"ABSTRAKTesis ini membahas sertipikat yang diterbitkan dengan dasar akta cacat hukum sehingga berpotensi untuk dimintakan pembatalannya oleh pihak-pihak yang dirugikan. Namun, perlu diperhatikan juga kepentingan pembeli yang beritikad baik, yang harus dilindungi. Penelitian tesis ini bersifat deskriptif analitis. Hasil penelitian menunjukan bahwa akta cacat hukum yang tidak memenuhi syarat sahnya perjanjian karena kesepakatan,tetap berlaku dan mengikat para pihak sepanjang akta yang cacat hukum tersebut tidak dimintakan pembatalannya. Untuk itu, sertipikat hak atas tanah yang terbit dengan dasar akta cacat hukum pun tetap merupakan alat bukti yang kuat bagi pemegangnya.

ABSTRACTThis study analyzes the certificate of land title which was issued based on the invalid deed so that it is potentially to be asked for its annulment by the suffered parties. However, it is also required to be paid attention for the interest of the good faith purchaser, who need to be protected. This research is analytic descriptive. The research result shows that the invalid deed which do not comply with the requirement for the valid agreement due to consencus, remind valid as long as such invalid deed is not asked for its annulment. So, the certificate of land title which was issued based on the invalid deed remain constituting a strong evidence for its holder."
