ABSTRACT
Peran kelurahan sebagai ujung tombak pemerintahan terendah untuk menjalankan segala bentuk kebijakan sekaligus menampung kebutuhan masyarakat. Dengan demikian dibutuhkannya sosok pemimpin yang tepat untuk memimpin organisasi kelurahan. Untuk itu penelitian ini bertujuan untuk menganalisis peran kepemimpinan lurah berdasarkan sepuluh indikator peran kepemimpinan Henry Mintzberg. Indikator tersebut yaitu monitor, disseminator, spokesman, entrepreneur, disturbance handler, resource allocator, negotiator, liaison, leader dan figurehead. Penelitian ini menggunakan pendekatan positivist dan termasuk dalam penelitian deskriptif. Manfaat penelitian ini murni, segi waktunya cross sectional dan pengambilan datanya melalui wawancara mendalam dengan narasumber terkait, observasi langsung serta studi pustaka. Melalui analisis yang dilakukan maka dapat disimpulkan bahwa Lurah Dodo Supendi dalam menjalankan perannya di Lingkungan Bambu Apus secara umum sudah menerapkan sepuluh indikator peran kepemimpinan Mintzberg. Hasil analisis menjelaskan masih ditemukan peran kepemimpinan yang buruk. Berdasarkan indikator spokesman yang berkaitan tentang koordinasi yang buruk dengan perangkat warga. Indikator disturbance handler berkaitan aturan yang dilanggar. Indikator resource allocator dan negotiator berkaitan peran lurah yang tidak merata untuk wilayah yang dipimpinnya, khususnya dalam Musrenbang. Serta indikator liaison dan leader berkaitan penyalahgunaan kewenangan yang dilakukan pemimpinnya. Semua indikator memiliki kekurangan berdasarkan analisis dari peran lurah ini, namun peneliti memberi saran khususnya dalam indikator leader karena menyangkut intergritas aparatur daerah secara umum.
ABSTRACT
The role of the village as the spearhead of the lowest government is to carry out all forms of policy while accommodating the needs of the community. Thus the right leader is needed to lead the village organization. For this reason the aim of this study was to analyze the leadership role of the lurah based on ten indicators of Henry Mintzberg's leadership role. The indicators are monitor, disseminator, spokesman, entrepreneur, disturbance handler, resource allocator, negotiator, liaison, leader and figurehead. This study uses a positivist approach and is included in descriptive research. The benefits of this study are purely, in terms of time, cross sectional and data collection through in-depth interviews with related sources, direct observation and literature. Through the analysis carried out, it can be concluded that the Head of Dodo Supendi in carrying out his role in the Bambu Apus Environment in general has applied ten indicators of Mintzberg's leadership role. The results of the analysis explain that bad leadership roles are still found. Based on the spokesman's indicators relating to poor coordination with citizen devices. Indicators of disturbance handlers relate to rules that are violated. Indicators of resource allocators and negotiators relate to the unequal role of village heads for the regions they lead, especially in Musrenbang. As well as liaison and leader indicators related to abuse of authority carried out by their leaders. All indicators have shortcomings based on the analysis of the role of this lurah, but the researcher gives advice especially in leader indicators because it involves the integrity of regional apparatus in general.

ABSTRAK
Tujuan dari penelitian ini adalah untuk mengetahui dan mengevaluasi efektivitas dalam pelaksanaan lelang jabatan camat dan lurah di DKI Jakarta. Pendekatan ilmiah yang digunakan dalam penelitian adalah pendekatan kualitatif. Hasil dari penelitian ini menunjukkan secara umum pelaksanaam lelang jabatan camat dan lurah DKI Jakarta dapat dikatakan efektif dibanding promosi jabatan terdahulu karena terlihat ada peningkatan kinerja camat dan lurah di sebagian besar wilayah DKI Jakarta kecuali Jakarta Pusat. Namun yang perlu diperhatikan adalah biaya yang digunakan dalam lelang jabatan sangat besar dibanding pelaksanaan promosi camat dan lurah sebelumnya. Untuk itu, biaya-biaya yang kurang berkaitan dengan efektivitas lelang jabatan dapat dikurangi.
ABSTRACT
The purpose of this study is to determining and evaluating the effectiveness of Open Selection for District Head and Village Head Position in DKI Jakarta. The scientific approach method used in the study is qualitative approach. The result of this study indicate that the general implementation of Open Selection for District Heads and Village Head’s Position in DKI Jakarta can be said to be effective than previous promotion since the performance of the District Heads and Village Head in most regions are increased. However, the main concern is the cost estimation. The cost for open selection is quite high compared to previous promotion. Hence, the costs that are less related to the effectiveness of the open selection recommended to be reduced.

