Tesis ini membahas petarungan pihak yang saling berlawanan dalam mendapatkan ketetapan hukum dari Mahkamah Konstitusi atas konstitusionalitas norma hukum dalam Pasal 284 dan 292 KUHP. Penelitian ini dilakukan dengan pendekatan kualitatif dengan metode analisis wacana kritis milik van Dijk dan konsep dari Bourdieu mengenai, doxa, heterodoxa dan orthodoxa. Peneliti berusaha mengungkap pengunaan wacana heterodoxa dan wacana orthodoxa atas doxa heteronormativitas dalam arena yudisial Mahkamah Konstitusi. Wacana heterodoxa atas doxa heternormativitas digunakan pihak penentang untuk membongkar kesewenang-wenangan yang terdapat dalam permohonan pemohon. Sementara wacana orthodoxa atas doxa heternormativitas digunakan kelompok pendukung untuk memapankan doxa atas heteronormativitas sebagai satu-satunya bentuk kenormalan seksualitas.

ABSTRACT
This thesis discusses the conflicting battle of parties in obtaining legal provisions of the Constitutional Court on the constitutionality of legal norms in Articles 284 and 292 of the Criminal Code. This research is conducted by qualitative approach with the method of critical discourse analysis of van Dijk and Bourdieu concept about doxa, heterodoxa and orthodoxa. Researchers try to uncover the use of heterodoxa discourse and orthodoxa discourse over doxa heteronatifivitas in the judicial arena of the Constitutional Court. The discourse of heterodoxa upon doxa heternativity is used by the opposing parties to expose the arbitrariness contained in the petition of the petitioner. While orthodoxa discourse over doxa heternatifivitas used support groups to establish doxa over heteronatifivitas as the only normal form of sexuality.

Penelitian ini bertujuan untuk menganalisis keragaman habitus dan implikasinya terhadap efektivitas organisasi. Berdasarkan studi kasus terhadap BKKBN melalui pendekatan kualitatif dengan menggunakan perangkat konseptual arena, modal, dan habitus; penelitian ini berargumen bahwa pertarungan simbolik sebagai hasil dari perbedaan habitus menciptakan infektivitas dalam mencapai tujuan organisasi. Pertarungan ini terjadi dalam bentuk negosiasi dan reinterpretasi terhadap nilai-nilai pembatasan anak dalam keluarga berencana (KB) yang berimplikasi pada capaian pekerjaan. Hasil penelitian ini merekomendasikan agar BKKBN melakukan pembentukan habitus kolektif dan penataan penempatan berdasarkan habitus yang dimiliki anggotanya.

ABSTRACT
This research aims to analyze how habitus diversity implicates the effectivity of organization. Based on case study of BKKBN analyzed qualitatively with the field, capital, and habitus conceptual framework; this research argue that symbolic conflict created by habitus diversity makes the organization ineffective in regard to attain organization purposes. The conflict is happened by the process of negotiation and reinterpretation of birth limitation value in family planning (KB) programme. This research recommends that BKKBN creating a collective habitus making programme and worker placement system based on the habitus that workers are having.
