Abstrak :
Seiring berkembangnya industri penerbitan buku, perlindungan Hak Kekayaan Intelektual berupa Hak Cipta, baik bagi penulis, maupun penerbit, harus segera disesuaikan dengan kebutuhan perlindungannya. Tujuan dari penelitian ini adalah untuk menganalisa keefektifan penerapan regulasi-regulasi terkait dalam melindungi Hak Cipta yang melibatkan penerbit dan penulisnya, terutama menganalisa perlindungan hak integritas yang merupakan bagian dari hak moral seorang pencipta dalam proses penyuntingan buku.
Jenis penelitian ini adalah Yuridis Normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder belaka dengan menjalankan dua tahap penelitian, yaitu penelitian kepustakaan dan didampingi dengan penelitian lapangan. Data primer didapatkan melalui pengumpulan bahan dari beberapa narasumber, yaitu para penulis dan penyunting beberapa perusahaan penerbitan di Indonesia. Data-data ini kemudian diolah dan dianalisis secara normatif kualitatif, yaitu metode yang menganalisis data-data yang diperoleh secara kualitatif untuk menemukan kejelasan atas pokok permasalahan.
Pada kesimpulannya, penelitian ini menemukan bahwa ternyata regulasi yang dibuat untuk melindungi Hak Cipta terhadap ciptaan yang dihasilkan dalam proses penerbitan, yaitu Undang-Undang RI No. 19 Tahun 2002 tentang Hak Cipta, belum efektif untuk melindungi hakhak penulis, terutama hak moral, dalam proses penerbitan, serta belum memberikan kepastian hukum kepada penerbit selaku pemegang hak cipta. Selain itu, ditemukan pula banyak ketidaksesuaian antar beberapa ketentuan sehingga mengakibatkan ketidakjelasan hukum dalam penegakan perlindungan Hak Cipta.
......As the development of the book publishing industry grows even more massive each day, the protection of intellectual property rights such as Copyright, both for authors and publishers, must be tailored to the needs of the current protection problems. The purpose of this study was to analyze the effectiveness of the implementation of regulations related to Copyright protection that involves both the publisher and the author during a publishing contract, especially analyzing the protection of the integrity rights that are part of the moral rights of an author in the process of editing a book.
The type of this research is normative juridical, where a legal research is done by examining library materials or mere secondary data by running the two stages of the research, the research literature and assisted with field research. The primary data is obtained through the collection of material from several sources, namely by interviewing the authors and editors of several publishing companies in Indonesia. These data are then processed and analyzed using qualitatively normative method that analyzes the data obtained qualitatively to find clarity over the issue.
In conclusion, this study found that the regulations designed to protect against the creation Copyright generated in the process of publishing , namely Law No. 19 of 2002 on Copyright, has not yet been an effective way to protect the rights of authors, especially moral rights, in the publishing process, and has not yet provided legal certainty to the publisher as copyright holder. In addition, there are also a lot of discrepancies between some of the terms that lead to ambiguities in the law enforcement of Copyright protection.
