"ABSTRAK
Penelitian ini membahas mengenai pelaku usaha fintech yang menawarkan pinjaman dana berbasis teknologi informasi kepada masyarakat. Belum adanya peraturan yang secara rinci mengatur mengenai fintech mengakibatkan kekosongan hukum yang dapat menimbulkan potensi masalah ke depannya. Permasalahan tersebut berkaitan dengan kewajiban dan tanggung jawab hukum pelaku usaha fintech bersangkutan serta kedudukannya ditinjau dari perspektif hukum pembiayaan. Tujuan dari penelitian ini ialah untuk menemukan pengaturan yang ideal bagi pelaku usaha fintech yang menawarkan pinjaman dana berbasis teknologi informasi. Oleh karenanya penelitian ini akan menjawab permasalahan tersebut dengan menggunakan metode penelitian yuridis normatif dimana keseluruhan data yang diperoleh kemudian diolah dengan metode kualitatif. Penelitian ini menemukan bahwa dalam kegiatan usahanya menawarkan pinjaman dana kepada masyarakat, pelaku usaha fintech memiliki tanggung jawab hukum berdasarkan pasal 15 UU ITE untuk dianggap selalu bertanggung jawab dalam penyelenggaraan sistem elektroniknya presumption of liability principle . Selanjutnya ditinjau dari perspektif kaidah hukum pembiayaan yang berlaku, pengaturan kedudukan yang ideal bagi pelaku usaha fintech tersebut adalah Perusahaan Pembiayaan. Penelitian ini menyarankan perbaikan atas aspek-aspek yang diatur dalam Peraturan Otoritas Jasa Keuangan Nomor 77/POJK.01/2016 Tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi POJK No. 77/POJK.01/2016 yakni: i perumusan definisi dan ruang lingkup fintech, ii kedudukan para pihak dalam POJK No. 77/POJK.01/2016 dimana menurut penulis, posisi pelaku usaha fintech harus dipertegas dalam kedudukannya selaku penyelenggara sistem elektronik yang menawarkan pinjaman dana kepada masyarakat, iii bentuk tanggung jawab hukum yang harus diemban, dan iv kepemilikan asing pada industri fintech dihapuskan karena dikhawatirkan akan bersaing dengan Bank Perkreditan Rakyat.

ABSTRACT
This research discusses the fintech businesses that offer technology based loan to society. The absence of detailed regulations concerning fintech result in a legal vacuum that could lead to potential problems in the future. The problems related to the obligation and legal responsibility of fintech entrepreneurs concerned and their status to be reviewed from perspective of financing law. The purpose of this research was to find the ideal setting rule for Fintech Financial Technology Business Offering Technology Based Loan To Society. Therefore, this study will answer these problems by using normative juridical research method in which the overall data obtained are then processed with qualitative methods. This research found that in the normal course of business to offer loans to society, fintech businesses have a legal responsibility under Article 15 of ITE Law to be considered always responsible for the implementation of the electronic systems presumption of liability principle . Furthermore, from the perspective of applicable financing law principles point of view, the proper position for fintech businesses are finance companies. This research suggests improvements on the aspects set out in the Regulation of Financial Services Authority No. 77 POJK.01 2016 on Information Technology Based Loan Services POJK No. 77 POJK.01 2016 , namely i formulation of definitions and fintech scope, ii the position of the parties in POJK No. 77 POJK.01 2016 which according to the author, position of fintech entrepreneurs should be emphasized, in his capacity as the operator of electronic systems that offer technology based loans to society, iii forms of liability that must be carried, and iv foreign ownership on fintech industry to be eliminated fearing they would compete with BPR."

"Perkembangan teknologi di Indonesia memicu hadirnya inovasi fintech lending berupa layanan kredit online yang semakin berkembang. Penelitian ini bertujuan untuk mengetahui faktor – faktor yang mempengaruhi intensi penggunaan layanan kredit secara online melalui fitur Paylater. Sampel yang digunakan dalam penelitian ini merupakan pengguna layanan aplikasi online yang mengetahui fitur Paylater ataupun pengguna yang pernah/sedang menggunakan fitur Paylater. Penyedia layanan fitur perlu mengetahui beberapa faktor yang mempengaruhi intensi penggunaan suatu layanan seperti pengaruh perceived usefulness, subjective norm, perceived trust, perceived risk, dan personal innovativeness terhadap intention to use layanan kredit online melalui fitur Paylater. Penelitian ini menggunakan metode non probability sampling dengan mencakup 240 responden dan pengolahan data melalui pemodelan Partial Least Squares – Structural Equation Modeling (PLS-SEM). Hasil penelitian ini menunjukkan bahwa subjective norm dan personal innovativeness berpengaruh positif secara signifikan dan perceived risk berpengaruh negatif secara signifikan terhadap intention to use. Sedangkan, perceived usefulness dan perceived trust tidak memiliki pengaruh signifikan terhadap intention to use

