"ABSTRAK
Delegasi keperawatan merupakan salah satu aktifitas kepala ruangan melaksanakan fungsi manajemen dalam pemberian pelayanan keperawatan. Mekanisme delegasi keperawatan yang efektif menjamin kualitas pendelegasian keperawatan. Penelitian ini bertujuan memperoleh model delegasi keperawatan yang efektif dan meningkatkan kualitas pendelegasian keperawatan kepala ruangan. Penelitian ini dilakukan tiga tahap yaitu tahap 1 identifikasi masalah melalui penelitian deskriptif kualitatif fenomenologi, tahap 2 pengembangan model, dan tahap 3 penelitian kuasi eksperimen pre-posttest control group design. Metode sampling tahap 1 dengan purposive sampling dengan 4 partisipan. Tahap 3 sampel dipilih secara probability sampling yaitu simple random sampling sejumlah 70 responden 35 responden kelompok intervensi dan 35 kelompok kontrol . Hasil penelitian tahap 1 didapatkan 5 tema yaitu proses kegiatan delegasi keperawatan belum sesuai prinsip, prosedur delegasi keperawatan tidak standar, kegiatan delegasi tidak terdokumentasi, perbedaan pemahaman antar partisipan tentang prosedur delegasi, dan belum ada penerapan penghargaan atau sanksi untuk proses delegasi yang telah dilaksanakan. Tema tersebut dikembangkan pada tahap ke 2 menjadi model delegasi keperawatan yang diberi nama lsquo;Relactor rsquo;. ABSTRACT
Nursing delegation becomes one of management function of head nurse 39 s activity in providing nursing care. The mechanism of effective nursing delegation assures quality of nursing delegation. This research aimed to discover effective nursing delegation model and improve quality of nursing delegation of head nurse. This study undergone 3 steps include step 1 problem identification through descriptive qualitative phenomenology research, step 2 model development, and step 3 quasi experimental research pre post test control group design. Sampling method of step 1 with purposive sampling involved 4 participants. Seventy respondents 35 respondents at each group had been collected by using simple random sampling probability sampling during step 3. Research result of step 1 obtained 5 themes, those were inappropriate nursing delegation process, unstandardized nursing delegation procedure, undocumented delegation activity, different understanding among participants about delegation procedure, and the absence of reward and punishment for implemented delegation. Those themes were developed at step 2 that hereinafter called nursing delegation model lsquo Relactor rsquo . Step 3 was successfully proved that there was significant influence of nursing delegation model lsquo Relactor rsquo toward quality of delegation. The study recommended that lsquo Relactor rsquo model can be applied in nursing service and be executed continuous monitoring to measure success."

"This research is about the Implementation of District Integrated Administration Service (PATEN) in bringing closer and improving services to the community in Siak Regency, Riau Province. Law Number 23 of 2014 on Regional Government states that District Heads must implement two authorities, namely Attributive authority, and Delegated authority. The District head as, a regional apparatus, is no longer the head of a region that must obtain a delegation of some the authority of the Regent/Mayor as stipulated by Regent/Mayor regulation. Not all Regents/Mayors delegate part of the authority to District Heads so that the implementation of service is centered in Regency/City. This research descriptive qualitative method, and data collection technique is in the form of the interview, observation and documentation. The results revealed that (1) PATEN in Siak District can bring closer and improve service to the community free of charge; (2) There is a strong commitment from the Siak Regent in the delegation of some of the licensing authority to the District Heads. For example, the presence of service space in the district with service counters, PATEN officers, the incentives of PATENT officers, and the direct supervision from the Regent. (3) Positive responses from the community such as better service, free, and close to the service recipient community."

