"Praktek ini dilatarbelakangi oleh karena telah ditemukannya praktek dimana dilaksanakan pembuatan akta penjaminan fidusia, yang didasarkan atas surat kuasa penjaminan fidusia dimana yang menandatangani surat kuasa tersebut berupa orang yang berbeda dengan pemilik benda yang ingin dijadikan jaminan fidusia tersebut. Dalam hal ini penulis berniat untuk menganalisis beberapa contoh akta jaminan fidusia beserta surat-surat kuasanya yang dibuat pada kantor notaris X.Penelitian ini dilakukan dengan metode kepustakaan dengan melakukan studi dokumen menggunakan bahan-bahan dari data sekunder, yang diperoleh dari kepustakaan, seperti buku-buku, artikel, skripsi, tesis, contoh surat kuasa penjaminan fidusia dalam bentuk bawah tangan, contoh akta penjaminan fidusia yang dibuat oleh Notaris X, dan lain sebagainya.

The background of this research is because of the discovery of a practice on the making of fiduciary guarantee deeds, that were based on power of attorneys where the person that signed the power of attorney is not the same person that owns the object that was about to be fiducary guaranteed. The goal of this research is to analyze the couple of examples of fiduciary guaranteed deeds along with the power of attorneys that was made in the notary office of X.This research was conducted by using library method, by doing documents study using materials from secondary data, that was procured from the library, for example books, articles, essays, thesis, examples of power of attorneys on fiduciary guarantees in the form of underhand, examples of deeds of fiduciary guarantees that was made by Notary X, and so on and so forth."

"Hak milik yang telah diatur secara secara khusus dan komprehensif dalam Kitab-Undang-Undang Hukum Perdata di Indonesia memberikan kesan bahwa prinsip hak milik sudah diatur secara sempurna, tetapi pada praktiknya masih terdapat celah pemilik hak atas benda yang dijaminkan tidak terlindungi sebagaimana mestinya. Skripsi ini akan membahas permasalahan akibat benda yang dijadikan jaminan fidusia dalam suatu perjanjian kredit tanpa sepengetahuan pemilik benda (dengan melakukan penipuan) serta perlindungan hukum yang dapat diberikan kepada pemilik benda dan kreditur penerima jaminan fidusia yang beritikad baik. Penelitian skripsi ini dilakukan dengan menggunakan metode penelitian yuridis-normatif, dengan pendekatan menggunakan peraturan perundang-undangan dan studi kasus. Hasil penelitian ini menyimpulkan bahwa jaminan fidusia tidak lahir apabila dilakukan dengan benda yang didapat dari hasil penipuan sebagaimana diatur dalam Pasal 35 UU Jaminan Fidusia, yang akhirnya berpotensi pada gugat-menggugat antara pemilik benda dan penerima jaminan fidusia di pengadilan.

Property rights that have been specifically and comprehensively regulated in the Civil Code in Indonesia give the impression that the principle of property rights has been perfectly regulated, but in practice there are still gaps in which the owner of the rights to the guaranteed object is not properly protected. This thesis will discuss the problems caused by objects that are used as fiduciary guarantees in a credit agreement without the knowledge of the owner of the object (by committing fraud) as well as legal protection that can be given to the owner of the object. This thesis research was conducted using juridical-normative research methods, with an approach using legislation and case studies. The results of this study conclude that fiduciary security is not born if it is carried out with objects obtained from fraud as stipulated in Article 35 of the Fiduciary Guarantee Law, which ultimately has the potential to sue between the owner of the object and the recipient of the fiduciary guarantee in court. "
