 Tahun 1997 mendelegasikan kewenangan pengaturan subyek, obyek, dan tarif PNBP kepada Peraturan Pemerintah yang dibentuk oleh Presiden tanpa melibatkan Dewan Perwakilan Rakyat. Hal tersebut bertentangan dengan Pasal 23A dan 1 ayat (2) UUD 1945 pasca amandemen, dan asas-asas pembentukan peraturan perundang-undangan yang baik. Undang-Undang PNBP Nomor 7 Tahun 1997 yang merupakan produk pra-reformasi harus segera diganti untuk disesuaikan dengan UUD 1945 yang telah diubah sebanyak empat kali.

This research analyses the values of people`s sovereignty over the State`s finances which has been deprived by the substantial provisions of mandatory charges found within government regulation. Law Number 20 Year 1997 allows Government Regulations to determine the subject, object, and tariff of state`s non-tax income. Government Regulations are issued by the President and does not require Parliament`s approval. Such thing is contrary to the provisions of Article 1 paragraph 2 and Article 23A Undang-Undang Dasar 1945 after the third amendment and good principles of state`s regulation formation. Law Number 7 Year 1997 which was the product of the pre-reformation regime must be replaced immediately to cope with the new constitution which has been amended for four times.
