"Penelitian ini menganalisis bagaimana penyedia jasa konstruksi dapat dikenakan dalil perbuatan melawan hukum dalam perkara Putusan Nomor 40/PDT.G/2023/PN Mtr mengenai sengketa konstruksi berdasarkan Pasal 1365 KUHperdata. Penelitian ini disusun dengan menggunakan metode penelitian doktrinal. Penulis menguraikan dan menganalisis tiga permasalahan dalam penelitian ini, yaitu pengaturan jenis-jenis penyelenggaraan jasa konstruksi di Indonesia, perbuatan melawan hukum yang dapat dilakukan oleh penyedia jasa konstruksi dalam konsep hukum perdata, dan pertimbangan hakim dalam mengenakan dalil perbuatan melawan hukum kepada penyedia jasa konstruksi pada perkara putusan terkait. Terdapat tiga jenis usaha jasa konstruksi, yaitu jasa konsultansi konstruksi, pekerjaan konstruksi, dan pekerjaan konstruksi terintegrasi yang masing-masing memiliki kewajiban hukum berbeda-beda sesuai dengan layanan usaha yang diberikan. Hasil penelitian ini menunjukan bahwa perbuatan penyedia jasa konstruksi dalam suatu sengketa konstruksi dapat digugat dan diputus atas dasar perbuatan melawan hukum. Penyedia jasa konstruksi dapat dikatakan melakukan perbuatan melawan hukum karena telah melakukan kelalaian dan ketidak hati-hatian melanggar kewajiban hukumnya sebagaimana yang diatur dalam UU Jasa Konstruksi dan PP Pelaksana UUJK sehingga karenanya dapat dibebankan pertanggungjawaban untuk mengganti kerugian yang ditimbulkannya.

This research analyses how construction service providers can be charged with tort in Case No. 40/PDT.G/2023/PN MTR regarding construction disputes based on Article 1365 of the Indonesian Civil Code. This research is conducted using the doctrinal research method. The author describes and analyses three problems in this research, namely the regulation of the types of construction services in Indonesia, unlawful acts that can be committed by construction service providers in the concept of civil law, and the judge's consideration in imposing unlawful acts on construction service providers in related verdict cases. There are three types of construction services business, namely construction consultancy services, construction work, and integrated construction work, each of which has different legal obligations according to the business services provided. The results of this study show that the actions of construction service providers in a construction dispute can be sued and decided by tort.The construction service provider can be said to have committed a tort because it has committed negligence and imprudence in violating its legal obligations as stipulated in the Construction Services Law and the PP Implementing the UUJK so that it can be held liable to compensate for the losses caused."

ABSTRACT<>br>In line with physical development that being speeded up by the government, Indonesia currently welcoming a huge number of foreign construction company that wants to make contract and do business on the country. At the beginning of 2017, Indonesian government regulated a new construction law named Act No. 2 2017, replacing Act No. 18 1999. Therefore in this article, the authors want to discuss about how the forementioned law Act. No.2 2017 ruling about construction contract that involving foreign contractor and then do a case study of Emrail Sdn Bhd Malaysian company on LRT Jakarta Trackworks construction contract. After the research, the author concludes that Act born constituting new norms that ruling about foreign contractor which can rsquo t be found on old construction law. However, in the practice, those new norms hasnt been fully obeyed, one of them is Emrail Sdn Bhd which breaking some rules about representative office and license Izin Perwakilan . That problem gives legal consequences to the enterprise administratively and to the LRT Jakarta Trackworks construction contract it made. This work is a legal research and the datas are collected from literatures, interviews, and the contract itself"

"Dalam Suatu proyek konstruksi terdapat beberapa hal penting yang harus diperhatikan salah satunya yaitu biaya. Salah satu kendala dalam dunia jasa konstruksi di Indonesia dipicu oleh kenaikan bahan bakar minyak (BBM). Hal ini berdampak langsung secara signifikan terhadap biaya setiap item pekerjaan yang telah dikerjakan sebelum terjadi kenaikan dan pekerjaan yang belum dikerjakan setelah terjadi kenaikan harga bahan bakar minyak (BBM). Oleh sebab itu, kenaikan harga bahan bakar minyak (BBM) telah menjadi satu masalah serius yang berdampak pada industri konstruksi sehingga diperlukan suatu analisa hubungan antara biaya konstruksi bangunan dengan kenaikan harga bahan bakar minyak (BBM). Penelitian ini bertujuan untuk mengetahui seberapa besar dampak kenaikan harga bahan bakar minyak (BBM) terhadap biaya setiap item pekerjaan yang telah dikerjakan sebelum terjadi kenaikan dan pekerjaan yang belum dikerjakan setelah terjadi kenaikan harga bahan bakar minyak (BBM). Metode penelitian yang dilakukan berupa studi kasus dengan mengumpulkan responden dalam bentuk observasi dan wawancara terhadap pihak-pihak yang terkait dan data yang didapat akan dianalisa dengan menggunakan metode analisa deskriptif. Dari hasil penelitian ini akan diketahui perkiraan biaya konstruksi bangunan dan kenaikan biaya produksi seiring dengan kenaikan harga Bahan Bakar Minyak (BBM) bagi penyedia jasa konstruksi.

In a construction project there are some important matters which must be paid attention one of them that is expense. One of constraint in the world of construction service is in Indonesia triggered by increase of oil fuel. This matter affect direct by isn't it to expense every work item which have been done by before happened work and increase which not yet been done by after happened oil fuel increase of price . On that account, oil fuel increase of price have come to one serious problem which affect at construction industry is so that needed by an analysis relation between building construction expense by oil fuel increase of price.

This research aim to to know how big affect oil fuel increase of price to expense every work item which have been done by before happened work and increase which not yet been done by after happened oil fuel increase of price.

Research method in the form of case study collected responder in the form of interview and observation to related and got data will be analysed by using descriptive analysis method.

From this research result will know by estimate of building construction expense and increase of production cost along with Fuel Oil increase of price for provider of construction service."