Technological advancements in Indonesia are currently presenting fintech innovations that provide growing online credit services. This research studies the factors that influence the intention to use credit services online through the Paylater feature. The sample used in this study is an online application service user who knows Paylater features or users who have / are using Paylater features. Service providers need to study several factors that affect the intention to use its services such as perceived usefulness, subjective norm, perceived trust, perceived risk, and personal innovativeness. This research uses a non probability sampling method involving 240 respondents and data processing through modeling of Partial Least Squares - Structural Equation Modeling (PLS-SEM). The results of this research indicate that subjective norms and personal innovation have significantly positive effect and perceived risk have significantly negative effect toward intention to use.

"Penelitian ini bertujuan untuk menganalisis prioritas masalah, solusi dan strategi dalam pengembangan teknologi finansial syariah di Indonesia dengan menggunakan metode Analytical Network Process (ANP). Hal yang melatarbelakangi penelitian ini adalah pesatnya pertumbuhan industri teknologi finansial syariah di Indonesia, namun hingga kini belum ditemukan peta jalan dalam pengembangannya. Penelitian ini melibatkan pemangku kepentingan dari Pemerintah/Regulator, Praktisi dan Akademisi sebagai responden penelitian. Hasil penelitian menunjukkan bahwa prioritas masalah pengembangan teknologi finansial syariah di Indonesia secara berurutan adalah adalah Regulasi, Literasi, Sumber Daya Manusia (SDM) dan Modal. Sedangkan prioritas solusinya secara berurutan adalah Literasi, Sumber Daya Manusia (SDM), Regulasi dan Modal. Adapun prioritas alternatif strategi pengembangan teknologi finansial syariah di Indonesia secara berurutan adalah Meningkatkan Literasi, Memperkuat Dukungan Pemerintah, Meningkatkan Kualitas dan Kuantitas Sumber Daya Manusia (SDM), Memperluas Akses Permodalan dan Menciptakan Ekosistem. Penelitan ini menujukkan bahwa perlu upaya-upaya kolaboratif agar industri teknologi finansial syariah di Indonesia dapat berkembang dan berkelanjutan.

This study aims to analyze the priority problems, solutions and strategies in the development of Islamic financial technology in Indonesia using the Analytical Network Process (ANP) method. The background of this research is the rapid growth of the Islamic financial technology industry in Indonesia, but until now there has not been a roadmap for its development. This research involves stakeholders from the Government/Regulators, Practitioners and Academics as research respondents. The results of the study indicate that the priority problems of developing Islamic financial technology in Indonesia in order are Regulation, Literacy, Human Resources (HR) and Capital. While the priority solutions in order are Literacy, Human Resources (HR), Regulation and Capital. The priority alternative strategies for developing Islamic financial technology in Indonesia in sequence are Improving Literacy, Strengthening Government Support, Improving the Quality and Quantity of Human Resources (HR), Expanding Access to Capital and Creating Ecosystems. This research shows that collaborative efforts are needed so that the Islamic financial technology industry in Indonesia can develop and be sustainable."

"This paper investigates the role of financial technology (FinTech) in propelling economic growth in Indonesia from 1998 to 2018. The FinTech industry employs a technology-based business model to provide financial services, including lending, payment, investment, and financing services. The study is motivated by endogenous growth theory, which seeks to explain technology as the most important driver of economic growth. The study finds that FinTech startups are positively correlated with Indonesia’s economic growth. FinTech firms in their first year are found to be disruptive, but they fail to have serious consequences on Indonesia’s economic growth; however, they seem to significantly encourage economic growth in their second year. These findings are derived after accounting for other important growth determinants, namely, capital per labor, foreign direct investment (FDI), stock market development, and trade openness."

