Abstrak :
Tugas Karya Akhir ini membahas tentang proses terbentuknya suatu Peraturan Menteri Ketenagakerjaan Republik Indonesia Nomor 2 Tahun 2015 Tentang Pekerja Rumah Tangga. Penelitian ini bertujuan untuk menjelaskan atau menggambarkan proses terbentuknya Permenaker No.2 Tahun 2015. Teori yang digunakan untuk menjelaskan penelitian ini antara lain kebijakan publik, sektor informal dan perlindungan tenaga kerja. Pendekatan ini menggunakan pendekatan kualitatif dengan metode pengumpulan data melalui studi literatur/dokumen dan wawancara mendalam. Hasil penelitian ini adalah formulasi Permenaker ini memiliki 3 tahapan, yakni pertama masukan-masukan dari masyarakat, kedua pembuatan draft Permenaker No.2 Tahun 2015 dan ketiga disahkannya Permenaker No.2 Tahun 2015 memfokuskan kepada lembaga penyalur. Hal ini disebabkan terdapat beberapa hal yang akan sulit diterapkan jika memfokuskan kepada PRT seperti jam kerja dan upah. Upaya pemerintah dalam melindungi pekerja rumah tangga anak telah terlihat dengan adanya pelarangan dalam permenaker ini. Namun permenaker ini masih belum cukup kuat untuk melindungi PRT dan kurang partisipatif dalam pembuatannya. ...... This minor thesis discusses about the process of formation of Regulation No.2/2015 about Domestic Workers, from the Ministry of Employment of the Republic Indonesia. This research aims to explain or describe the formation process of Permenaker 2 2015. The theories used to explain this research include public policy, the informal sector, and labor protection. The methods of this thesis using qualitative approach of data collection, using the study of literature or documents and in-depth interviews. The results of this study is the formulation of Ministry of Employmemt Regulation has three steps, the first is input from the public, the second is the drafting of Permenaker No.2/2015, and the third is legalization of Permenaker No.2/2015 that focused on the distributor of domestic workers. This is due to there are some things that would be difficult to implement if the focus to domestic workers such as working hours and wages. Government efforts to protect child domestic workers have been seen by the prohibition in this Ministrial Regulation. However this regulation from the Ministry of Employment of the Republic Indonesia is still not strong enough to protect domestic workers and less participative in the making.
