ABSTRAK Tesis ini membahas pembatasan hak-hak politik ASN (PNS) dalam Pasal 119 dan Pasal 123 ayat (3) UU No. 5 Tahun 2014 tentang ASN. Sebagai warga negara Indonesia, maka ASN juga mempunyai hak-hak sipil dan poitik yang dilindungi oleh konstitusi. Seorang ASN tidak dapat menjadi pengurus suatu partai politik namun untuk menggunakan hak politiknya dalam pemilu yaitu hak dipilih dan memilih untuk jabatan politik/publik adalah dilindungi konstitusi. Pengisian jabatan politik oleh seorang ASN melalui mekanisme pemilu adalah suatu yang wajar dan terlindungi sepanjang dilakukan dengan itikad baik dan melalui mekanisme yang diatur dalam peraturan perundang-undangan. Seorang ASN mempunyai hak politik dan hak konstitusional jika ingin maju sebagai Presiden dan Wakil Presiden; ketua, wakil ketua, dan anggota Dewan Perwakilan Rakyat; ketua, wakil ketua, dan anggota Dewan Perwakilan Daerah; gubernur dan wakil gubernur; bupati/walikota dan wakil bupati/wakil walikota. Sehingga seharusnya tidak ada perbedaan perlakuan antara profesi seorang ASN dengan profesi lainnya, misalnya Advokat, Notaris, Dokter, dan lain-lain dalam pengisian jabatan-jabatan publik. Namun dengan berlakunya UU No. 5 tahun 2014 Tentang ASN tersebut, telah membatasi hak seorang ASN dalam mempergunakan haknya sebagai warga negara yang ingin berpartisipasi dalam mengisi jabatan-jabatan publik dengan diwajibkannya seorang ASN untuk menyatakan mengundurkan diri secara tertulis sebagai PNS sejak mendaftar sebagai calon. Dengan demikian ketentuan Pasal 119 dan pasal 123 ayat (3) UU No. 5 Tahun 2014, yang membedakan profesi seorang ASN dengan Profesi lainnya bersifat diskriminatif, bertentangan dengan Pasal 28D ayat (1), Pasal 28i ayat (2) UUD 1945. Padahal, dalam kedudukannya sebagai warga negara maka ASN juga mempunyai hak-hak asasi manusia yang dilindungi oleh konstitusi. Ada beberapa hak asasi manusia yang dimiliki oleh ASN sebagai warga negara dan ada pula hak-hak politik yang melekat pada individu ASN tersebut, namun dengan berlakunya Pasal 119 dan Pasal 123 ayat (3) UU No. 5 Tahun 2014 hak-hak tersebut menjadi dibatasi dan melanggar hak asasi maupun hak politik ASN.
ABSTRACT This thesis discusses restrictions on political rights ASN (PNS) of Article 119 and Article 123 paragraph (3) of Act No. 5 In 2014 about ASN. As a citizen of Indonesia, the ASN also have civil rights and political exclusion that is protected by the constitution. An ASN can not take charge of a political party but to use their political rights in the election, namely the right of elected and to vote for political office / public are constitutionally protected. Charging political office by an ASN through the mechanism of elections is a natural and protected all done in good faith and through the mechanisms set out in the legislation. An ASN having political rights and constitutional rights if it is to go forward as President and Vice President; chairman, deputy chairman and members of the House of Representatives; chairman, deputy chairman and members of the Regional Representative Council; governor and vice governor; regent / mayor and deputy regent / deputy mayor. So there should be no difference in treatment between an ASN profession with other professions, for example Advocate, Notary, doctors, and others in filling public positions. However, with the enactment of Law No. 5 2014 On the ASN, has limited rights to use the ASN in their rights as citizens who wish to participate in filling public positions with an ASN mandatory to declare in writing to resign as a civil servant since registering as a candidate. Thus the provisions of Article 119 and Article 123 paragraph (3) of Act No. 5 In 2014, the ASN distinguishes a profession with other professions is discriminatory, contrary to Article 28D paragraph (1), Article 28i paragraph (2) of the 1945 Constitution In fact, in his capacity as a citizen, the ASN also has rights human rights is protected by the constitution. Abstrak :
The scheme of checks and balances in the process of legislation in various countries, experienced a shift after judical review accommodated. Legislation does not only involve exeecutive institutions and the parliament bbut also the judiciary. Judicial review is a channel for the expression of public dissent against the decision taken by the legislators. Through the authority of judical review, the Constitutional Court may overturn legislation. This is not because the Constutional Court is in a superior position but becausae judical review is an instrument of the checks and balances mechanism among institutions in the legislative process. Therefore, the presence of the Constitutional Court with powers of judical review should be understood in order to contribute to the democratization in the legislation process.
