Abstrak :
Tulisan ini menganalisis secara rinci mengenai inkonsistensi dalam aspek hukum sebagai salah satu bentuk risiko dalam PMA pada proyek pembangunan IKN Nusantara beserta konsekuensi yang dapat terjadi terkait dengan hal tersebut. Penelitian ini disusun dengan menggunakan metode penelitian doktrinal. Dari penelitian yang dilakukan, diketahui bahwa terdapat permasalahan terkait dengan pendanaan proyek IKN, khususnya yang bersumber dari investor asing. Hingga saat ini belum terdapat bukti konkrit PMA di proyek IKN Nusantara. Sebelumnya Pemerintah Indonesia sempat mengklaim bahwa terdapat banyak investor asing yang menyatakan minatnya untuk berinvestasi di proyek IKN. Namun, baru-baru ini justru Pemerintah menyatakan pernyataan yang berkontradiksi dengan klaim pemerintah sebelumnya. Bahwa saat ini belum ada PMA di proyek IKN. Terdapat suatu kejanggalan dalam hal tersebut karena pemerintah sendiri telah memberikan banyak insentif bagi para investor asing yang ingin berinvestasi di proyek IKN. Pemerintah juga pada dasarnya telah berupaya memberikan kepastian hukum bagi para investor dengan adanya UU IKN dan PP 12/2023. Berdasarkan hal tersebut, diketahui bahwa terdapat suatu inkonsistensi hukum yang dapat mendasari keputusan investor asing untuk tidak atau belum melakukan PMA di proyek IKN. UU IKN dan PP 12/2023 yang penyusunannya dinilai problematik telah menciptakan suatu ketidakpastian tersendiri bagi para investor. Penulis juga memberikan contoh perbandingan kegagalan negara-negara lain dalam memindahkan ibu kotanya dalam tulisan ini untuk memberikan gambaran konkrit terkait permasalahan dalam proyek IKN. ......This paper analyzes regarding the legal inconsistency as a form of risk in Foreign Investment in the Nusantara National Capital development project and the consequences that could occur related to that matter. This research was completed by using doctrinal research method. From the research, it is known that there are problems related to the funding of the Nusantara National Capital project, especially those originated from foreign investors. To date there has been no concrete evidence of Foreign Investment in the Nusantara National Capital project. Previously, the Government of Indonesia had claimed that there were many foreign investors who expressed their interest in investing in the Nusantara National Capital project. However, recently the government has made a statement that contradicts the previous claim. That there is currently no Foreign Investment in the Nusantara National Capital project. There is an inconsistency in this matter since the government itself has provided many incentives for foreign investors who invest in the Nusantara New Capital City project. The government has also tried to provide legal certainty for investors with the existence of Capital City Law and GR 12/2023. Based on that, it is known that there is a legal uncertainty that underlies the decision of foreign investors who decide not to conduct Foreign Investment in the Nusantara National Capital project. The Capital City Law and GR 12/2023, whose formulation is considered problematic, have created uncertainty for investors. The author also provides comparative examples of other countries' failures in moving their capital cities in this writing to provide a concrete overview of the problems in the Nusantara National Capital project.
