In this article, the author addresses the problem of violence towards women, with a focus on the violence in ethnic conflict and armed conflict. She takes the view that any legal system should be seen as having three components, i.e., legal substance, legal structure and legal culture, and that none of these components protect women from acts of violence. Citing articles from the criminal code, the authors show how the laws cannot protect women who are victims of violence and how some articles of the code in fact perpetuate injustice toward women. Following this, she shows how law enforcement officers who constitute the legal structure lack any gender awareness in their handling of cases. Finally, the attitudes and beliefs toward the law is the legal culture encourages the view that women are the property of men, especially in times of armed conflict. "

"ABSTRAK
Tugas karya akhir ini melihat bagaimana upaya dari penyidik unit perlindungan perempuan dan anak dalam menangani kasus anak sebagai korban kekerasan seksual melalui teori ikatan sosial yang mengedapkan kepentingan terbaik bagi anak dan berupaya menghindarkan anak dari pemberian label dari masyarakat. Tugas karya akhir ini disertai dengan data sekuder, baik dari lembaga kepolsian maupun dari berita. Analisa pada tugas karya akhir ini didukung dengan adanya kajian literatur mengenai penanganan unit perlayanan perempuan dan anak atau lembaga non-formal yang memiliki kajian yang sama. Dari hasil analisa penulis, dapat dikatakan bahwa penanganan yang diberikan kepada anak korban kekerasan seksual masih dikatakan kurang melindungi. Kepolisian Indonesia perlu membentuk sebuah peraturan atau prosedur khusus yang membahas bagaimana penanganan terbaik yang diberikan kepada anak sebagai korban atau lebih tepatnya anak sebagai korban kekerasan seksual.

ABSTRACT
This thesis discusses looks at how efforts of female and child protection unit investigators to address child cases as victims of sexual violence through social bonding theory that bestows the best interests of the child and seeks to prevent children from labeling from the community. This final paper work is accompanied by secondary data, both from the police and the news. The analysis on this thesis is supported by a literature review on the handling of women and child service units or non formal institutions that have the same study. From the results of the author 39s analysis, it can be said that the handling given to children victims of sexual violence is still said to be less protective. The Indonesian police need to establish a special regulation or procedure that addresses how the best handled to the child as a victim or more precisely the child as a victim of sexual violence."

"Skripsi ini bertujuan untuk melakukan analisis terhadap peraturan perundang-undangan di Indonesia yang berkaitan dengan korban perkosaan guna memposisikan dan mengakamodasi perlindungan terhadap para korban tersebut. Peneliti melakukan analisis terhadap hukum adat Nagari Lunang terkait perlindungan terhadap korban perkosaan. Metode yang dipergunakan dalam penelitian ini adalah berperspektif sosio-legal dengan melakukan analisis terhadap aturan terkait perlindungan korban perkosaan yang diatur dalam Undang-Undang Nomor 7 Tahun 1984 tentang pengesahan CEDAW, Kitab Undang-undang Hukum Pidana, dan Undang-undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban serta dengan pengumpulan data yang dilakukan dengan beberapa cara, yaitu pengamatan, wawancara secara mendalam dengan bantuan instrumen berupa pedoman wawancara, dan dokumentasi dalam rangka mengungkapkan gejala-gejala dalam kehidupan di masyarakat seperti yang dipersepsikan oleh warga masyarakat Nagari Lunang tentang kondisi mereka sendiri. Perlindungan terhadap perempuan korban perkosaan baik secara yuridis maupun non-yuridis merupakan hal yang penting guna menjamin tegaknya rasa keadilan dalam masyarakat. Namun, hingga saat ini, perlindungan terhadap perempuan korban kekerasan masih sangat minim, seperti yang ditunjukkan dari kurangnya komitmen negara dalam melindungi mereka. Untuk mewujudkan perlindungan yang dimaksudkan tersebut maka dibutuhkan suatu instrumen hukum yang dapat mengakamodir hak-hak perempuan atas kebenaran, keadilan dan pemulihannya secara utuh menyeluruh.

This undergraduate thesis aims to analyze the laws and regulations in Indonesia relating to rape victims to positioning and accommodate the protection of these victims. Researchers conducted an analysis of the customary law of Nagari Lunang related to the protection of rape victims. The method used in this study is a socio-legal perspective by analyzing the rules relating to the protection of rape victims regulated in Law Number 7 of 1984 concerning the ratification of CEDAW, Criminal Law Book, and Law Number 13 Year 2006 concerning Protection of Witnesses and Victims, as well as by collecting data carried out in several ways, namely observation, in-depth interviews with the help of instruments in the form of interview guidelines, and documentation in order to express symptoms in life in the community as perceived by residents of Nagari Lunang about their own condition. Protection of women victims of rape both legally and non-legally is important to ensure the upholding of a sense of justice in society. However, until now, the protection of women victims of violence is still very minimal, as shown by the lack of state commitment to protect them. To realize the intended protection, a legal instrument is needed that can fully accommodate the rights of women to truth, justice, and its full recovery."

