Abstrak :
Undang-Undang Nomor 5 Tahun 1960 Tentang Peraturan Dasar Pokok-Pokok Agraria telah mencabut Buku II KUHPerdata. Pencabutan tersebut menimbulkan penafsiran bahwa Hukum Tanah Nasional tidak mengenal lembaga daluarsa sebagai upaya memperoleh hak milik atas tanah. Adanya Putusan Mahkamah Agung Nomor: 2773.K/Sip/Pdt/2012, yang menetapkan sesorang memperoleh hak milik atas tanah karena daluarsa. Putusan MA tersebut mendorong penulis meneliti bagaimana peran dan konsekuensi cara memperoleh hak atas tanah yang didasarkan lampaunya waktu menurut Hukum Tanah Nasional dan pengaruh Putusan MA tersebut terhadap Hukum Tanah Nasional. Penelitian ini merupakan penelitian yuridis normatif dengan alat pengumpulan data berupa studi dokumen untuk mendapatkan data sekunder melalui berbagai sumber hukum. Data yang diperoleh diolah dan dianalisa secara kwalitatif deduktif. Dari hasil penelitian disimpulkan bahwa UUPA tidak mengenal lembaga daluarsa. Lembaga daluarsa terdapat dalam Peraturan Pemerintah No. 24 Tahun 1997 Tentang Pendaftaran Tanah dan dalam Hukum Adat.
