Alternative Policy in the Final Tax on Stock Sales Conducted Through Stock ExchangesBeginnings 1995, any gains received by any individual person or body corporate on stock sales which are conducted through stock exchanges have been subjected to a final tax of 0.1% of their gross value. The tax is withheld by the stock exchange, broker, or dealer concerned. In practice, this policy has caused problems due to the fact that the tax is conclusive in nature such that one cannot claim that the economic resources in the form of money or funds received from stock sales are revenue until any costs and/or expenses which may be incurred are taken into consideration. In addition, in a bearish market even taxpayers who have suffered capital losses must pay this tax. Such losses cannot be compensated for or refunded. However, in a bullish market the policy is found "favorable" as stock sellers are not subject to the maximum marginal tax rate of 30% but a final tax of a mere 0.1% of any capital gains they enjoy. Discussion focuses on such things as the reasons for the introduction of the final tax, whether this tax meets the principles of justice, problems which arise from this tax and how to apply it to foreign taxpayers in connection with tax treaties. In addition to the concept of income, particularly the accretion concept of income, four maxims, equality, certainty, convenience and economy, were employed to deal with such issues. For this purpose, the author reviewed the final tax policy employing a descriptive and analytical method through both desk research and field research to gather the relevant data and information. From the review, the author has found that the policy has caused injustice to taxpayers. Taking into consideration the ideals as set forth in the accretion concept of income or the S-N-S concept, an increase in economic capacity which forms an income serves as the net earnings which permit deduction from any costs which may be incurred and connected with the processes to gain, collect and maintain such an income. In addition, this increase must be capable of being measured and must not distinguish between the types of its source so that horizontal equity may be applied, equal treatment for the equals. In further addition, the policy employs a flat rate. As a result, small-scale taxpayers bear an equal rate to that born by large-scale taxpayers. Ideally, tax rates should reflect vertical equity In that the more income one enjoys the bigger tax burden he should bear, unequal treatment for the unequal. Notwithstanding, tax authorities hold the sovereign tax power and have an interest in the supervision and securing tax receipt potential, in particular that from securities taxpayers. Notwithstanding its simplification effect on tax collection, the self-assessment system which has been introduced through the Income Tax Law has brought about technical problems in the reporting of capital gains on stock sales through annual returns. In order to deal with the problems above, the author recommends revoking the charging of the final tax on stock sales and treating such sales as withholding tax objects instead. Hence, it is expected that tax authorities will not lose tax receipt potential at one time from stock transactions on stock exchanges and that taxpayers' concern with equity will be answered. xii + 119 pages Bibliography: 30 books, 11 official documents, several daily general newspapers (from the years 1970 up to and including 2001)

Usaha-Mikro-Kecil-Menengah (UMKM) di Indonesia berkembang secara signifikan setiap tahunnya. Namun perkembangan ini tidak diikuti dengan tingkat kepatuhan pajak dari pelaku UMKM. Pemerintah berusaha meningkatkan kepatuhan pajak dari pelaku UMKM salah satunya dengan memberikan kebijakan berupa pengenaan PPh Final sebesar 0,5% dari omzet yang diharapkan meningkatkan kepatuhan pajak pelaku UMKM. Penelitian ini mengambil site penelitian di Kepulauan Seribu. Penelitian ini menggunakan pendekatan campuran dengan teknik analisa data kualitatif dan kuantitatif. Penelitian ini meninjau bagaimana implementasi kebijakan PPh Final UMKM di Kepulauan Seribu serta dampaknya terhadap kepatuhan pajak, dan meninjau faktor-faktor yang mempengaruhi kepatuhan pajak. Penelitian ini menunjukkan bahwa implementasi kebijakan PPh Final di Kepulauan Seribu tergolong cukup. Implementasi kebijakan penurunan tarif PPh Final menunjukkan titik tarif yang optimal. Serta kebijakan penurunan tarif PPh Final UMKM memiliki pengaruh signifikan terhadap kepatuhan pajak. Penelitian ini diharapkan dapat memberikan masukan kepada KPP Jakarta Pademangan dan KP2KP Kepulauan Seribu dalam mengimplementasikan kebijakan PPh Final UMKM di Kepulauan Seribu. ......Micro-Small-Medium Enterprises (MSMEs) in Indonesia develops significantly each year. However, this development was not followed by the level of tax compliance of MSME actors. The government is trying to improve tax compliance from MSME actors, one of which is by providing a policy in the form of imposing Final tax income of 0.5% of turnover which is expected to increase tax compliance of MSME actors. This study took the research site in Kepulauan Seribu. This study uses a mixed approach with qualitative and quantitative data analysis techniques. This study examines how the implementation of the MSMEs Final tax income policy in the Thousand Islands and its impact on tax compliance, and looks at the factors that affect tax compliance. This study shows that the implementation of the Final Income Tax policy in the Thousand Islands is sufficient. The implementation of the Final Income Tax rate reduction policy shows the optimal tariff point. And the policy for reducing the MSMEs Final tax income tariff has a significant effect on tax compliance. This research is expected to provide input to office tax Jakarta Pademangan and Kepulauan Seribu in implementing the MSMEs Final tax income policy in Kepulauan Seribu.

