Abstrak :
Pendaftaran tanah di Indonesia bertujuan untuk menjamin kepastian hukum dengan memberikan sertipikat sebagai tanda bukti haknya. Namun dalam penerbitannya seringkali membawa akibat hukum bagi para pihak. Salah satu contohnya terdapat penerbitan sertipikat oleh Kantor Pertanahan yang secara yuridis kawasan tersebut adalah kawasan hutan dan belum mendapat keputusan pelepasan kawasan hutan dari Menteri Kehutanan. Akibatnya, terjadi tumpang tindih antara areal Izin Usaha Pemanfaatan Hasil Hutan Tanaman dengan Izin Usaha Perkebunan. Metode yang digunakan dalam penelitian ini adalah penelitian yuridis normatif dengan menggunakan data sekunder. Penelitian ini menyimpulkan bahwa kurang menunjangnya data fisik dimana belum terdapatnya sistem update peta secara otomatis atas segala tindakan hukum yang dilakukan pemerintah sehingga menyebabkan kekeliruan dalam mengambil suatu kebijakan. ......Land registration in Indonesia aims to ensure legal by giving a certificate. However in issuing the certificates often carry legal consequences for the parties. One example is the presence of dispute of the issuance of the certificate by the Land Office, which legally the region is forest area and has not, received a decision the forest area release from the Minister of Forestry. Due to this, there is an overlap between the areas of Business License Utilization of Forest Plants with Plantation Business and the rights over the land. The method used in this research is normative juridical research using secondary data. This study concluded that the lack of support that the physical data which has not been the presence of the map automatically updates the system for any legal action taken by the government, causing an error in taking a policy.