"Penelitian ini berisi tentang perlindungan perempuan korban KDRT pada masa pandemi Covid-19 dari disiplin Ilmu Kesejahteraan Sosial. Penelitian ini dilatarbelakangi oleh peningkatan angka kasus kekerasan terhadap perempuan khususnya KDRT pada masa pandemi Covid-19. Keterbatasan ruang gerak serta menurunnya perekonomian menimbulkan frustasi bagi sebagian besar masyarakat yang dapat meningkatkan agresivitas. Perempuan sebagai kelompok rentan, memiliki potensi yang tinggi untuk menjadi korban kekerasan. Sehingga, urgensi dilakukannya penelitian ini adalah untuk melihat upaya perlindungan yang dilakukan oleh Komnas Perempuan sebagai Lembaga Nasional Hak Asasi Manusia dalam rangka mencegah dan menanggulangi kekerasan terhadap perempuan serta meningkatkan perlindungan dan kesejahteraan perempuan di Indonesia. Penelitian ini merupakan penelitian kualitatif dengan jenis deskriptif. Pengumpulan data dilakukan pada Mei 2022 hingga Oktober 2022 melalui studi literatur dan wawancara semi terstuktur pada lima informan dari Komnas Perempuan, LBH Apik Jakarta dan Yayasan Pulih. Kelima informan tersebut dipilih menggunakan teknik purposive sampling sesuai dengan kriteria informan yang dibutuhkan dalam penelitian ini. Hasil penelitian ini menunjukkan bahwa dalam melakukan upaya perlindungan perempuan korban KDRT pada masa pandemi Covid-19, Komnas Perempuan memberikan rekomendasi kebijakan ke berbagai lembaga pemerintah, melakukan layanan pengaduan dan rujukan serta melakukan Kampanye 16 HAKTP setiap tahunnya. Hasil penelitian ini diharapkan dapat memberi sumbangsih bagi program studi Ilmu Kesejahteraan Sosial khususnya dalam mata kuliah Perundang-undangan Sosial terkait dengan perlindungan sosial dan mata kuliah Kebijakan dan Perencanaan Sosial terkait dengan kebijakan sosial.

This research is about protection of women victims of domestic violence during the Covid-19 pandemic from the Social Welfare Science discipline. This research is motivated by an increase in the number of cases of violence against women, especially domestic violence during the Covid-19 pandemic. Space limitations as well as economic decline cause frustration for the majority of society which can increase aggressiveness. Women as a vulnerable group, have a high potential to become victims of violence. Therefore, the urgency of doing this research is to see the social advocacy efforts made by the National Commission on Violence Against Women as a National Human Rights Institution in order to prevent and cope with violence against women as well as increasing the protection of women in Indonesia. This research is a qualitative research with descriptive research design. Data collection was carried out from May 2022 to October 2022 through literature studies and semi-structured interviews with five informants from the National Commission on Violence Against Women, LBH Apik Jakarta and Yayasan Pulih. The five informants were selected using a purposive sampling technique according to the informant critetia needed in this research. This research showed that in doing protection of women victims of domestic violence during the Covid-19 pandemic, the National Commission on Violence Against Women provide policy recommendations to various government institutions, carry out complaint and referral services as well as doing 16 HAKTP Campaign every year. The results of this research are expected to be able to contribute in Social Welfare Science study program especially in social law course related to social protection and social policy and planning courses related to social policies."

"Upaya Perlindungan Diri Perempuan dari Pelecehan Seksual Pada Perang Dunia II dalam Film Anonyma: Eine Frau in Berlin Karya Max Färberböck

The issue of sexual harassment against women is an issue that has long been a topic of discussion in the world. Sexual harassment of women is formed from the existence of hegemonic masculinity. According to Gramsci, hegemony is a form of domination and power, in short, hegemonic masculinity can be interpreted as a form of domination and power exercised by men over women. This is common in various social circles, therefore women
fight for their rights and demand gender equality. This research will raise the issue of identity change caused by hegemonic masculinity against the main female character Anonyma in Germany during World War II, through the film Anonyma: Eine Frau in Berlin. This research uses a qualitative approach and literature review through books, journals and scientific articles. The main focus of this research is the actions of the Russian army and the situation in the environment that supports the identity change and struggle of the figures Anonyma. How the surrounding environment can influence the process of forming the identity of Anonyma's character and the struggles he undertakes. This is answered by using the theory place identity and using cinematographic techniques in analyzing scenes in the film. The results of the analysis show that a person's identity can be formed through environmental influences, as well as the struggles that women waged by arranging strategies to protect themselves from sexual violence during World War II.