Abstrak :
This study explains Bantamesse village leadership which is traditionally consist of lurah (village chief), kyai (Islamic clergy) dan jawara ('strong man'). It questions raison d'etre becoming a leader; prerequisites and processes, how they exercise of power and maintain their positions. In search for answer to the above questions, a field research was carried out in Senangsari village, regency of Pandeglang, Banters Province, Indonesia. This research uses qualitative method, analyzing local leader history approach and reputation information. Information on leader' life history and reputation was collected trough participant observation and in depth interview. Library research was also conducted as complementary technique. This thesis argues that for someone to become a lurah, as formal leader needs enough wealth, brave, and magical power to win the ballot vote. For someone to be a kyai, a religious leader, he needs long process in pesantren (Islamic boarding school) and shows good moral conduct before he sets up his own school as a basis of his authority. While for someone to be a jawara, an informal leader, he needs skill in martial art and kanuragan (manipulation of magic power) before he starts career in a doggy dog world. As traditional leaders, they function as cultural brokers connecting between villagers' and outside village interest. Lurah leadership gives official administration services. Kyai leadership provides religious services through education and spiritual healing. While jawara leadership gives services which cannot be provided by others. The above services are reflections of the nature of powers these three type of traditional leaders. Lurah excercises his power over his villagers. Kyai utilizes persuasive power to his santri (religious student) and community members who once were his clients. If necessary jawara could utilize coercion power to achieve his goals, not only over his followers but also for his opponents. In the auspice of regional government autonomy (otonomi daerah), jawara toot over formal leadership position by becoming lurch. While kyai's political position has long been imputated. The old saying "jawara obeys kyai" has been changed to become "lurah obeys jawara". Further implication is denying villagers as a stake holders of community development process. This situation has also been reflected in changing of elite powers in Bantamesse village.

Analisis yang dilakukan dalam penulisan ini adalah mengenai sengketa kepemilikan atas bidang tanah yang belum bersertipikat dan pemilik tanahnya tidak memiliki bukti kepemilikan atas tanah tersebut. Persoalan muncul manakala ada pihak lain yang mengaku berhak atas tanah tersebut dan datang ke Lurah untuk minta dibuatkan Surat Keterangan Tanah untuk melakukan pengalihan bidang tanah itu. Surat Keterangan Tanah yang dibuat Lurah hanya berdasarkan keterangan yang disampaikan secara lisan saja dan tidak dilakukan pemeriksaan atau pencocokan dengan fakta-fakta yang terjadi di lapangan. Kemudian Surat Keterangan Tanah itu dijadikan dasar pembuatan Akta Jual Beli Tanah oleh Camat yang dalam kasus ini sebagai Pejabat Pembuat Akta Sementara,tanpa sepengetahuan pemiliknya. Akibatnya pihak yang mengaku sebagai pemilik sah atas bidang tanah tersebut merasa dirugikan karena tanahnya dialihkan oleh pihak lain tanpa seizinnya. Yang menjadi pokok permasalahan adalah mengenai perlindungan hukum bagi pemilik tanah dengan adanya pihak lain yang melakukan transaksi jual beli terhadap bidang tanahnya. Serta bagaimana peran pengadilan menilai Surat Keterangan Tanah dan Akta Jual Beli yang dibuat berdasarkan keterangan yang tidak benar. Untuk menjawab permasalahan hukum dalam kasus yang dimaksud maka dilakukan penelitian kepustakaan yang bersifat deskriptif analitis untuk menggambarkan teori-teori hukum dalam praktek pelaksanaannya berkenaan dengan permasalahan yang ada. Dari penelitian tersebut dapat diketahui bahwa ada perlindungan hukum terhadap pihak yang mengaku sebagai pemilik sah walau dirinya tidak memiliki sertipikat tanah namun secara nyata telah menguasai secara fisik dan tidak menelantarkan tanah miliknya. Kemudian Surat Keterangan Tanah yang isinya tidak benar dibatalkan oleh pengadilan, demikian pula Akta Jual Beli yang dibuat Camat karena kesalahannya, pengadilan menyatakan batal dan menghapuskan Akta Jual Beli tersebut.
The research aims to analyze a dispute of the noncertified land ownership of which the land owner has no adequate evidence to prove his/her ownership. The main issue to be addressed on this research is when the other party who claims the land title as his/hers and requests to the- Lurah (Village Head) to issue the letter clarification of land ownership for purpose transferring the land title without any consent from the legally land owner. The letter clarification of land ownership which issued by Village Head merely based on verbal statement without any further facts verification. Furthermore, the letter clarification of land ownership is submitted to the Camat (Sub District-Head) and the same became the basic of Sales-Purchase Deed before The Sub-DistrictHead (in this case as the temporary Land Deed Official) . Thus, leads to consequences of suffering losses for the legally land owner. The main issues to be scrutinized are the legal protection of the legally land owner wfien the other party claims that the land title as his/hers anci sold the land, also the role of the court to evaluate the certificate of land and Sales Purchase Deed which executed based qp false information. In order to answer the issues, the writer applies descriptiveanalytical literature to explain the ^egal theories that relevant to the issues in practical. The research found that there is indeed legal protection for th^ legally land owner who doesn't have the certificate of land ownership but physically she/he has been occupying the land. In addition, the research also shows that the certificate of land which is based on false information may be cancelled by the court, and also The Sales Purchase Deed which is exececuted by the Sub- District Head due to his faults.
