Abstrak :
Pelaksanaan kewenangan Pengaturan dan Pengawasan oleh Pemerintah terhadap Penyelenggara Over The Top (OTT) mencakup penetapan kebijakan, pelaksanaan kebijakan, fasilitasi infrastruktur, promosi dan edukasi terhadap masyarakat,dan pengawasan dilaksanakan oleh Kementerian Komunikasi dan Informatika. Pengawasan dan pengaturan tersebut meliputi pemantauan, pengedalian, pemeriksaan penelusuran dan pengamanan terhadap Penyelenggaraan Over The Top (OTT). Permasalahan mengenai Pelaksanaan kewenangan Pengaturan dan Pengawasan oleh Pemerintah terhadap Penyelenggara Over The Top (OTT) dikarenakan belum memilikinya peraturan pelaksana khusus terkait penyelenggaraan tersebut sehingga menimbulkan berbagai permasalahan dalam Penyelenggara Over The Top (OTT). Penyelenggara Over The Top (OTT) yang merupakan Penyelenggara Sistem Elektronik yang memberikan layanan aplikasi atau konten melalui internet dalam pelaksanaannya belum memiliki peraturan yang jelas dan lengkap sehingga permasalahan muncul seperti kedudukan dengan Penyelenggara Telekomunikasi, perlindungan data pribadi dan prosedur pemberiaan sanksi administratif. Terkait dengan metode penelitian yang digunakan dalam penilitian ini adalah yuridis normatif mengacu pada norma hukum yang terdapat pada peraturan perundang-undangan. Berdasarkan hasil penilitian sebagai bentuk dari kewenangan pemerintah dalam mengatur dan mengawasi Penyelenggara Over The Top (OTT) diperlukan pembentukan peraturan pelaksana khusus terkait Penyelenggara Over The Top (OTT) sehingga memberikan pengaturan dan pengawasan yang jelas dan lengkap pada Penyelenggara Over The Top (OTT). ......The implementation of the authority of Regulation and Supervision by the Government to the Organizer Over The Top includes policy determination, policy implementation, infrastructure facilitation, promotion and education to the community, and supervision carried out by the Ministry of Communication and Informatics. Such monitoring and arrangements include monitoring, tracking, tracking and securing the Implementation of Over The Top . Related to the research method used in this study is normative juridical reference to the legal norms contained in the legislation . Based on the results of the study as a form of government authority in regulating and supervising the Organizer Over The Top required the establishment of special implementing regulations related to Over The Top so as to provide clear and complete arrangements and supervision to the Organizer Over The Top.
