Abstrak :
In the increasingly sophisticated digital era today, it is necessary to have a legal protection for a work of creation namely copyright. But as the development of the world, it actually raises a new issue in the modern society because the term of a copyrighted creation is too long, so it leaves the impression that those rules are to curb the creativity of the community to create a new creation. With the issue, a legal expert from Harvard University, Lawrence Lessig initiated a movement called ldquo Free Culture rdquo , in which users can use some or all of the rights of the creators, not to rule out all the provisions of the Copyright Law. This thesis aims to find out whether the existence of the movement eliminates any legal protection provided by the Copyright Law and whether Indonesia has adopted the principles of Free Culture Movement. ...... Di era digital yang makin canggih saat ini, tentu diperlukan adanya suatu perlindungan hukum dalam suatu karya ciptaan yaitu hak cipta. Namun seiring berkembangnya dunia, hal itu justru menimbulkan isu baru dimasyarakat modern karena masa berlaku suatu ciptaan yang dilindungi di rasa terlalu lama sehingga terkesan mengekang kreativitas masyarakat untuk menciptakan suatu karya baru. Dengan adanya isu tersebut, seorang ahli hukum Universitas Harvard yaitu Lawrence Lessig menggerakan suatu gerakan bernama ldquo;Free Culture rdquo;, dimana pengguna dapat menggunakan sebagian atau seluruh hak dari pencipta, dengan tidak mengesampingkan seluruh peraturan dalam UU Hak Cipta. Skripsi ini bertujuan untuk mengetahui apakah dengan adanya gerakan tersebut menghapuskan segala perlindungan hukum yang diberikan oleh UU Hak Cipta serta apakah Indonesia telah mengadopsi prinsip dari Free Culture Movement.
