"Dalam kegiatan usaha hulu minyak dan gas bumi, hal yang perlu menjadi perhatian adalah mengenai jangka waktu pengelolaan wilayah kerja yang diatur dalam Kontrak Kerja Sama atau Production Sharing Contract (PSC). Pengaturan mengenai jangka waktu atas pengelolaan wilayah kerja minyak dan gas bumi, akan memberikan kepastian bagi pemerintah dan kontraktor. Pengaturan tersebut telah dituangkan dalam UU No. 22 Tahun 2001 tentang Minyak dan Gas Bumi dan Peraturan Menteri ESDM yang telah diubah beberapa kali untuk memenuhi perkembangan dan dinamika dalam kegiatan usaha hulu minyak dan gas bumi di Indonesia. Namun, perubahan tersebut dianggap menimbulkan suatu permasalahan sehingga diajukan uji materiil ke Mahkamah Agung dikarenakan adanya perubahan pada Pasal 2 yang memberikan kesan adanya akses prioritas bagi kontraktor eksisting untuk melanjutkan pengelolaan wilayah kerja. UU No. 11 Tahun 2020 tentang Cipta Kerja juga mengatur mengenai pengelolaan wilayah kerja yang berdasarkan PSC, menyatakan bahwa nomenklatur izin minyak dan gas bumi adalah PSC. Berdasarkan hal tersebut, maka penelitian ini akan menganalisis mengenai perbedaan mekanisme dalam pengelolaan wilayah kerja yang akan berakhir PSCnya berdasarkan perubahan pada Peraturan Menteri ESDM, dampak dari Putusan Mahkamah Agung No. 69P/HUM/2018, serta perubahan pada pengelolaan wilayah kerja minyak dan gas bumi setelah berlakunya UU No. 11 Tahun 2020 tentang Cipta Kerja.

In the upstream oil and gas business activities, the time period for the management of the work area as stipulated in the Production Sharing Contract (PSC) is an important matter. The regulation related to the time period for the management of oil and gas working areas will provide certainty for the government and the contractors, as has been stated in Law no. 22 of 2001 concerning Oil and Gas and Regulation of the MEMR which has been amended several times to comply with the developments and the dynamics of the changes in upstream oil and gas business activities in Indonesia. However, the change was deemed to have caused a problem so that a judicial review was submitted to the Supreme Court due to the amendment to Article 2 which gives the impression that there is a priority access for the existing contractor to continue the management of the oil and gas working area. In addition, the management of working areas based on PSC is regulated in Law no. 11 of 2020 concerning Job Creation which states that the nomenclature of oil and gas permits is PSC. This study will analyze the different mechanisms in the management of oil and gas working areas that the PSC will be terminated based on the MEMR regulation that has been changed several times, the impact of the Supreme Court Decision no. 69P/HUM/2018, as well as changes to the management of oil and gas working areas after the enactment of Law no. 11 of 2020 concerning Job Creation. "
