ABSTRAK
Sejak tanggal 30 Oktober 2017 yang lalu, pemerintah Indonesia melalui Bank Indonesia mengeluarkan kebijakan kewajiban menggunakan uang elektronik e-money sebagai satu-satunya alat pembayaran yang diterima untuk membayar pada gerbang tol diseluruh Indonesia. Kebijakan tersebut berjalan sesuai dengan Gerakan Nasional Non Tunai GNNT yaitu rencana pemerintah untuk menjadi masyarakat Indonesia masyarakat non tunai cashless society . Pemerintah mengatakan bahwa hal ini merupakan hal yang baik karena akan membuat transaksi pembayaran menjadi lebih mudah dan efisien, sedangkan Yayasan Lembaga Konsumen Indonesia YLKI mengatakan bahwa kebijakan ini merugikan konsumen dengan tidak adanya pilihan lain untuk membayar tol. Kerugian lainnya juga dialami apabila terjadi suatu keadaan luar biasa force majeure , sehingga konsumen yang akan melewati jalan tol tidak memiliki kartu uang elektronik. Penggunaan uang elektronik untuk membayar tol pun dianggap tidak mengurangi tingkat kemacetan pada gerbang tol secara signifikan karena itu masalah pada volume kendaraan yang menggunakan jalan tol. Kerugian-kerugian ini diteliti dengan melakukan studi kepustakaan dan secara khususnya melakukan wawancara kepada konsumen serta pihak-pihak lain yang menyelenggarakan kegiatan uang elektronik. Dalam hal terjadinya permasalahan ketika membayar dengan uang elektronik di gerbang tol, sebagai suatu akses pelayanan publik, maka konsumen dapat mengajukan keluhan/pengaduan ke pihak penyelenggara jalan tol dan/atau ke Ombudsman selaku pengawas penyelenggaraan pelayanan publik. Namun apabila melihat secara lebih dalam lagi, ini merupakan suatu jasa penyelenggaraan kegiatan pembayaran menggunakan uang elektronik, sehingga perlindungan konsumen yang tepat diberikan oleh pihak perbankan sesuai dengan Peraturan Bank Indonesia tentang Perlindungan Konsumen Jasa Sistem Pembayaran. Sehingga dengan demikian seharusnya pemerintah tetap membuka setidaknya satu gerbang tol yang menerima pembayaran secara tunai agar konsumen yang tidak memiliki kartu uang elektronik tidak diharuskan untuk membelinya karena belum tentu akan melewati jalan tol seterusnya.
ABSTRACT
Since 30 October 2017, the Indonesian government through Bank Indonesia has issued a policy that states e money as the only means of payment received to pay at toll gateways throughout Indonesia. The policy runs in accordance with the Non Cash National Movement GNNT , which is that to make Indonesia as a cashless society. This policy was issued as it is seen to be of a good thing where consumers can do payment transactions much more easily and in an efficient manner. On the other hand, Indonesian Consumer Institute Foundation YLKI says that this policy harms consumers with no other option to pay tolls. Other losses are also experienced in the event of a force majeure ndash those consumers who will pass through toll roads do not have e money cards to pay. The use of e money to pay tolls is also considered to not have any significant impact on reducing congestion at the toll gate as it is more of the volume of vehicles using toll roads which causes the problem. These losses are examined by conducting literary studies and particularly conducting interviews to consumers as well as parties who take part in hosting e money payment activities. In the event of problems arising when paying with e money at toll booths, as an access to public services, consumers may file a complaint to the toll road operator and or to Ombudsman as an institute which supervises the management of public services. However, if seen more deeply, this is more of a payment services which uses e money as the only means of payment, so that the appropriate consumer protection should be delivered by banks in accordance with Bank Indonesia rsquo s Regulation on Consumer Protection for Payment System Services. Therefore, the government should open at least one toll gate that receives payment in cash so that consumers who do not have e money cards are not required to buy it as those consumers do not regularly pass the toll road.

Gerakan Nasional Non Tunai (GNNT) merupakan gerakan yang mendorong dan meningkatkan penggunaan sarana pembayaran non tunai. Salah satu cara industri perbankan mendukung program GNNT adalah dengan cara menempatkan mesin EDC pada toko atau gerai di mall untuk mempermudah masyarakat dalam melakukan transaksi pembayaran non tunai. Permasalahan yang timbul pada implementasi jaringan komunikasi mesin EDC adalah biaya transaksi yang dirasa cukup tinggi dengan menggunakan teknologi General Packet Radio System (GRPS) yang dipakai oleh operator telekomunikasi. Dengan adanya pilihan teknologi koneksi mesin EDC selain menggunakan GPRS, yaitu dengan teknologi wireline (fiber optic) atau wireless (radio link) membuat biaya transaksi komunikasi mesin EDC dapat diturunkan secara signifikan sehingga biaya transaksinya menjadi lebih rendah daripada menggunakan teknologi yang digunakan saat ini (GPRS). Pemilihan penggunaan teknologi diatas harus disertai dengan kebijakan investasi dan operasi yang berbeda, untuk itu pada tesis ini telah dibuatkan sebuah pemodelannya sehingga memudahkan para pemimpin untuk mengambil keputusan. Pemodelan tersebut terdiri dari lima pilihan skenario yang dapat digunakan dalam kondisi jumlah mesin EDC dan payback periode yang berbeda.
