"This articles examines the position of Chinese photographers in the visual colonial landscapes. The Chinese toekang potret were involed in both commissioned photographs and the production of commercial imgaes, but the latter was lesswidespread. Contratry to the image that Chinese photographers client wew from the lower strata of society, this article shosw the they were commissioned by the European, Chinese and Javanese elite. The image materiality of the portrats reveals the visual traces of circulation and exchange. Hence, the Chinese photographers were indirectly involved in these elite networks as well."

"ABSTRAKSkripsi ini membahas mengenai sebuah hak moral berupa hak menarik kembali sebuah ciptaan dari publikasi (retraction right) yang dimiliki oleh seorang pencipta atas sebuah ciptaannya. Penentuan seorang pencipta dapat menggunakan hak moral yang ia miliki ini didasarkan kepada berbagai doktrin dan/atau teori mengenai hak moral. Penggunaan berbagai doktrin dan/atau teori hak moral diperlukan karena belum memadainya perlindungan hak moral yang terdapat dalam Undang-Undang Hak cipta. Untuk hak moral berupa hak menarik kembali sebuah ciptaaan dari publikasi dalam sebuah karya potret memiliki sebuah dasar alasan yang jelas dalam pengajuan dan pelaksanaan dari hak moral tersebut. Penelitian ini adalah penelitian yuridis-normatif dengan tipologi deskriptif. Hasil penelitian ini menyarankan agar pihak-pihak terkait khususnya pihak pemotret untuk lebih memperhatikan tujuan dan maksud dari sebuah kegiatan perjanjian dengan pihak ketiga sebagai pihak pengguna dari potret yang dihasilkan oleh pemotret, selain itu kepada pihak yang dipotret atau model untuk memperhatikan tujuan penggunaan dari sebuah hasil pemotretan, masyarakat agar tidak sembarangan menggunakan sebuah potret yang dihasilkan pemotret, dan pemerintah diharapkan agar dapat membuat pengaturan yang memadai mengenai hak moral dari seorang pencipta di dalam Undang-Undang Hak Cipta.

ABSTRACTThis research paper discusses the right to retract a work from the public use (retraction right) that an author possesses for his work. The principle for the author in using his moral rights is based on various doctrines and/or theories about moral rights. The use of those doctrines and/or theories is needed due to the lack of moral rights protection in the Copyright Law. As for the moral right where a work (or photos, in this case) can be retracted from the public use, there has to be a clear description in proposing and implementing the right. This research was done by using the juridical-normative method with descriptive typology. The results of this research suggest the related parties, especially photographers, pay more attention to all intents and purposes of an agreement with a third party as the user of the photos they produce; models pay more attention to the purpose behind a photo shoot; people use the photos taken by photographers appropriately; and the government provide fair regulations regarding the moral rights of an author in the Copyright Law."
