Indonesia telah memberikan komitmen terbuka di sektor perbankan. Di kawasan ASEAN keterbukan sektor perbankan Indonesia menduduki nomor 2 tertinggi setelah Singapura. Terhadap kondisi yang telah terbuka tersebut, kecil kemungkinan untuk menarik komitmen perbankan Indonesia yang telah terdaftar dalam SoC liberalisasi sektor jasa keuangan di WTO. GATS memberikan ruang kepada negara anggota untuk menerapkan prudential measures. Annex on Financial Services merupakan aturan khusus yang mengatur mengenai liberalisasi sektor jasa keuangan yang tidak terpisahkan dari General Agreement on Trade in Services (GATS), dimana di dalamnya terdapat aturan yang mengijinkan negara untuk mengambil tindakan dengan alasan prudential termasuk untuk melindungi investor, depositor, pemegang saham atau orang yang menyerahkan fiduciary duty kepada pemasok jasa keuangan atau untuk menjamin integritas dan stabilitas dari sistem keuangan. Prudential measures mutlak diperlukan mengingat proses liberalisasi yang tidak disertai dengan sistem keuangan domestik yang kuat dapat menimbulkan efek negatif terhadap stabilitas sistem keuangan dan perekonomian Indonesia. Keterbukaan perbankan tersebut perlu direspon otoritas dengan bijak, melalui upaya persiapan dan peningkatan industri perbankan Indonesia menjadi industri perbankan yang sehat dan kuat sehingga memiliki daya saing dan ketahanan terhadap faktor pemicu resiko instabilitas. Tujuan dari penulisan tesis ini adalah untuk memahami penerapan GATS dalam liberalisasi jasa perbankan Indonesia dan penerapan prudential measures sebagai jaring pengaman stabilitas sistem keuangan dalam kaitan dengan kebijakan liberalisasi sektor jasa perbankan di Indonesia.

ABSTRACT
In term of financial services liberalization, Indonesian commitment on banking sector liberalization open largely. In the ASEAN, the openness of Indonesia's banking sector is the 2nd after Singapore. GATS provides space for member to implement prudential measures. Annex on Financial Services is a specific rules on the financial services liberalization and being an integral part of the General Agreement on Trade in Services (GATS), which included a rule allowing the state to take action on prudential reasons, including to protect investors, depositors, share holders or the person submitting the fiduciary duty to financial service suppliers or to ensure the integrity and stability of the financial system. Prudential measures are absolutely necessary, since the liberalization process that is not accompanied by a strong domestic financial system can have a negative impact on the financial stability system and the economy of Indonesia. The oppeness of banking sector need to be respond by authority wisely, preparing the sound and strong banking industry is a must. The sound and strong banking industry could increase banking competitiveness and resilience to risk factors triggering instability. The purpose of this thesis is to understand the GATS and its application on banking services liberalization in Indonesia as well as the application of prudential measures as a part of financial system safety net in terms of Indonesian policy in the banking services liberalization.

Skripsi ini membahas mengenai penerapan tindakan pengamanan perdagangan terhadap Impor Ubin Keramik yang dilakukan oleh Komite Pengamanan Perdagangan Indonesia sebagai salah satu bentuk perlindungan atas kerugian serius atau ancaman kerugian serius yang dialami akibat adanya lonjakan impor produk ubin keramik. Metodologi penelitian yang digunakan dalam penulisan skripsi ini adalah perskriptif, yaitu mempelajari tujuan hukum, nilai-nilai keadilan, validitas aturan hukum, konsep-konsep hukum dan norma-norma hukum lain. Pokok permasalahan dalam skripsi ini adalah bagaimanakah kepatuhan Komite Pengamanan Perdagangan Indonesia melakukan penyelidikan terhadap lonjakan impor ubin keramik terhadap GATT 1947, WTO Agreement on Safeguards, dan PP No. 34 tahun 2011 tentang Tindakan Antidumping, Tindakan Imbalan dan TIndakan Pengamanan Perdagangan serta preseden-preseden yang telah dikeluarkan oleh WTO-DSB. Berdasarkan hasil penelitian penulis, penerapan tindakan pengaman pedagangan terhadap Impor ubin keramik belum memenuhi semua batasan yang telah diberikan oleh GATT 1947, WTO Agreement on Safeguards dan juga putusan yang telah dikeluarkan oleh WTO-DSB dan memerlukan pembaharuan dalam metode penyelidikan serta pemberian pengamanan perdagangan.

ABSTRACT
This thesis is discussing regarding the application of safeguards measures on the import of ceramic tiles which was conducted by the Indonesian Committee of Safeguards Measure as a protection to minimize of serious injury or threat of serious injury which was caused by the surge of import on ceramic tiles product. The method that is used in this research is prescriptive, which are to study about the purposes of the law, the value of justice, the validity of the law, the concept and the other principlas of law. Main issue in this thesis is to understand the compliance of application of safeguard measure that has been done by the Indonesian Committee of Safeguards Measure on conducting the investigation the surge of imports of ceramic tiles to the GATT 1946, WTO Agreement Safeguards, and Government Regulation No. 34/2011 regarding Antidumping Measure, Cumpolsory Measure, and Trade Safeguard Measure as well as the precedent of WTO-DSB. Based on the writers research, the application of the safeguard measures on import of the ceramic tiles did not comply to all the factors that has been made by GATT 1947, WTO Agreement on Safeguards and WTO-DSB decisions. It needs modifications concerning the methods of investigation and the application of the safeguards measures.