"Dalam konteks pemberian layanan kesehatan, kekurangan tenaga medis, terutama dokter, di daerah terpencil dan kurang terlayani telah mengharuskan pendelegasian tanggung jawab medis tertentu kepada perawat. Praktik ini, meskipun penting untuk menyediakan perawatan kesehatan yang tepat waktu dan efektif, menimbulkan pertanyaan hukum yang rumit mengenai ruang lingkup wewenang, kewajiban, dan kerangka hukum keseluruhan perawat yang mengatur tindakan mereka. Penelitian ini membangun kembali konstruksi hukum Hukum Administrasi Negara dan Hukum Kesehatan mengenai pelimpahan wewenang tindakan medis, khususnya dalam konteks di daerah terpencil. Penelitian ini mengadopsi pendekatan doktrinal, memanfaatkan doktrin dan prinsip hukum dari Hukum Kesehatan untuk menganalisis konsep pelimpahan wewenang dokter kepada perawat di daerah terpencil. Doktrin hukum utama, seperti doktrin life-saving oleh van der Mijn dan prolonged arms doctrine oleh HJJ. Leenen, akan menjadi dasar untuk memberikan pemahaman yang komprehensif tentang pelimpahan wewenang tindakan medis tersebut. Dengan mengeksplorasi konstruksi hukum seputar pelimpahan wewenang dokter kepada perawat, penelitian ini memberikan kerangka hukum untuk dapat dijadikan dasar penyusunan kebijakan hukum bagi perawat yang bertugas di daerah terpencil. Konstruksi hukum yang mengatur pelaksanaan pelimpahan wewenang dokter kepada perawat di daerah terpencil mempunyai peran penting dalam memastikan pemberian layanan kesehatan yang efektif. Penelitian ini berfokus dengan studi perawat di Puskesmas Kecamatan Seko, Kabupaten Luwu Utara, Sulawesi Selatan. Faktor keterbatasan yang dihadapi oleh perawat di Kecamatan Seko menjadi bahan analisis utama untuk dapat menemukan konstruksi hukum yang sesuai dengan kondisi pelayanan kesehatan di daerah terpencil. Hasil penelitian ini menunjukkan diperlukannya rekonstruksi Hukum Administrasi Negara dan Hukum Kesehatan terhadap implementasi pelimpahan wewenang tindakan medik dokter kepada perawat atas adanya faktor keterbatasan di daerah terpencil untuk menunjukkan adanya kebutuhan perluasan peran Perawat dalam kondisi tertentu yang bertujuan untuk penyelamatan nyawa.

In the context of healthcare provision, the scarcity of medical personnel, particularly doctors, in remote and underserved areas has necessitated the delegation of specific medical responsibilities to nurses. This practice, vital for delivering timely and effective healthcare, raises intricate legal inquiries concerning the scope of authority, duties, and overarching legal framework regulating the actions of nurses. This research reconstructs the legal constructs of Administrative Law and Health Law regarding the delegation of medical authority, specifically within remote regions. Employing a doctrinal approach, it leverages legal doctrines and principles from Health Law to analyze the concept of delegating doctors' authority to nurses in remote areas. Key legal doctrines, such as the life-saving doctrine by van der Mijn and the prolonged arms doctrine by HJJ. Leenen, serve as foundations to establish a comprehensive understanding of the delegation of medical authority. By exploring the legal constructs surrounding the delegation of doctors' authority to nurses, this research provides a legal framework to serve as the basis for formulating legal policies for nurses operating in remote areas. The legal constructs governing the implementation of delegating doctors' authority to nurses in remote areas play a crucial role in ensuring the provision of effective healthcare. This research focuses on studying nurses at the Seko Sub-district Health Center in North Luwu Regency, South Sulawesi. The limiting factors faced by nurses in Seko Sub-district serve as the primary analytical material to discern legal constructs suitable for the healthcare conditions in remote areas. The findings of this study underscore the necessity for a reconstruction of Administrative Law and Health Law concerning the implementation of delegating doctors' medical authority to nurses due to limiting factors in remote areas, demonstrating the need for expanding the role of nurses in specific circumstances aimed at preserving lives."