ABSTRACT
Penelitian ini bertujuan untuk mendeskripsikan implementasi kebijakan Pajak Penghasilan (PPh) atas bunga deposito dari Devisa Hasil Ekspor dan menganalisis hambatan dan solusi dalam penerapan kebijakan Pajak Penghasilan atas bunga deposito dari Devisa Hasil Ekspor. Kebijakan Pajak Penghasilan atas bunga deposito dari Devisa Hasil Ekspor yang dibahas dalam penelitian ini adalah tarif khusus bagi bunga deposito dari Devisa Hasil Ekspor yang diatur dalam PP No. 123 Tahun 2015 tentang Pajak Penghasilan atas Bunga Deposito dan Tabungan serta Sertifikat Bank Indonesia. Metode penelitian yang digunakan adalah kualitatif dengan teknik pengumpulan data wawancara mendalam (indepth interview). Hasil dari penelitian ini adalah bahwa dalam implementasi kebijakan pajak terdapat empat faktor yang menentukan keberhasilan dari kebijakan sebagaimana konsepsi implementasi kebijakan menurut Edwards III yaitu meliputi komunikasi, sumberdaya, disposisi, dan struktur birokrasi dalam mencapai tujuan dari kebijakan ini dan terdapat hambatan berupa kurang menariknya kebijakan dan kurang intensifnya sosialiasi yang diberikan oleh pihak implementor.
ABSTRACT
This study aims to describe the implementation of income tax policy on interest on deposits from foreign exchange proceeds from exports and identify obstacles and solutions in the application of income tax policies on interest on deposits from foreign exchange proceeds from exports. The Income Tax Policy on interest on deposits from Foreign Exchange Export Results discussed in this study is a special rate for interest on deposits from Foreign Exchange Export Results as regulated in PP No. 123 of 2015 concerning Income Tax on Interest on Deposits and Savings and Bank Indonesia CertificatesThe research method used is qualitative in-depth interview data collection techniques. The results of this study are that in the implementation of tax policy there are four factors that determine the success of the policy as Edwards III's conception of policy implementation includes communication, resources, disposition, and bureaucratic structure in achieving the objectives of this policy and there are obstacles in the form of less attractive policies and less intensive socialization provided by the implementor.

Penelitian ini bertujuan untuk menganalisis dampak perubahan PSAK 46 Pajak Penghasilan Revisi 2013 terhadap penyajian pajak final perusahaan. Penelitian menggunakan perusahaan konstruksi dan properti yang terdaftar di Bursa Efek Indonesia tahun 2014 ndash; 2016 sebagai sampel. Pajak final tidak lagi dicakup dalam lingkup PSAK 46. Hasil penelitian menunjukkan terdapat enam klasifikasi penyajian pajak final dalam perusahaan, serta dari hasil uji beda rata-rata rasio keuangan yang terdiri dari tarif pajak efektif, cash ETR dan operating profit margin menunjukkan bahwa keberagaman penyajian pajak final memiliki dampak yang signifikan terhadap ketiga rasio tersebut. Implikasi yang muncul dari keberagaman penyajian pajak final adalah laporan keuangan sulit dibandingkan.
ABSTRACT
The objective of this study is to analyze the impact of changing in Indonesian Accounting Standards 46 PSAK 46 Income Tax Revised 2013 on final tax presentation in financial statements. This study used a construction and real estate companies which listed on the Indonesian Stock Exchange for book period 2014 2016 as the sample. The result shows that there are six classifications of final tax presentation in the company, also the result of average testing of financial ratios consisting of effective tax rate, cash ETR and operating profit margin indicates that the variety of final tax presentations have a significant impact on those three ratios. The implications arising from the diversity of final tax presentations are financial statement is uncomparable.
