Seen as a breakthrough in protecting migrant workers, of whom are predominantly female, Law No. 18/2017 on the Protection of Indonesian Migrant Workers (The Migrant Workers Act of 2017), replacing Law No. 39/2004, is not void of imperfections. Prima facie, the act may be seen as progressive development in protecting Indonesian migrant workers, having embraced the many experiences and realities their profession entails. However, upon investigating the Act under the careful lens of Feminist Jurisprudence as well as other national legal instruments for gender equality, the Migrant Workers Act of 2017 still provides unsatisfactory details in regards to the protection of female workers; if the government does not quickly act by making corresponding regulations, the Act will in fact, introduce us to new problems from what was seen as a one-size fits all solution. In its implementation, legal literacy becomes one of the most profound challenges the 2017 Act faces. Field research findings in three areas (Sukabumi, Lampung, and Jakarta) show that legal literacy on this Act remains sparse. This article will address problems in regards to the 2017 Act, its implementation, and solutions to develop more tangible legal instruments in protecting Indonesian migrant workers, in particular, women, who, in foreign lands, often face the risk of violence and abuse on a daily basis with little to no protection.

Ditegakkannya Hukum Syariah di Provinsi Aceh memunculkan serangkaian peraturan bernuansa Islam. Hadirnya peraturan-peraturan yang mengatur perilaku menyimpang kemudian memunculkan diskriminasi terhadap perempuan dalam pelaksanaannya. Penelitian ini kemudian mencoba melihat konstruksi perilaku menyimpang terhadap perempuan yang terkandung di dalam peraturan tersebut. Penelitian ini menggunakan pendekatan Sosiologi Hukum, Feminist Jurisprudence, dan Kriminologi Kritis melalui Teori Realitas Sosial Kejahatan. Menggunakan pendekatan kualitatif dengan memakai studi dokumen dan wawancara, serta ditambah dengan studi literatur, penelitian ini menemukan bahwa dalam dua Qanun tidak terdapat kalimat bias gender yang diskriminatif terhadap perempuan. Diskriminasi terjadi karena konstruksi budaya dalam masyarakat yang dipengaruhi oleh patriarki dalam menginterpretasikan Qanun. ...... The implementation of Shariah Law in Aceh Province triggered creation of series of Islam related rules. Several rules that regulate deviance, in time, impose discrimination towards women in the practice. This research tries to oversee the constructed deviance of women that were defined within the rules. This research based on Sociology of Law approach, Feminist Jurisprudence, and Critical Criminology within Social Reality of Crime Theory. Using qualitative approach supported with documents study and interview completed with literature study, this research found that in two Qanun there is no gender-biased lines and discrimination towards women. Discrimination in this case happened because of cultural construction within the local people that influenced by patrialchal views in interpreting Qanun.
