Abstrak :
Tesis ini membahas mengenai ada atau tidaknya peralihan hak dalam perpanjangan hak atas tanah bersama rumah susun. Hal ini berkaitan dengan kewajiban Perhimpunan Penghuni yang beranggotakan pemegang Sertipikat Hak Milik atas Satuan Rumah Susun (SHMSRS) untuk mengajukan permohonan perpanjangan hak atas tanah bersama yang dalam sertipikatnya tercantum nama Penyelenggara pembangunan sebagai pemegang haknya. Kesimpulan dari tesis adalah bahwa tidak terjadi peralihan hak atas tanah dalam perpanjangan hak tersebut karena setelah diterbitkan dan dialihkannya SHMSRS atas tanah bersama, bukti pemegang hak atas tanah bersama ada pada SHMSRS yang dikuasai pemilik satuan rumah susun. Namun demikian, hal ini tidak diatur secara jelas dalam peraturan yang ada sehingga perlu diperbaiki demi kepastian hukum.

This thesis provides the existence of transfer of rights in the extension of condominium's joint land title process. This is related to the Tenant Association's obligation to apply the extension of land title, which is registered under the name of the developer. As the conclusion, there is no transfer of rights because following the issuance of right to own condominium's unit title, the evidence of the rights holder is not in the land title anymore but in the right to own condominium?s unit title which is owned by the Tenant Association?s members. Nonetheless, there is still no legal certainty on this matter so that the state must further regulate.

Tesis ini membahas mengenai aspek hukum dalam pembangunan rumah susun dan jual beli satuan rumah susun pada rumah susun yang dikembangkan oleh Pengembang "A". Dibahas mengenai kepatuhan Pengembang "A" dalam mengikuti persyaratan teknis dan administratif yang ditentukan peraturan perundang-undangan dalam membangun rumah susun, cara penjualan satuan rumah susun yang dilakukan oleh Pengembang "A" dengan pemesanan terlebih dahulu dan pengikatannya dengan perjanjian akan jual beli, serta mengenai tanggung jawab Pengembang "A" sebagai pengurus perhimpunan penghuni sementara dan kewajibannya membentuk perhimpunan penghuni yang sebenarnya.

The focus of this thesis is the analysis of legal aspect in the development of apartment buildings by Developer "A" and its units sale-purchase to the consumers. Described here are the obedience level of Developer "A" in following the terms of technical and administrative requirements determined by the regulations in the apartment buildings development, how Developer "A" sale the apartment units to the consumers through the pre sale-purchase agreement, and how is the responsibility of Developer "A" in its role as the temporary board of apartment building's occupants association and its obligation to establish the real occupants association.
