"Tanah yang pada dasarnya merupakan hasil dari warisan menjadi milik bersama dari orang yang memiliki hak menjadi ahli waris. Dalam hal tersebut tanah akan dialihkan melalui jual beli maka semua Ahli Waris wajib mengetahui dan menyetujui jual beli tersebut karena jika salah satu dari Ahli Waris tidak mengetahui dan merasa dirugikan maka jual beli tersebut dapat dibatalkan. Permasalahan pada penelitian ini adalah Bagaimana perlindungan hukum bagi pembeli tanah warisan tanpa adanya persetujuan dari ahli waris lainnya, dan bagaimana kewenangan mewarisi dari ahli waris cucu tersebut seperti halnya terdapat pada Putusan Mahkamah Agung Nomor 870/PK/PDT/2019. Dari penelitian ini diperoleh hasil bahwa setiap perbuatan hukum, dalam hal ini hibah yang dilakukan oleh pewaris maupun jual beli yang telah dilakukan oleh penerima hibah, dianggap batal demi hukum dan dapat dibatalkan karena jual beli tersebut tidak diketahui oleh ahli waris lainnya dan membawa kerugian pada ahli waris lain.

Land which is basically the result of inheritance becomes the common property of people who have the right to become heirs. In this case the land will be transferred through sale and purchase, all heirs must know and agree in terms of the sale and purchase because if one of the heirs does not know and feels disadvantaged, the sale and purchase can be canceled. The problem in this research is how is the legal protection for buyers of inherited land without the approval of other heirs, and how is the authority to inherit from the heirs of these grandchildren as is the case in the Decision of Mahkamah Agung Number 870/PK/PDT/2019. From this study, the results were obtained that any legal actions, in this case grants carried out by the heir or sale and purchase that had been carried out by the recipient of the grant, were considered null and void and could be canceled because the sale and purchase were not known by other heirs and brought losses to other heirs."
