Abstrak :
Penelitian ini bertujuan untuk melihat kinerja strategi portofolio yang berdasarkan cash from operating dengan operating profit, di mana dalam penelitian terdahulu Foester et al (2017) diketahui bahwa cash from operating memiliki kekuatan yang lebih baik dalam memprediksi imbal hasil dari saham di masa yang akan mendatang dibandingkan operating profit. Selain itu, penelitian ini ingin melihat bagaimana perbandingan strategi portofolio berdasarkan cash from operating dengan operating profit. Penelitian ini menggunakan serangkaian langkah untuk membentuk dan menguji portofolio seperti filteriasi untuk membentuk portofolio hingga mengujinya menggunakan Fama French Three Factor Model. Adapun ukuran sampelnya 219 perusahaan yang tercatat di Bursa Efek Indonesia (BEI) selama periode 2014-2018. Diperoleh bahwa strategi portofolio cash from operating dan operating profit tidak layak digunakan di BEI. ......This study discusses the performance of portfolio based on Cash From Operating and Operating Profit of listed companies in Indonesia Stock Exchange (IDX). According to Foester et al (2017) Cash From Operating is better predictors than operating profit to predict stock returns. Therefore, this study try to compare the strategic portfolio based on cash from operating and operating profit. This study is quantitative research study with multiple regression method for data panel with 219 listed companies during the period 2014-2018 for the sample. The result of this study provides evidence that the portfolio strategy based on cash from operating and operating profit show volatility in portfolio performance. Furthermore, the strategy portfolio in the lowest value could outperform the largest value of cash from operating and operating profit.

Dalam pengusahaan migas, PERTAMINA sebagai Badan Usaha Milik Negara mungkinkan untuk bekerja sama dengan perusahaan minyak lain/kam bentuk Joint Operating Body (JOB) yang merupakan motif konsep kontrak bagi hasi/Production Sharing Contract (PSC) yang dianut di Indonesia. Dalam JOB, PERTAMINA dan kontraktor masing-masing mempunyai share sama besar yakni 50:50 dan bersama-sama membentuk komite yang terdiri dari wakil-wakil PERTAMINA dan kontraktor (komite operasi) untuk menetapkan dasar-dasar alokasi hak dan tanggung jawab antara para pihak seria mengatur tentang tata cara pelaksanaan operasi dan melakukan pengawasan. Untuk memperlancar opcrasional JOB, pendiri JOB telah me kewenangan penuh kepada JOB untuk melakukan tindakan hokum seperti membuat perjanjian dengan pihak lain, memiliki kekayaan, mempekerjakan karyawan dan lainnya sehingga menempatkan JOB scolah-olah seperti sebuah subyek hukum. Namun dalam literatur hukum, JOB tidak dikenal sebagai subyck bukum/badan hukum dan olch karenanya tidak dapat bertindak di muka pengadilan, sebagaimana ditegaskan dalam Putusan Mahkamah Agung RI No 07/PK/N/1999 tanggal 14 Mei 1999, yang diuraikan lebih lanjut dalam Tesis ini karenanya, walaupun kewenangan penuh telah diberikan kepada Jo dirinya, namun untuk bertindak di hadapan hukum tetap harus sendiri oleh pendir-pendiri JOB dan tidak diwakilkan oleh JOB. Melalui penulisan Tesis ini, Penulis berharap dapat memberikan kejelasan kepada masyarakat terutama pihak-pihak yang terkait dalam JOB mengenai status hokum JOB agar tidak merugikan pihak-pihak tersebut di kemudian hari. Diharapkan pembahasan tersebut di atas akan membawa efisiensi serta peningkatan kinerja operasional JOB dalam mencapai target yang maksimal......In oil and gas mining, it is possible for PERTAMINA as a State-Owned Company to enter into cooperation with other oil company/contractor in terms of Joint Operating Body (JOB) constituting modification of the Production Sharing Contract (PSC) concept adopted in Indonesia. In JOB, PERTAMINA and the contractor respectively has equal share namely 50:50 and jointly establishes committee consisting of the representatives of PERTAMINA and contractor committee) to lay down the basis of allocation ofrights and ob party as well as stipulate the procedure of operation implement supervision. For smooth operation of JOB, JOB founder has confer upon the JOB to take corporate acts such as entering into agree other party, controlling assets, employing experts etc thereby placing JOB as is it were a law subject However law literature does not mention that JOB is a law subject/legal entity and consequently it has no authority to take any act before a court, as confirmed in the Judgment of the Supreme Court of the Republic of Indonesia No. 07/PK/N/1999 dated May 14, 1999, described further in this Thesis. Therefore, despite the full authority the founders conferred upon it, it is the JOB founders themselves, not represented to JOB, that must take any corporate act. May this Thesis writing able to provide clarity to the community pecially those interested in JOB about the legal status of JOB and not ret loss to them in the future. Such discussion may bring about an efficiency as well increase the performance of JOB operation in attaining the maximum.
