The Dewan Perwakilan Daerah (Regional Representatives Council - DPD) and the Dewan Perwakilan Rakyat (House of Representatives - DPR) are institutions which represent the people in the parliament of the Republic of Indonesia. However, these two institutions do not have equal powers, including the powers related to the control function. The DPD’s function related to control is provided for under Article 22D paragraph (3), Article 23E paragraph (2), and Article 23F paragraph (1) of the Third Amendment to the 1945 Constitution of the Republic of Indonesia. The DPD can exercise control of the implementation of certain laws related to regional interests, the implementation of the State Budget, taxes, education and religion, reporting on the results of supervision exercised by it to the DPR; it receives the results of state finance audit conducted by the Badan Pemeriksa Keuangan (Audit Board - BPK), and provides its consideration to the DPR in electing members of BPK. Based on a comparison among various countries it is evident that although some countries have weaker control authorities compared to those of the DPD, it is the DPD elected directly through the general elections which has the weakest authority among them. Proportionate powers need to be granted to the DPD in order to ensure that that the objective of its establishment in representing the interests of the regions may be achieved.

Pasal 22D ayat (2) dan (3) serta Pasal 23 ayat (2) dan (3) UUD NRI 1945 menempatkan konstruksi relasi DPR dengan DPD terkait Pengawasan atas APBN tidak berimbang. Kewenangan DPD yang diberikan sangat lemah, menempatkan DPD hanya sebagai supporting system bagi DPR di Parlemen. Penelitian ini menggunakan pendekatan studi perbandingan hukum dan perundang-undangan, bentuk hasil penelitian bersifat preskriptif-analitis. Hasil penelitian menemukan kewenangan formal yang dimiliki DPD dengan DPR tidak sesuai dengan teori bikameralisme dan konsep fungsi pengawasan parlemen. Secara teori bikameralisme dan konsep fungsi pengawasan parlemen, DPD yang memiliki legitimasi tinggi seharusnya memiliki kedudukan dan kewenangan pengawasan atas APBN setara dengan DPR baik secara ex ante maupun ex post. Berdasarkan perbandingan hukum yang dilakukan dengan enam negara, menempatkan kamar kedua baik secara pengawasan ex ante mapun ex post ikut terlibat dalam pengawasan APBN. Kedepan, DPR dan DPD seharusnya mempunyai kedudukan, kewenangan, serta hubungan yang setara. Langkah penguatan yang dapat ditempuh, melakukan perubahan Pasal 22D ayat (2) dan (3) serta Pasal 23 ayat (2) dan (3) UUD NRI 1945 atau yang lebih praktis adalah dengan membentuk tata tertib hubungan kerja antara DPR dan DPD terkait pengawasan atas APBN yang memungkinkan DPD dapat terlibat dengan baik. ......Article 22D paragraphs (2) and (3) and Article 23 paragraphs (2) and (3) of the 1945 Constitution of the Republic of Indonesia place the construction of the relationship between the DPR and the DPD regarding Supervision of the APBN as unequal. The authority of the DPD given is very weak, placing the DPD only as a supporting system for the DPR in Parliament. This research uses a comparative study approach of law and legislation, the form of research results is prescriptive-analytical. The results of the study found that formal authority the DPD has with the DPR are not in accordance with the theory of bicameralism and the concept of the parliamentary oversight function. In theory, bicameralism and the concept of parliamentary oversight function, a DPD that has high legitimacy should have the position and authority to supervise the APBN on a par with the DPR, both ex ante and ex post. Based on legal comparisons conducted with six countries, placing the second chamber both in ex ante and ex post supervision is involved in APBN supervision. In the future, the DPR and DPD should have equal position, authority and relationship. Strengthening steps that can be taken, amending Article 22D paragraphs (2) and (3) as well as Article 23 paragraphs (2) and (3) of the 1945 Constitution of the Republic of Indonesia or more practically is to form an orderly working relationship between the DPR and DPD regarding supervision over APBN which allows the DPD to be involved properly.