"Penelitian ini dilatarbelakangi oleh berbagai kasus kekerasan terhadap perempuan dan anak yang terjadi di Provinsi Maluku. Dewasa ini, kasus kekerasan terhadap perempuan dan anak selalu terjadi. Kita melihat di berita-berita, baik itu berita online, surat kabar maupun di sosial media, maraknya kasus kekerasan yang terjadi selalu melibatkan perempuan dan anak sebagai korban. Sementara itu, di Provinsi Maluku, kasus kekerasan boleh dikatakan selalu naik tiap tahunnya meskipun Perda Perlindungan Perempuan Dan Anak telah disahkan, yaitu pada tahun 2012. Perda yang disahkan pada 4 (empat) tahun lalu itu ternyata masih jauh dari harapan. Sebab, kebijakan yang dirasa mampu menjawab permasalahan perempuan dan anak ternyata tidak berdampak apa-apa. Hal ini tentu berkaitan erat dengan peran yang dimainkan oleh setiap anggota legislatif (terkhususnya perempuan) yang tergabung di dalam tim pembuat kebijakan.
Sebagai landasan teoritis, penelitian ini menggunakan pendekatan konseptual peran untuk melihat sikap politik anggota legslatif perempuan di dalam pembuatan perda; serta menggunakan pendekatan teoritis gender yang di dalamnya terdapat konsepsi gender dan demokrasi dalam melihat perempuan di dalam parlemen. Di dalam penelitian ini juga terdapat posisi tawar anggota legislatif perempuan di dalam tim pembuat kebijakan. Hal ini cukup direpotkan dengan hambatan-hambatan partai politik serta budaya patriarki yang masih sangat kuat di dalam parlemen bahkan hingga masuk ke tim pembuat kebijakan.
Dengan menggunakan metode kualitatif, hasil yang diperoleh yaitu anggota legislatif perempuan belum maksimal menjalankan perannya dalam pembuatan Perda Penyelengaraan Perlindungan Perempuan Dan Anak Korban Kekerasan Di Maluku.. Hal ini disebabkan oleh jumlah anggota legislatif perempuan dan jumlah aktor kritis yang sedikit di dalam tim pembuat Perda tersebut. Kedua, fokus keterwakilan anggota legislatif lebih banyak ke partai politik. Ketiga, dalam pembuatan perda tersebut anggota legislatif perempuan lebih bersifat delegasi (utusan dari partai politik) ketimbang mewakili konstituennya. Keempat, isu keterwakilan perempuan belum menjadi bagian kepemilikan isu oleh partai politik. Dan kelima, komunikasi oleh sesama anggota legislatif perempuan dan kelompok kepentingan (LSM) kurang begitu baik.

This research is motivated by cases of violence against women and children that occurred in the province of Maluku. Today, cases of violence against women and children is always happening. We see in the news, either online news, newspapers and on social media, many cases of violence always involves women and children as victims. Meanwhile, in the province of Maluku, violence is virtually always go up every year even though Regulation Women And Children Protection has been ratified, ie in 2012. The recent legislation passed in 4 (four) years ago it was still far from expectations. Therefore, policies that felt able to answer the problems of women and children did not affect anything. This is of course closely related to the role played by each member of the legislature (terkhususnya female) is incorporated in the policy making team.
As a theoretical foundation, this study uses a conceptual approach to the role of political attitudes member legslatif see women in the making of regulations; and using a theoretical approach to gender in which there are conceptions of gender and democracy in view of women in parliament. In this study there is also a legislative bargaining position of women in policy making team. It is quite bothered by the constraints of political parties as well as a patriarchal culture that is still very strong in the parliament even to get into the team policymakers.
By using qualitative methods, the results obtained by the women legislators have not been up to perform its role in the formulation of regulations Implementation of the Protection of Women and Children Victims of Violence in Maluku .. It is caused by a number of female legislators and the number of actors are a bit critical in the regulation making team , Second, focus more legislative representation to political parties. Third, in the manufacture of these regulations are more women legislators delegates (delegates of political parties) rather than to represent their constituents. Fourth, the issue of women's representation has not become part of the ownership issue by political parties. And fifth, the communication by fellow female legislators and interest groups (NGOs) not so good.
