"ABSTRAKTesis ini membahas hasil penelitian tentang analisis pendekatan kearifan lokal dalampenanganan perkara pidana di wilayah hukum Kepolisian Sektor Andir Bandung.Penelitian ini dilakukan dengan metode deskriptif-kualitatif yang bersumber dari dataprimer dan sekunder dengan metode pengumpulan data yang dilakukan dengan carawawancara mendalam, wawancara pakar, observasi dan telaahan dokumen. Hasilpenelitian menunjukkan bahwa Pendekatan kearifan lokal masyarakat adat Bandungditerapkan dalam penanganan tindak pidana oleh Unit Reskrim Polsek Andir melaluimusyawarah mufakat yang menjunjung tinggi nilai karuhun berdasarkan falsafahsilih asih, silih asah dan silih asuh. Penyidik Polsek Andir dalam menangani perkarapidana memfasilitasi musyawarah mufakat antara pelaku dan korban sertakeluarganya dalam rangka mencapai perdamaian. Apabila kedua belah pihak telahberdamai dan korban mencabut atau menarik laporan polisi yang dibuatnya, makapenyidikan dihentikan dan perkaranya dinyatakan selesai. Selain itu hasil penelitianjuga menunjukkan bahwa Dalam tahap penyidikan pra adjudikasi maka kearifanlokal yang sejalan dengan KUHAP dan UU Kepolisian adalah kearifan lokal yangdapat memberikan manfaat optimal dari suatu penyelesaian perkara pidana yaitu rasakeadilan dan kepastian hukum bagi para pihak sebagaimana digagas oleh pendekatankeadilan restoratif. Kearifan lokal pada dasarnya merupakan bentuk peraturan yangkeberadaan dan keberlakuannya diakui oleh masyarakat setempat. Akan tetapipenggunaan pendekatan kearifan lokal di lingkungan Polri belum menjadi kebiasaanmengingat masih belum tegasnya pengaturan ini di dalam hukum acara pidananasional. Pasal 18 UU Kepolisian merupakan landasan yang sah bagi penyidik untukmenghentikan penyidikan yang sedang dilakukannya atas suatu perkara pidana yangterjadi di wilayah hukum setempat. Tindakan ini dilakukan dengan pertimbanganbahwa perselisihan antara pelaku dan korban telah selesai. Pelaku mengakuikesalahannya dan korban menerima permintaan maaf yang diajukan oleh pelakusehingga hubungan antara para pihak kembali pulih yang pada akhirnya akanmendorong terciptanya situasi yang kondusif di wilayah setempat

ABSTRACTThis thesis discusses the results of research on the analysis of local wisdom approachin handling criminal cases in the jurisdiction of Police Sector Andir Bandung. Thisresearch is conducted by descriptive qualitative method that comes from primary andsecondary data with data collection method which is done by in depth interview,expert interview, observation and document review. Result of research indicate thatApproach of indigenous wisdom of indigenous people of Bandung applied inhandling of crime by Unit Crimes Andir Police Subdivision through consensusmufakat that uphold value of karuhun based on philosophy of silih asih, silih asahand silih asuh. Andir police investigators in handling criminal cases facilitatedeliberation between consecutors and victims and their families in order to achievepeace. If both parties have made peace and the victim revokes or withdraws thepolice report he made, then the investigation is suspended and the case is declaredover. In addition, the results of the study also showed that in the investigation stage pre adjudication the local wisdom in line with the Criminal Procedure Code and thePolice Act is the local wisdom that can provide optimal benefits from a criminal casesettlement that is the sense of justice and legal certainty for the parties as initiated bythe approach restorative justice. Local wisdom is basically a form of regulationwhose existence and validity are recognized by the local community. However, theuse of local wisdom approach within the Indonesian National Police has not becomea habit since the regulation is still unclear in the national criminal procedure law.Article 18 of the Police Law is the legal basis for investigators to stop theirinvestigations into a criminal case that occurs in the local jurisdiction. This action isdone with the consideration that the dispute between the perpetrator and the victimhas been completed. The perpetrator acknowledges his guilt and the victim acceptsthe apology filed by the perpetrator so that the relationship between the parties willrecover which will ultimately lead to the creation of a conducive situation in the localarea."

"A Vision of Europe analyses a little-known collaborative effort by France and Germany to secure a durable peace between the World Wars, through European integration organized around a Franco-German axis. Received wisdom has it that the era of Franco-German rapprochement depended from 1925 on a close personal relationship between the French and German Foreign Ministers, Briand and Stresemann. With Stresemanns death in 1929, and the simultaneous onset of the interwar Great Depression, Germany in particular allegedly turned its back on this process of rapprochement several years before Hitler took power. However, A Vision of Europe challenges this view of Franco-German relations during the Depression years. Upsets and setbacks notwithstanding, a sustained mutual effort drew on political will, diplomatic rationale, economic synergies, cultural affinities, and various peace movements to agree a Franco-German customs union which had European union as its ultimate goal. These efforts were formalized in the Franco-German Berlin Accord of September 1931, with the diplomacy surrounding this event forming the heart of this book. By mid-1932, however, rapprochement had all but failed. An unforeseen crisis in trading relations, the impact on French opinion of a media scandal surrounding the publication of the late Stresemanns memoirs, and the disruptive impact of domestic party politics in both countries derailed a process that had been conceived by France and Germanys diplomatic, political and economic elites. Nonetheless, this first modern attempt at European unification reflected a deeper process and logic that survived Hitler and informed the creation of the contemporary European Union."
