"The Jury Under Fire: Myth, Controversy, and Reform examines a number of controversial beliefs about juries that have persisted in recent years, as well as the implications of these views for jury reform. It reviews empirical research on both criminal and civil juries that uses a variety of research methodologies: simulations, archival analyses, field studies, and juror interviews. Each chapter is titled with a mistaken assumption or myth about jurors or juries. The book critiques these myths and relies on social science research findings to inform empirically grounded reform efforts. It focuses on the experience of serving as a juror; jury selection and jury size; and the impact of evidence from eyewitnesses, experts, confessions, and juvenile offenders. It also covers the process of deciding damages and punishment and the role of emotions in jurors decision making, and it compares jurors and judges decisions. Finally, it reviews a broad range of efforts to reform the jury, including the most promising reforms that have a strong empirical foundation. "Konsep partisipasi masyarakat awam dalam proses persidangan pidana atau yang biasa disebut dengan juri, sudah menjadi elemen integral yang bersejarah pada negara-negara Common Law, namun upaya untuk melakukan sebuah transplantasi sudah mulai dilakukan oleh banyak negara-negara Civil Law, salah satunya adalah Perancis. Penelitian skripsi ini mengulas bagaimana kedekatan tradisi hukum Perancis mempengaruhi hukum masa depan yang mungkin dapat diterapkan di Indonesia. Hal ini didasari dari pengangkatan isu penggunaan hakim dan juri telah diangkat menjadi salah satu latar belakang Naskah Akademik RUU KUHAP, mengharuskan KUHAP Indonesia mengadakan suatu perubahan agar lebih sesuai dengan perkembangan zaman. Penelitian ini pertama berupaya untuk membandingkan bagaimana perkembangan sistem juri di Perancis dibandingkan dengan negara yang menggunakan sistem juri terbanyak, yakni Amerika Serikat. Dilanjutkan dengan mengkaji kemungkinan penerapannya di Indonesia dengan tujuan untuk menghasilkan putusan-putusan yang lebih mencerminkan rasa keadilan masyarakat, menggunakan metode RIA sebagai dasar dalam menentukan apakah suatu kebijakan merupakan langkah yang tepat. Hasil penelitian menunjukkan bahwa penggunaan sistem juri di Perancis dibandingkan dengan Amerika Serikat telah mengalami banyak penyesuaian, hakim di Perancis tetap aktif sampai sekarang dalam persidangan karena tidak sepenuhnya mempercayakan keputusan kepada juri, hal ini menunjukkan bahwa penggunaan sistem juri tidak membawa perubahan yang fundamental dalam praktek. Berdasarkan perbandingan ini juga diketahui bahwa penggunaan sistem juri terlalu sedikit untuk menimbang keefektivitasanya dalam persidangan. Oleh karena itu, perlu untuk mengkaji potensi lain yang dimiliki KUHAP untuk melakukan perubahan yang lebih relevan.
The concept of lay participation in the criminal trial process or commonly referred as jury, has become a historic integral element in Common Law countries, but attempts to transplant have begun to be carried out by many Civil Law countries, one of which is France. This thesis research examines how the closeness of the French legal tradition affects future laws that may be applied in Indonesia. This is based on the issue of the use of judges and jurors were appointed as one of the background facts of the Academic Draft of the Draft Criminal Procedure Code, requiring the Indonesian Criminal Procedure Code to make changes in order to make it more in line with times. This study first attempts to compare how the development of the jury system in France is compared to the country that uses the most jury systems, namely the United States. Followed by examining the possibility of its application in Indonesia with the aim of producing decisions that better reflect the community's sense of justice, using the RIA method as a basis in determining whether a policy is the right step. The results show that the use of the jury system in France compared to the United States has undergone many adjustments, judges in France remain active until now in the trial because they do not fully entrust the decision to the jury, this shows that the use of the jury system does not bring fundamental changes in practice. Based on this comparison, it is also known that the use of the jury system is too little to weigh its effectiveness in the trial. Therefore, it is necessary to examine other potentials of the Criminal Procedure Code to make more relevant changes. "
