"Penelitian ini merupakan penelitian berbentuk yuridis normatif yang menggunakan data-data sekunder berupa peraturan perundang-undangan dan literatur terkait serta data primer berupa hasil wawancara dengan beberapa narasumber dari kalangan akademisi maupun praktisi yang diolah dengan metode kualitatif. Hasil penelitian menunjukkan bahwa (1) Perbedaan yang ada antara Undang-Undang No. 2 Tahun 1992 tentang Usaha Perasuransian dengan Undang-Undang No. 40 Tahun 2014 tentang Perasuransian, memiliki cukup banyak perbedaan. Mengingat Undang-undang yang sebelumnya sudah berusia cukup tua yaitu, 22 tahun. (2) Pada studi kasus yang dilakukan Perusahaan Pialang Asuransi terlibat sejak awal penentuan calon debitur, hingga penyelesaian klaim. (3) Tanggung Jawab Pialang Asuransi terhadap penyelesaian klaim diatur berdasarkan Undang-undang 40 tahun 2014 tentang Perasuransian, selanjutnya tanggung jawab diatur berdasarkan kesepakatan antara Perusahaan Pialang Asuransi dengan Tertanggung.

This thesis is discussing about how Insurance Broker liability to their Client (Insured), when they are on claim settlement process. This reseach formed in juridicial normative reseach that using secondary data such as national regulation and related literature, also using primary data such as result of interview with related informants, both academics and practicioners, which the data were processed by qualitative method. The result of this research explained that (1) There is a lot differences betwene the old Insurance law with the new one, considering that the old law was publicated onn 22 years ago (2) According to the case study, Insurance broker involved from the beginning process of credit pension debitur selection until the end, which is claim settlement if there any claim (3) insurance broker liability regulated on Undang-undang 40 tahun 2014, unless otherwise stated will be based on the deal between insured and insurance broker."