The development of Information Communication and Technology (ICT) has shifted financial services to technological devices known as `Fintech` Companies and technological start-ups act as disintermediation of the traditional bank services by developing an online platform that offers customization financial solutions accordance to the customer needs and wants. By taking
dynamic capabilities and stakeholder-based theory as the fundamental theories, this paper analyses the importance of adapting technological changes for customer preferences adjustment and satisfying the firm`s stakeholders. This study focuses on the four main types of fintech services namely Mobile Payments, Crowdfunding, Peer-to-Peer Lending, and Robo- Advisory.
This research aims to extend the existing theory in fintech literature, Technology Acceptance Model (TAM) proposed by Davis (1986), through integrating the elements of digital marketing as an online promotion strategy. The expectations of this study show that digital marketing can capture customer awareness regarding the sustainability aspect, particularly, the social benefits of fintech to shape their attitude and behavioural intention towards using the financial services. A positive perception and response from customers lead to a continuous lifecycle of payment,

"Penelitian ini mengeksplorasi pengaruh customer experience terhadap loyalitas pengguna aplikasi fintech investasi di Indonesia. Transformasi radikal di sektor keuangan, dipicu oleh perkembangan fintech, telah mengubah cara masyarakat mengakses layanan keuangan dengan menyediakan sistem transaksi yang lebih efisien. Penelitian ini berfokus pada faktor-faktor yang memengaruhi customer experience, termasuk ease of use, perceived value, customer support, perceived risk, speed dan perceived firm innovativeness, serta pengaruhnya terhadap loyalty intention. Data dikumpulkan dari 301 responden pengguna aplikasi fintech investasi di Indonesia dan dianalisis menggunakan teknik Partial Least Squares – Structural Equation Modeling (PLS-SEM). Hasil penelitian menunjukkan bahwa kemudahan penggunaan, nilai yang dirasakan, jaminan keamanan, kecepatan layanan, dan inovasi perusahaan memiliki pengaruh signifikan terhadap customer experience. Customer experience juga terbukti berpengaruh signifikan terhadap niat loyalitas pengguna. Temuan ini memberikan wawasan bagi perusahaan fintech investasi untuk meningkatkan kualitas layanan mereka dan memperkuat ikatan dengan pelanggan.

This research explores the influence of customer experience on user loyalty of investment fintech apps in Indonesia. The radical transformation in the financial sector, triggered by the development of fintech, has changed the way people access financial services by providing a more efficient transaction system. This study focuses on the factors that influence customer experience, including ease of use, perceived value, customer support, perceived risk, speed and perceived firm innovativeness, and their influence on loyalty intention. Data were collected from 301 respondents of investment fintech application users in Indonesia and analyzed using Partial Least Squares - Structural Equation Modeling (PLS-SEM) technique. The results showed that ease of use, perceived value, security assurance, service speed, and company innovation have a significant influence on customer experience. Customer experience is also proven to have a significant effect on user loyalty intentions. The findings provide insights for investment fintech companies to improve their service quality and strengthen bonds with customers."

"ABSTRACT
Financial technology or FinTech refers to technology-enabled financial transaction solutions while financial inclusion refers to wider financial access to as-yet-unreached people. Some agencies such as the World Bank state that Fintech and Financial Inclusion have synergistic roles in developing a better economy. Based on Global Findex data of more than 140 countries, this research shows that FinTech and Financial Inclusion are positively correlated and have a causality effect on each other. I used a cross-section regression model adopted from Wang & Guan (2017) using regional Dummy variables   distinguishing OECD, Developing World, and ASEAN countries with 2014 and 2017 data. The findings suggest that the role of Fintech in increasing financial inclusion is the strongest in OECD countries in the examined period. To develop financial inclusion in the countries, the use of Fintech should be pushed up, especially in developing countries like Indonesia.

Teknologi keuangan atau FinTech mengacu pada solusi transaksi keuangan yang didukung teknologi, sedangkan inklusi keuangan mengacu kepada akses keuangan yang lebih luas untuk orang-orang yang belum terjangkau. Beberapa lembaga seperti Bank Dunia menyatakan bahwa Fintech dan Inklusi Keuangan memiliki peran sinergis dalam mengembangkan ekonomi yang lebih baik. Berdasarkan data Global Findex di lebih dari 140 negara, penelitian ini menunjukkan bahwa FinTech dan Inklusi Keuangan berkorelasi positif dan memiliki efek kausalitas satu sama lain. Saya menggunakan model regresi cross-section yang diadopsi dari Wang & Guan (2017) menggunakan variabel Dummy regional yang membedakan negara-negara OECD, Dunia Berkembang, dan ASEAN dengan data 2014 dan 2017. Temuan menunjukkan bahwa peran Fintech dalam meningkatkan inklusi keuangan adalah yang terkuat di negara-negara OECD pada periode yang diperiksa. Untuk mengembangkan inklusi keuangan di negara-negara, penggunaan Fintech harus didorong, terutama di negara-negara berkembang seperti Indonesia."

