Abstrak :
Penelitian ini membahas berkaitan dengan regulasi reklamasi dan permasalahannya di Indonesia. Terutama menyoroti pembangunan Pulau G oleh PT. Muara Wisesa Samudera dalam Proyek Pluit City. Pada proses pembangunan reklamasi di Pulau G sebagai tanah yang akan dibangun proyek Pluit City oleh pengembang terdapat beberapa kendala diantaranya moratorium dan hambatan perpanjangan izin perpanjangan pembangunan reklamasi. Penelitian ini akan membahas berkaitan dengan sepanjang mana perjanjian jual beli dalam proyek Pluit City dapat dikategorikan sebagai force majeur dengan adanya hambatan yaitu moratorium pembangunan tanah reklamasi dan perpanjangan izin pembangunan reklamasi. Untuk menjawab permasalahan tersebut digunakan metode penelitian yuridis normatif. Hasil dari penelitian ini adalah bahwa memang terdapat berbagai regulasi yang menjadi payung hukum pembangunan reklamasi di Indonesia, kemudian juga bahwa dalam perjanjian jual beli proyek pluit city antara pengembang dengan konsumen terdapat sebuah peristiwa force majeur dengan adanya moratorium pembangunan lahan reklamasi dan juga adanya hambatan perpanjangan izin reklamasi. ......This thesis discuss related to reclamation regulations and their problems in Indonesia. Especially highlighting the development of Island G by PT. Muara Wisesa Samudera in the Pluit City Project. In the process of building reclamation on Pulau G as the land of to be built by the Pluit City project by the developer, there are several obstacles including the moratorium and obstacles to the extension of the permit for the extension of the reclamation development. This study will discuss the extent to which the sale and purchase agreement in the Pluit City project can be categorized as a force majeur with obstacles, namely the moratorium on land reclamation development and the extension of the reclamation development permit. This thesis use a juridis normative research. The result of this study are there are indeend various regulation for reclamation development in Indonesia then also that in the sale and purchase agreement of the Pluit City project between the developer and the consumer there is a force majeur even with a moratorium on the development of reclamation land and also obstacles in extending the permit of reclamation

Abstrak :
Tulisan ini menganalisis bagaimana terjadinya PHK dengan alasan Covid-19 sebagai force majeur, ketentuan penetapan Covid-19 dengan dalih force majeur sebagai faktor PHK dalam peraturan perundang-undangan dan perlindungan hukum terhadap hak pekerja yang mengalami PHK akibat pandemi covid-19 dengan alasan force majeur. Tulisan ini disusun menggunakan metode penelitian doktrinal dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual. Hasil dari penelitian ini disimpulkan bahwa terjadinya PHK dengan alasan Covid-19 sebagai force majeur dilakukan oleh Ramayana City Plaza terhadap 87 pekerjanya akibat pandemi virus corona. Ketentuan penetapan covid-19 dengan dalih force majeur sebagai faktor PHK dalam peraturan perundang-undangan tidak dijelaskan secara detail mengenai ketentuan maupun kategori suatu keadaan dikatakan sebagai force majeur, namun berdasarkan unsur dan karakteristik force majeur pandemi covid-19 merupakan suatu peristiwa yang dapat digolongkan dan termasuk dalam literasi force majeur yang bersifat temporer. Kondisi force majeur dapat menjadi pertimbangan dilakukannya PHK sebagaimana diatur dalam Pasal 154A ayat (1) huruf D UU No. 6 Tahun 2023. Perlindungan hukum terhadap hak pekerja yang mengalami PHK akibat pandemi covid-19 dengan alasan force majeur diatur dalam Pasal 156 Ayat (1) UU Ketenagakerjaan dan Pasal 45 ayat (1) PP 35 Tahun 2021 yang mewajibkan pengusaha untuk membayar uang pesangon dan/atau uang penghargaan masa kerja dan uang penggantian hak yang seharusnya diterima pekerja. lebih lanjut perlindungan hukum terhadap pekerja kontrak diatur dalam Pasal 62 UU Ketenagakerjaan dan Pasal 17 PP 35 Tahun 2021 bahwa perusahaan wajib membayar ganti kerugian dan uang kompensasi kepada pekerja. ......This paper analyzes how layoffs occur on the grounds of covid-19 as force majeur, provisions for determining covid-19 under the pretext of force majeur as a layoff factor in laws and regulations, and legal protection of the rights of workers who experience layoffs due to the covid-19 pandemic for reasons of force majeur. This paper is prepared using doctrinal research methods using a statutory approach and a conceptual approach. The results of this study concluded that the occurrence of layoffs due to Covid-19 as a force majeur was carried out by Ramayana City Plaza on 87 workers due to the coronavirus pandemic. The provisions for determining covid-19 under the pretext of force majeur as a layoff factor in laws and regulations are not explained in detail about the provisions or categories of a situation said to be force majeur, but based on the elements and characteristics of force majeur, the covid-19 pandemic is an event that can be classified and included in force majeur literacy which is temporary. Force Majeure conditions can be a consideration for layoffs as stipulated in Article 154A paragraph (1) letter D of Law No. 6 of 2023. Legal protection of the rights of workers who experience layoffs due to the covid-19 pandemic for reasons of force majeur is regulated in Article 156 paragraph (1) of the Manpower Law and Article 45 paragraph (1) of PP 35 of 2021 which requires employers to pay severance pay and/or service period appreciation money and compensation money that workers should receive. Furthermore, legal protection for contract workers is regulated in Article 62 of the Manpower Law and Article 17 PP 35 of 2021 that companies are obliged to pay compensation and compensation money to workers.