"Kajian dan analisis hukum dalam tesis ini bertujuan untuk mendapatkan pedoman-pedoman mengenai apa yang harus dilakukan untuk mengatasi masalah-masalah yang timbul dalam pelaksanaan eksekusi Hak Tanggungan dalam hal terjadi pengalihan Hak Tanggungan. Hak Tanggungan merupakan perjanjian accesoir, dimana keberadaannya ditentukan oleh adanya perjanjian pokok yang dapat berupa perjanjian kredit atau perjanjian lainnya yang menimbulkan utang. Untuk itu Hak Tanggungan dapat beralih karena hukum apabila piutang (perjanjian pokok) yang dijamin dengan Hak Tanggungan beralih kepada pihak ketiga/kreditur yang baru.Salah satu bentuk Peralihan Hak Tanggungan adalah Cessie, yaitu perbuatan hukum mengalihkan piutang oleh Kreditor pemegang Hak Tanggungan kepada pihak lain. Suatu obyek Hak Tanggungan dapat dibebani lebih dari satu Hak Tanggungan guna menjamin pelunasan lebih dari satu utang, sehingga kemudian akan muncul Pemegang Hak Tanggungan peringkat I, II, dan seterusnya. Penentuan mengenai siapa yang mendapat prioritas di antara para pemegang Hak Tanggungan tersebut penting dalam rangka pelaksanaan eksekusi Hak Tanggungan untuk pelunasan masing-masing utang yang dijamin dengan satu Hak Tanggungan yang sama. Namun ternyata dalam praktek hal itu tidak menjamin para pemegang Hak Tanggungan yang lainnya mendapat pemenuhan piutangnya, karena pemegang Hak Tanggungan peringkat II dan seterusnya tidak mengetahui jika ada pelaksanaan eksekusi terhadap obyek Hak Tanggungan yang dimohonkan oleh pemegang Hak Tanggungan Peringkat I ditambah Pula kemungkinan adanya itikad tidak baik dari pemegang Hak Tanggungan peringkat I. Untuk itu dalam tesis ini dibahas bagaimana seharusnya hubungan antara para pemegang Hak Tanggungan dalam pelaksanaan eksekusi Hak Tanggungan, sehingga masalah-masalah yang timbul pada saat pelaksanaan eksekusi Hak Tanggugan dapat diminimalisir."

"Penelitian ini berangkat dari permasalahan adanya praktik pendelegasian peraturan langsung dari undang-undang kepada peraturan menteri secara langsung yang berpotensi bertentangan dengan semangat sistem presidensial yang dianut di Indonesia dan semangat pasal 5 ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Penelitian dilaksanakan dengan tujuan untuk mengetahui pembentukan undang-undang dalam sistem presidensial di Indonesia, dan praktik pendelegasi peraturan dari undang-undang kepada peraturan menteri secara langsung dalam sistem presidensial di Indonesia, serta pendelegasi peraturan dari undang-undang yang baik dimasa yang akan datang. Dalam penelitian ini, metodologi yang dilaksanakan adalah penelitian normatif. Hasil Penelitian menunjukkan bahwa Pertama, Pembentukan undang-undang dalam sistem presidensial Indonesia mempunyai ke khasan tersendiri. Hal itu dapat dilihat dengan adanya kekuasaan pembentukan peraturan perundang-undangan yang besar yang dimiliki Presiden dalam konstitusi Indonesia. Kedua, Pendelegasian secara langsung dari undang-undang kepada peraturan menteri dalam praktiknya masih sering dilakukan, dalam kurun waktu 2015 sampai dengan 2017 terdapat 16 undang-undang yang memberikan delegasi langsung kepada Peraturan Menteri. Pendelegasian secara langsung dari undang-undang kepada peraturan menteri secara filosifis terkesan mengingkari sistem presidensial di Indonesia. Secara historis, praktik pendelegasian peraturan dari undang-undang kepada peraturan menteri secara langsung dipahami sebagai bagian dari proses transformasi praktikal yang tidak sempurna dari sistem parlementer pasca Maklumat Pemerintah 14 November 1945 hingga saat ini.

This research departs from the problem of the practice of delegating direct regulations from the law to ministerial regulations directly which has the potential to contradict the spirit of the presidential system adopted in Indonesia and the spirit of article 5 paragraph (2) of the 1945 Constitution of the Republic of Indonesia. with the aim of knowing the establishment of laws in presidential systems in Indonesia, and the practice of delegating regulations from the law to ministerial regulations directly in presidential systems in Indonesia, as well as regulatory delegators from good laws in the future. In this study, the methodology implemented was normative research. Research results show that First, the establishment of laws in Indonesian presidential systems has its own specificity. This can be seen by the establishment of a large number of laws and regulations that the President has in the Indonesian constitution. Second, direct delegation of the law to ministerial regulations is still practiced in practice, in the period 2015 to 2017 there are 16 laws that provide direct delegation to Ministerial Regulations. Direct delegation of the law to ministerial regulations philosophically seems to deny the presidential system in Indonesia. Historically, the practice of delegating regulations from the law to ministerial regulations was directly understood as part of the imperfect process of practical transformation of the parliamentary system after the Government Declaration of November 14, 1945 to the present."