"Metode pendanaan terorisme di Indonesia terus berkembang semakin kompleks dan variatif. Dari yang awalnya menggunakan metode-metode konservatif seperti kurir tunai, badan amal, dan perampokan bank, kini mereka mulai memanfaatkan kemajuan teknologi keuangan, seperti peretasan terhadap Fintech ilegal. Dengan demikian, penelitian ini bertujuan untuk menjelaskan dan menganalisis pertimbangan teroris dalam memanfaatkan fintech sebagai sumber pendanaan mereka serta penanggulangannya. Analisis dalam penelitian ini dilakukan dengan menggunakan teori yang digagas oleh Michael Freeman tentang pertimbangan teroris dalam pemilihan metode pendanaan mereka. Metode penelitian yang digunakan adalah studi kasus, yaitu peretasan speedline.com oleh Rizki Gunawan pada tahun 2011 untuk pendanaan terorisme. Data penelitian didapatkan melalui wawancara pelaku peretasan tersebut, ahli dari PPATK, OJK, penyidik Densus 88, laporan, serta jurnal yang berkaitan dengan permasalahan penelitian. Hasil penelitian ini menunjukkan bahwa aspek yang menjadi prioritas utama dalam pendanaan terorisme adalah aspek keamanan pelaku, kuantitas dana yang didapat, dan tingkat kemudahan dalam mengumpulkan dana.

Terrorism financing method in Indonesia is developing in an alarming rate, to the point it is now becoming more complex than before. Terrorists traditionally use conventional methods like robberies, charities and courier service to fund their activities, today terrorists are able to utilize modern methods in financing their activities due to the rapid development in financial technology nowadays, one example is by hacking an illegal Fintech Company. Therefore, this research is conducted in order to explain and analyze the consideration behind the usage of illegal fintech company to finance terrorism activities and how to prevent it. The analysis on this research is done by using the theory that is coined by Michael Freeman about the reasoning of terrorists when choosing their financing method. The method used in this research is case study, and the case that is used for this research is the terrorism financing hacking of speedline.com in 2011 by Rizki Gunawan. Research data are acquired from interviews with the perpetrators, experts from INTRAC (PPATK), Special Detachment 88, reports, and journals that are relevant with the research. As a result, this study found that the priority aspects in terms of terrorist financing are security, quantity, and the simplicity while obtaining funds."

"ABSTRAK
Fintech adalah suatu layanan jasa sebagai suatu inovasi teknologi di bidang keuangan yang juga perpaduan antara finance dan technology yang mana mengenalkan suatu produk dan layanan baru yang inovatif yang berbasis dari suatu perangkat lunak. Penelitian ini bertujuan untuk menguji apakah variabel pada Product-Related Perceived Usefulness, Perceived Ease of Use, Compatibility, Perceived Risk, Perceived Cost, Trialability, Additional Value , Personal-Related Factors Personal Inovatif dan Daya serap, Trust dan Daya Tarik. Alternatif berpengaruh positif terhadap Intention to adopt Fintech di bidang pembayaran. Metode penelitian menggunakan teknik analisis Structural Equation Modelling (SEM) dengan responden yang diteliti sebanyak 249 orang dengan menggunakan metode pengambilan sampel Non-Probability Sampling berupa convenience sampling dan snowball sampling. Hasil penelitian menunjukkan bahwa variabel Perceived Usefulness, Compatibility, Trialability, Absorptive Capacity, Trust berpengaruh positif terhadap Intenton to adopt. Namun, variabel Perceived Cost berpengaruh negatif dan perceived Ease of Use, Perceived Risk, Additional Value, dan Daya Tarik alternatif tidak berpengaruh terhadap minat untuk menggunakan program Fintech di bidang pembayaran.

ABSTRACT
Fintech is a technological innovation service in finance which is also a combination of finance and technology which introduces an innovative new product and service based on a software. This study aims to examine whether the variables in Product Related Perceived Usefulness, Perceived Ease of Use, Compatibility, Perceived Risk, Perceived Cost, Trialability, Additional Value, Personal Related Factors, Trust and Attractiveness Alternative has positive effect on Intention to adopt Fintech in the field of payment services. The research method used Structural Equation Modeling SEM analysis technique with 249 respondents using Non Probability Sampling method in the form of convenience sampling and snowball sampling. The results showed that the variables Perceived Usefulness, Compatibility, Trialability, Absorptive Capacity, Trust have positive effect on Intenton to adopt. However, the Perceived Cost variable have negative effect and perceived Ease of Use, Perceived Risk, Additional Value, and Alternative Pull have no effect on interest to use Fintech program in the payment field."
